TheSecondAmendmentPreservationAct(Sections1.410-1.485,RSMo)
providesthatnoentityorperson,includinganypublicofficeror
employeeofthisstateoranypoliticalsubdivisionofthisstate,
shallhavetheauthoritytoenforceorattempttoenforceanylaw,
order,orrulethatinfringesontherighttokeepandbeararmsas
describedintheAct.
TheActalsoprovidesthatanypoliticalsubdivisionorlaw
enforcementagencythatemploysalawenforcementofficerwho
knowinglyactstoviolatetheprovisionsoftheActshallbeliable
totheinjuredpartyandsubjecttoacivilpenaltyof$50,000per
occurrence. Further,anypoliticalsubdivisionorlawenforcement
agencythatknowinglyemploysorhiresanindividualwhopreviously
actedtoenforceorattemptedtoenforce,orgavematerialaidand
supporttoanotherwhoenforcesorattemptedtoenforce,any
infringementidentifiedundertheAct,shallbesubjecttoacivil
penaltyof$50,000peremployeehired.
Thisbillrepealstheseprovisionsrelatingtoenforcementand
liability(Sections1.450;Section1.460;andSection1.470).
