No. 0342H.03C Bill No. HCS for HB 159 Page 3 of April 3, 2023 JLH:LR:OD FISCAL ANALYSIS ASSUMPTION Officials from Department of Elementary and Secondary Education (DESE) state DESE does not currently collect all/some of the required data through MOSIS. New data collection and reporting will be required. Minimum of 8 modifications will be needed: educational settings. Officials from the Office of Administration – Information Technology (ITSD) state it is assumed that every new IT project/system will be bid out because all ITSD resources are at full capacity. This project would have to be prioritized by DESE to be worked among DESE's other projects. ITSD assumes this bill would require changes to the MOSIS collection processes, as additional information/data would need to be collected from districts including charter schools. The proposed bill requires that the existing APR processes include data calculations and elements that are not available to DESE today. Thus, these processes will be impacted, and will require changes to pull from the MOSIS data collections received from districts. ITSD assumed the disciplinary removal of pupils is not collected data by DESE today. DESE further assumes that DESE has the power to enforce that districts provide this data per the requirement in the proposed bill. “Before July 1, 2025, and before July first each year thereafter, school districts and charter schools shall annually report". ITSD assumed the data collection process, which is MOSIS, is just one component of the needs. The data has to also be quality- checked and securely stored. ITSD assumed the existing database structures are able to be utilized, with known required changes for securely storing the new data elements collected from districts. The ITSD data process that pull in the district reported data, aggregate it as per state requirements/laws, and any calculations within the processes would need reviewed, and adjusted to meet the new L.R. No. 0342H.03C Bill No. HCS for HB 159 Page 4 of April 3, 2023 JLH:LR:OD requirements proposed in this bill. The additional data elements are pretty significant and will take time to first, collect, and secondly, to summarize/aggregate accurately per the bill requirements. The estimate includes this. ITSD estimates the project would take 1,836.00 hours at a contract rate of $95 for a total cost of $174,420 with on-going support costs (estimated at $36,000 per year). Oversight assumes there could be additional costs for school districts for data collection and reporting. Oversight will show an impact to school districts ranging from $0 (no impact or can be absorbed with existing resources) to an unknown cost beginning in FY 2025. Oversight did not receive any responses from school districts related to the fiscal impact of this proposal. Oversight has presented this fiscal note on the best current information available. Upon the receipt of additional responses, Oversight will review to determine if an updated fiscal note should be prepared and seek the necessary approval to publish a new fiscal note. Oversight only reflects the responses received from state agencies and political subdivisions; however, school districts were requested to respond to this proposed legislation but did not.
