Thebillprovidesthat,foracityofthefourthclassification
withnomorethan2,000inhabitants,ifastatuteorordinance
authorizesthemayortoappointamemberofalocalboardor
commission,anyrequirementthattheappointedpersonbearesident
ofthecitywillbedeemedsatisfiedifthepersonownsreal
propertyorabusinessinthecity,regardlessofwhetherthe
positiontowhichtheappointmentismadeisconsideredanofficer
ofthecity.
Thebillalsoprovidesthat,foracityofthefourth
classification withnomorethan2,000inhabitants,ifastatuteor
ordinanceauthorizesthemayortoappointamemberofaboardthat
managesamunicipalutility,anyrequirementthattheappointed
personbearesidentofthecitywillbedeemedsatisfiedonlyif
thefollowingconditionsaremet:
(1)Theboardhasnoauthoritytosetutilityratesortoissue
bonds;
(2)Thepersonresideswithinfivemilesofthecitylimits;
(3)Thepersonownsrealpropertyorabusinessinthecity;
(4)Thepersonortheperson'sbusinessisacustomerofapublic
utility,asdescribedunderSection91.450,RSMomanagedbythe
board;and
(5)Thepersonhasnopecuniaryinterestin,andisnotaboard
memberof,anyutilitycompanythatoffersthesametypeofservice
asautilitymanagedbytheboard.
ThisbillissimilartoHB1581(2022).
PROPONENTS: Supporterssaythatoftenitishardtogetcity
residentstoserveontheseboardsandwithvacanciesitishardto
getaquorumtoconductbusiness. Thisbillwouldallowforpeople
whohaveavestedinterestbutdonotliveinthecitytoserveon
theboards.
