Thisbillprovidesthatif,precedingthedateofinjuryordeath,anemployeewhowasemployedon activedutyasafirstresponderisdiagnosedwithamentalimpairmentandsuchpersonwasnot previouslydiagnosedwithsuchanimpairment,theimpairmentshallpresumptivelybeconsidered anoccupationaldiseaseandshallbepresumedtohavearisenoutofandinthecourseof employment.Thispresumptionmayberebuttedbytheemployerorinsurer. Oneormorecompensablementalimpairmentclaimsarisingoutofasingleaccidentshall constituteasingleinjury.Amentalimpairmentarisingoutofandinthecourseofemployment causedbyasingleaccidentorcumulativetraumashallalsoconstituteacompensablemental impairmentclaim. Furthermore,amentalimpairmentshallnotbeconsideredanoccupationaldiseaseifitresults fromadisciplinaryaction,workevaluation,jobtransfer,layoff,demotion,promotion,termination, retirement,orsimilaractiontakeningoodfaithbytheemployer.
