ASSUMPTION
§192.257 – Return of fines/monetary penalties for violation of COVID-19 health orders
Officials from the Department of Health and Senior Services and the City of Kansas City 
assume the proposal will have no fiscal impact on their respective organizations. Oversight does 
not have any information to the contrary. Therefore, Oversight will reflect a zero impact in the 
fiscal note.  
Oversight notes the provisions of this proposal appear to apply only to Jackson County. No 
response to Oversight’s request for a statement of fiscal impact was received from Jackson 
County. Therefore, Oversight assumes the fiscal impact of returning any fines or monetary 
penalties related to COVID-19 health orders collected by Jackson County or city health 
departments within Jackson County will have a negative unknown fiscal impact in FY 2024.  
Oversight is not able to determine the amount of COVID-19 fine revenue collected in Jackson 
County since March 12, 2020.
Oversight notes the provisions of this proposal have an emergency clause.

FISCAL IMPACT – Small Business
This proposal may have a positive fiscal impact on any small business that incurred a 
fine/penalty because of local COVID-19 health orders. (§192.257)
FISCAL DESCRIPTION
This bill provides that any local public health agency that imposes a fine or other monetary 
penalty against any individual or business for failure to comply with a COVID-19 health order, 
defined as any order, ordinance, rule, or regulation intended to prevent or limit the spread of 
COVID-19, shall return all moneys collected from the individual or business within 60 days. 
The provisions of this proposal only apply to Jackson County. Any fine or other monetary 
penalty collected after March 12, 2020, and before the effective date of the bill for failure to 
comply with a COVID-19 health order shall be returned before November 1, 2023. The 
provisions of this bill shall not apply to any fine or monetary penalty that is not directly related to 
a failure to comply with a COVID-19 health order. 
This bill has an emergency clause.
This legislation is not federally mandated, would not duplicate any other program and would not 
require additional capital improvements or rental space.
