Torepealsection578.365,RSMo,andtoenactinlieuthereofonenewsectionrelatingtothe
offenseofhazing,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section578.365,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection578.365,toreadasfollows:
578.365.1.Apersoncommitstheoffenseofhazingifheorsheknowingly
2participatesinorcausesawillfulact,occurringonoroffthecampusofapublicorprivate
3collegeoruniversity,directedagainstastudentoraprospectivememberofanorganization
4operatingunderthesanctionofapublicorprivatecollegeoruniversity,thatrecklessly
5endangersthementalorphysicalhealthorsafetyofastudentorprospectivememberforthe
6purposeofinitiationoradmissionintoorcontinuedmembershipinanysuchorganizationto
7theextentthatsuchpersonisknowinglyplacedatprobableriskofthelossoflifeorprobable
8bodilyorpsychologicalharm.Actsofhazinginclude:
9 (1)Anyactivitywhichrecklesslyendangersthephysicalhealthorsafetyofthe
10studentorprospectivemember,includingbutnotlimitedtophysicalbrutality,whipping,
11beating,branding,exposuretotheelements,forcedconsumptionofanyfood,liquor,drugor
12othersubstance,orforcedsmokingorchewingoftobaccoproducts;
13 (2)Anyactivitywhichrecklesslyendangersthementalhealthofthestudentor
14prospectivemember,includingbutnotlimitedtosleepdeprivation,physicalconfinement,or
15otherextremestress-inducingactivity;or
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16 (3)Anyactivitythatrequiresthestudentorprospectivemembertoperformadutyor
17taskwhichinvolvesaviolationofthecriminallawsofthisstateoranypoliticalsubdivisionin
18thisstate.
19 2.Publicorprivatecollegesoruniversitiesinthisstateshalladoptawrittenpolicy
20prohibitinghazingbyanyorganizationoperatingunderthesanctionoftheinstitution.
21 3.Nothinginthissectionshallbeinterpretedascreatinganewprivatecauseofaction
22againstanyeducationalinstitution.
23 4.Consentisnotadefensetohazing.Section565.010doesnotapplytohazingcases
24ortohomicidecasesarisingoutofhazingactivity.
25 5.TheoffenseofhazingisaclassAmisdemeanor,unlesstheactcreatesasubstantial
26risktothelifeofthestudentorprospectivemember,inwhichcaseitisaclassDfelony.
27 6.Apersonshallnotbeguiltyoftheoffenseofhazingifthepersonestablishesall
28ofthefollowing:
29 (1)Thatheorshewaspresentataneventwhere,asaresultofhazing,aperson
30appearedtobeinneedofimmediatemedicalassistance;
31 (2)Thatheorshewasthefirstpersontocall911orcampussecuritytoreport
32theneedforimmediatemedicalassistance;
33 (3)Thatheorsheprovidedhisorherownname,theaddresswhereimmediate
34medicalassistancewasneeded,andadescriptionofthemedicalissuetothe911operator
35orcampussecurityatthetimeofthecall;and
36 (4)Thatheorsheremainedatthescenewiththepersoninneedofimmediate
37medicalassistanceuntilmedicalassistance,lawenforcement,orcampussecurity
38arrivedandthatheorshecooperatedwithsuchpersonnelonthescene.
39 7.Notwithstandingsubsection6ofthissection,apersonshallbeimmunefrom
40prosecutionunderthissectionifthepersonestablishesthatthepersonrenderedaidto
41thehazingvictimbeforemedicalassistance,lawenforcement,orcampussecurity
42arrivedonthesceneofthehazingevent.Forpurposesofthissubsection,"aid"
43includes,butisnotlimitedto,renderingcardiopulmonaryresuscitationtothevictim,
44clearinganairwayforthevictimtobreathe,usingadefibrillatortoassistthevictim,or
45renderinganyotherassistancetothevictimthatthepersonintendedingoodfaithto
46stabilizeorimprovethevictim'sconditionwhilewaitingformedicalassistance,law
47enforcement,orcampussecuritytoarrive.
