ASSUMPTION
§§321.130 & 321.210 – Filing Fees for Fire Protection District Nominations
In response to similar legislation from 2022, HB 1601, officials from the City of St. Louis, the 
Kansas City Board of Elections and the St. Louis City Board of Elections
proposal will have no fiscal impact on their respective organizations. Oversight does not have 
any information to the contrary. Therefore, Oversight will reflect a zero impact in the fiscal note 
for these agencies for this section of the proposal.  
Oversight assumes these sections are removing the requirement of paying a filing fee when 
filing a nomination for a member of the board of the fire protection district. Oversight assumes 
this fee is paid to the committee of a political party (per Section 115.357), not the county 
government. Therefore, Oversight will assume no fiscal impact from this part of the proposal.
§321.228 – Fire Protection Districts and Residential Construction
In response to similar legislation from 2022, HB 2663, officials from the Florissant Valley Fire 
Protection District assumed this proposal could limit a fire district's ability to ensure basic 
safety requirements are met related to fire protection infrastructures such as road width, access, 
bridge weights, and water for firefighting to name a few that are provided for in the fire codes.
Oversight assumes this proposal prohibits fire protection districts (FPD) from adopting 
ordinances, orders, rules or regulations relating to the subdivision of land or to serving residential 
construction. Oversight assumes FPDs may enter into contracts with counties or municipalities to 
create a residential construction regulatory system, however if the county or municipality does 
not adopt a system, then the FPD would only be able to issue permits relating to fire protection. 
Oversight assumes this proposal would have no fiscal impact unless action is taken by a local 
government to put these policies or contracts into place. Therefore, Oversight will assume no 
direct fiscal impact for this section of the proposal.
In response to a previous version, officials from the Jefferson City and Jackson County each 
assumed the proposal will have no fiscal impact on their respective organizations. Oversight 
does not have any information to the contrary. Therefore, Oversight will reflect a zero impact in 
the fiscal note for these agencies.  
In response to similar legislation from 2022, HB 2663, officials from the City of O’Fallon and 
the City of St. Louis each assumed the proposal will have no fiscal impact on their respective 
organizations. Oversight does not have any information to the contrary. Therefore, Oversight

Officials from the Department of Public Safety’s Division of Fire Safety, the City of Kansas 
City, the City of SpringfieldJackson County Board of Elections, the Platte County 
Board of Elections and the St. Louis County Board of Elections each assume the proposal will 
have no fiscal impact on their respective organizations. Oversight does not have any information 
to the contrary. Therefore, Oversight will reflect a zero impact in the fiscal note for these 
agencies.  
Officials from the Office of the Secretary of State (SOS) note many bills considered by the 
General Assembly include provisions allowing or requiring agencies to submit rules and 
regulations to implement the act. The SOS is provided with core funding to handle a certain 
amount of normal activity resulting from each year's legislative session. The fiscal impact 
for this fiscal note to the SOS for Administrative Rules is less than $5,000. The SOS 
recognizes that this is a small amount and does not expect that additional funding would be 
required to meet these costs. However, the SOS also recognizes that many such bills may be 
passed by the General Assembly in a given year and that collectively the costs may be in excess 
of what the office can sustain with its core budget. Therefore, the SOS reserves the right to 
request funding for the cost of supporting administrative rules requirements should the need arise 
based on a review of the finally approved bills signed by the governor.
Oversight only reflects the responses received from state agencies and political subdivisions; 
however, other local election authorities, counties, local fire protection districts and cities were 
requested to respond to this proposed legislation but did not. A listing of political subdivisions 
included in the MOLIS database is available upon request.

FISCAL DESCRIPTION
This proposal changes the law regarding fire protection districts.
This legislation is not federally mandated, would not duplicate any other program and would not 
require additional capital improvements or rental space.
