COMMITTEEOFORIGIN:SpecialCommitteeonHomelandSecurity
Thisbillamends"ThePersonalPrivacyProtectionAct"toprovidea
publicagency,asdefined,mayrelease,publicize,orotherwise
publiclydisclosepersonalinformation,asdefined,intheagency's
possessionwiththeexpress,writtenpermissionofeveryindividual
whoisidentifiablefromthepotentialreleaseofthepersonal
informationandalsoexemptsfromtheActthefilingoffinancial
interestsstatementsasrequiredbylaw.
ThebillfurtherexemptsfromthePersonalPrivacyProtectionAct:
(1)Personalinformationapersonornonprofitvoluntarilysubmits
orhaspreviouslyvoluntarilysubmittedtoapublicagencyforthe
purposeofobtainingenumerateditemsandbenefitsasdescribedin
thebill;
(2)Thedisclosureofpersonalinformationamonglawenforcement
agenciespursuanttoanactiveinvestigation;
(3)Thedisclosureofpersonalinformationvoluntarilymadeaspart
ofapubliccommentorinapublicmeetingbyanonprofitor
representative ofthenonprofit;and
(4)Thedisclosureofpersonalinformationtoalaborunionor
employeeassociationregardingemployeesinabargainingunit
representedbytheunionassociation.
Thisbillestablishes"TheAnti-SurveillanceandForeign
InterventionAct"whichprohibitsanyelectedorappointedmember
oremployeeofanystateentityfromusingordownloadingany
socialmediaapplicationthatisownedbytheChineseGovernmentor
acompanythatsharesuserdatawiththeChinesegovernmentonany
state-ownedelectronicdevice.
Thisbillalsocreatestheoffenseofunlawfultrackingofamotor
vehicle,whichapersoncommitsifheorsheknowinglyinstalls,
conceals,orotherwiseplacesanelectronictrackingdeviceinor
onamotorvehiclewithouttheconsentofallownersofthevehicle
forthepurposeofmonitoringorfollowinganoccupantofthe
vehicle. Thebillprovidesexceptionstotheoffense. Theoffense
ofunlawfultrackingofamotorvehicleisaclassAmisdemeanor.
Thisbillcontainsanemergencyclausefortheprovisionsrelating
tothePersonalPrivacyProtectionAct.
