HB458--RISKPROTECTIONORDERS SPONSOR: Merideth Thisbillallowslawenforcementofficersoragenciestofilea petitionforariskprotectionorder(RPO)whentheofficeror agencybelievesanindividualposesasignificantdangerofcausing injurytohimselforothersbyhavingpossessionofafirearm. The petitionforanRPOshallidentifythequantity,types,and locationofallfirearmsbelievedtobeintherespondents possessionandidentifywhetherthereareanyotherknown protectionorderscurrentlyissuedagainsttherespondent. Thepetitioner,thelawenforcementofficeroragency,shallmakea goodfaithefforttoprovidenoticetoafamilyorhouseholdmember oftherespondent,andtoanyknownthirdpartywhomaybeatrisk ofviolence. Uponreceiptofapetition,thecourtshallorderahearingtobe heldnolaterthan14daysafterthedateoftheorderandshall issueanoticeofhearingtotherespondent. Thecourtshallcause acopyofthenoticeofhearingandpetitionbeforwardedonor beforethenextbusinessdaytotheappropriatelawenforcement agencyforserviceupontherespondent,asprovided. Apetitionermayrequestandthecourtmayissue,withoutnoticeto therespondentandonafindingofreasonablecause,atemporaryex parteRPO(TRPO)pendingthehearing. ArequestforaTRPOshall includedetailedallegationsbasedonpersonalknowledgethatthe respondentposesasignificantdangerofcausingpersonalinjuryin thenearfuturebyhavingafirearminhisorhercustodyor control. ThecourtshallholdahearingontheTRPOinpersonor bytelephoneonthedayoronthebusinessdayimmediately followingthedaythepetitionisfiled.SuchTRPOshallbeserved concurrentlywiththenoticeofhearingandpetition. Ifthecourt deniesthepetitioner'srequestforaTRPO,thecourtshallstate theparticularreasonsforthedenial. IndeterminingwhethergroundsforaRPOexist,thecourtmay consideranyrelevantevidence,includingbutnotlimitedto: (1)Recentactsorthreatsorotheractsorthreatsofviolence withinthelast12monthsbytherespondent; (2)Evidenceoftherespondentbeingseriouslymentallyillor havingrecurringmentalhealthissues; (3)Anyviolationofpreviousorexistingriskprotectionorders againsttherespondent; (4)Anyconvictionsofdomesticviolenceagainsttherespondent, inthisorotheranyotherstate; (5)Anyrelevantinformationfromfamilyorhouseholdmembers;and (6)Anywitnesstestimony,takenbyawitnessunderoath,relating tothematterbeforethecourt. Duringthehearing,thecourtshallconsider,andmayorderif appropriate,amentalhealthevaluationorchemicaldependency evaluationoftherespondent. Ifthecourtdeniesthepetitioner's requestforanRPO,thecourtshallstatetheparticularreasons forthedenial. Thecourtshallprovideacopyofthenoticeofthehearing, petition,andTRPOorRPO,asapplicable,tothesheriffofthe countyinwhichtherespondentresidesorcanbefound.The sheriffshallserveitupontherespondentassoonaspracticable onanydayoftheweekandatanytimeofthedayornight. Additionally,thechiefjudgeofeachcircuit,inconsultationwith theappropriatesheriff,mayauthorizealawenforcementagency withinthejurisdictiontoeffectservice. Suchlawenforcement agencyeffectingserviceshalluseserviceandverification proceduresconsistentwiththoseofthesheriff. Inissuingan RPO,thecourtshallinformtherespondentthatheorsheis entitledtorequestahearingtovacatetheorder. Within24hoursafterissuance,thecourtshallenteranyRPOor TRPOintotheuniformcasereportingsystemandforwardacopyof anysuchordertotheappropriatelawenforcementagency.Upon receipt,theagencyshallenteranysuchorderreceivedintothe MissouriUniformLawEnforcementSystem(MULES)andtheNational CrimeInformationCenter(NCIC). UponserviceofanRPOorTRPO,arespondentshallimmediately surrenderallfirearmsownedbytherespondentinhisorher custodyorcontrolandanyconcealedcarrypermit.Thelaw enforcementofficershalltakepossessionofallsuchfirearms. Thelawenforcementofficermayseekasearchwarranttoconducta searchforfirearmsownedbytherespondentiftheofficerhas probablecausetobelievetherearefirearmsownedbythe respondentwhichhavenotbeensurrendered. Atthetimeof surrender,thelawenforcementofficershallissueacopyofa receiptidentifyingallsuchfirearmstotherespondent,andfile theoriginalreceiptwiththecourt. Alllawenforcementagenciesshalldeveloppoliciesandprocedures regardingtheacceptance,storage,andreturnoffirearmsand licenses. IfanRPOisvacatedorendswithoutextension,thelawenforcement agencyholdingthefirearmorconcealedcarrypermitownedbythe respondentshallreturnsuchsurrenderedfirearmorpermitupon requestbytherespondentafterconfirmingthroughabackground checktherespondentiscurrentlyeligibletoownorpossessa firearm. Theagencyshallprovidenoticetoanyfamilyor householdmembersoftherespondentpriortoreturningany surrenderedfirearmtotherespondent. Anyfirearmthatremains unclaimedforoneyearshallbedisposedofinaccordancewiththe agency'spoliciesandprocedures. TheOfficeoftheStateCourtsAdministratorshalldevelopand prepareinstructionsandinformationalbrochures,standardpetition andRPOforms,andacourtstaffhandbookontheRPOprocess. The Officeshalldeterminethesignificantnon-English-speaking populationsinthestateandpreparethesematerialsinthose languages. Suchmaterialsshallbepreparedinconsultationwith relevantstakeholdersasdescribedinthebill. Apersonwhomakesafalsestatementunderoathinahearingin regardtoanymaterialmatterundertheprovisionsofthisbill shallbeguiltyofaclassEfelony.Anypersonwhohasinhisor hercustodyorcontrolafirearmorwhopurchases,possesses,or receivesafirearminviolationoftheprovisionsofthisbill shallbeguiltyofaclassEfelony.
