Undercurrentlaw,traffickingdrugsinthefirstdegreeisaclass
Bfelonyifthepersonknowinglydistributes,delivers,
manufactures,produces,orattemptstodistribute,deliver,
manufacture,orproducesmorethan10milligramsoffentanyl. It
isaclassAfelonyiftheamountis20milligramsormore.
TraffickingdrugsintheseconddegreeisaclassCfelonyifthe
personknowinglypossessesorhasunderhisorhercontrol,
purchases,orattemptstopurchase,orbringsintothisstatemore
than10milligramsoffentanyl,andaclassBfelonyiftheamount
is20milligramsormore.
Thisbillamendsthequantitiesoffentanylfortheoffenseof
traffickingofdrugs,inthefirstandseconddegree,asfollows:
(1)DrugtraffickinginthefirstdegreeisaClassBfelonyfor
morethanthreebutlessthan14milligramsoffentanyl;
(2)DrugtraffickinginthefirstdegreeisaClassAfelonyfor
morethan14milligramsoffentanyl;
(3)DrugtraffickingintheseconddegreeisaClassCfelonyfor
morethanthreebutlessthan14milligramsoffentanyl;
(4)DrugtraffickingintheseconddegreeisaClassBfelonyfor
morethan14milligramsoffentanyl.
Thebillalsospecifiesthatitisnotagainstthelawto
manufacture,possess,sell,deliver,oruseanydevice,equipment,
orothermaterialforthepurposeofanalyzingcontrolled
substancestodetectthepresenceoffentanyl.
