HB725--OFFENSESINVOLVINGTELLERMACHINES SPONSOR: Francis Thisbilladdsdamaging,destroying,ormakinginoperable,a "tellermachine",asdefinedinthebill,totheoffenseof propertydamageinthefirstdegree.ThisoffenseisaclassD felony;aclassCfelonyifcommittedforthepurposeofexecuting anyschemeorartificetodefraudorobtainanypropertythat exceeds$750orthedamagetothetellermachineexceeds$750;and aclassBfelonyifthedamagecommittedwastoobtainthepersonal financialcredentialsofanotherpersonoriscommittedasasecond violation. Thisbillcreatestheoffenseoftamperingwithatellermachine andmakesitaclassDfelony,unlesstheoffenseisforthe purposeofexecutinganyschemetodefraudorobtainanyproperty valuedat$1000ormoreordamagetothetellermachineof$1000or more,inwhichcaseitisaclassCfelony. ThebillalsoprovidesthattheoffenseofstealingisaClassC felonyifthepropertyisatellermachineorthecontentsofa tellermachineregardlessofthevalueoramountofcash. ThisbillissimilartoHCSHB2127(2022).
