FISCAL ANALYSIS
ASSUMPTION
Officials from the Department of Revenue, Missouri Department of Transportation, 
Missouri Highway PatrolDepartment of Elementary and Secondary Education, City of 
Kansas City, City of Springfield, Phelps County Sheriff, Kansas City Police Department 
and St. Louis County Police Department each assume the proposal will have no fiscal impact 
on their respective organizations. Oversight does not have any information to the contrary. 
Therefore, Oversight will reflect a zero impact in the fiscal note for these agencies.  
The St. Joseph Police Department assumes this proposal could cause the department to lose 
revenue generated from summonses, which in turn go into their training fund to help provide 
training for officers.
Oversight notes in §479.359, political subdivisions can only collect up to 20% (as of January 1, 
2016) of their annual revenue from fines, bond forfeitures, and court costs for municipal 
ordinance violations and minor traffic violations.  If this revenue exceeds 20%, the excess 
amount is to be sent to the Department of Revenue.  The Department of Revenue will then 
distribute the excess funds to the schools of the county in which the revenue was collected.
According to DOR’s FY 2021 Financial and Statistics Report (https://dor.mo.gov/revenue-
annual-financial-report/documents/FY21FinancialAndStatisticalReport.pdf), there were 42 
counties that collected excess revenue from traffic fines, ranging from $31 (St. Clair County) up 
to $105,371 (St. Louis County). 
Oversight assumes some local law enforcement agencies and local political subdivisions could 
lose revenue from not being able to stop, inspect or detain drivers for traffic violations in which 
they currently conduct stops; therefore, Oversight will reflect an “Unknown, less than $250,000” 
fiscal impact to local political subdivisions.  
Oversight only reflects the responses received from state agencies and political subdivisions; 
however, other local political subdivisions and law enforcement agencies were requested to 
respond to this proposed legislation but did not. A listing of political subdivisions included in the 
Missouri Legislative Information System (MOLIS) database is available upon request.

FISCAL IMPACT – Small Business
No direct fiscal impact to small businesses would be expected as a result of this proposal.
FISCAL DESCRIPTION
This bill creates the "Driver's Protection Act", which provides that no person will be stopped, 
inspected, or detained solely for a traffic violation that does not involve speeding or failure to
register or re-register a vehicle, that does not involve an accident or injury, and that does not 
involve points assessed by the Department of Revenue.
This legislation is not federally mandated, would not duplicate any other program and would not 
require additional capital improvements or rental space. L.R. No. 0843H.01I
