                    HB174--REVIEWOFPRESIDENTIALEXECUTIVEORDERS

ThisbillprovidesthattheMissouriHouseofRepresentativesmayreviewanyexecutiveorderissued
bythePresidentoftheUnitedStatesiftheorderhasnotbeenaffirmedbyavoteofCongressand
signedintolaw.Uponreview,theHousemayrecommendthattheAttorneyGeneralandthe
Governorexaminetheorderfurthertodeterminetheconstitutionalityofitandwhetherthestate
shouldseekanexemptionfromtheapplicationoftheorderorseektohavetheorderdeclaredan
unconstitutionalexerciseofauthoritybythePresident.
Nostateagency,politicalsubdivision,oranyofficialsoremployeesofthisstateoranypolitical
subdivisioninthisstateshallimplementanexecutiveorderthatrestrictsaperson'sConstitutional
rightsorisdeterminedbytheAttorneyGeneraltobeunconstitutionaliftheorderrelatestothe
following:
(1)Theregulationofbusinessactivitiesorpersonalbehaviorsduringapandemicorotherpublic
healthemergency;
(2)Theregulationofnaturalresources;
(3)Theregulationoftheagriculturalindustry;
(4)Theregulationoflanduse;
(5)Theregulationofthefinancialsectorthroughtheimpositionofenvironmental,social,or
governancestandards;or
(6)TheregulationoftheConstitutionalrighttokeepandbeararms.
