Theofficers 7ofthepoliceforceshallhavecommissionsissuedtothembytheboardsofpolice 8commissioners,andthoseheretoforeandthosehereaftercommissionedshallservesolongas 9theyshallfaithfullyperformtheirdutiesandpossessthenecessarymentalandphysical 10ability,andbesubjecttoremovalonlyforcauseafterahearingbytheboard,whoarehereby 11investedwithexclusivejurisdictioninthepremises. 84.160.1.AsofAugust28,[2006] 2024, theboardofpolicecommissionersshall 2havetheauthoritytocomputeandestablishtheannualsalaryofeachmemberofthepolice 3forcewithoutreceivingpriorauthorizationfromthegeneralassembly, whichshallnotbe 4lessthantheannualsalarypaidtoanymemberatthetimeoftheenactmentofthisact. 5 2.Eachofficerofpoliceandpatrolmanwhoseregularassignmentrequires 6nonuniformedattiremayreceive,inadditiontohisorhersalary,anallowancenottoexceed 7threehundredsixtydollarsperannumpayablebiweekly.Notwithstandingtheprovisionsof 8subsection1ofthissectiontothecontrary,noadditionalcompensationorcompensatorytime 9offforovertime,courttime,orstandbycourttimeshallbepaidorallowedtoanyofficerof 10therankof[sergeant] lieutenantorabove.Notwithstandinganyotherprovisionoflawtothe 11contrary,nothinginthissectionshallprohibitthepaymentofadditionalcompensation 12pursuanttothissubsectiontoofficersoftheranksofsergeantsandabove,providedthat 13fundingforsuchcompensationshallnot: 14 (1)Bepaidfromthegeneralfundsofeitherthecityortheboardofpolice 15commissionersofthecity;or 16 (2)Beviolativeofanyfederallaworotherstatelaw. 17 3.Itisthedutyofthemunicipalassemblyorcommoncouncilofthecitiestomake 18thenecessaryappropriationfortheexpensesofthemaintenanceofthepoliceforceinthe 19mannerhereinandhereafterprovided;provided,thatinnoeventshallsuchmunicipal 20assemblyorcommoncouncilberequiredtoappropriateforsuchpurposes(including,butnot 21limitedto,costsoffundingpensionsorretirementplans)foranyfiscalyearasuminexcessof 22anylimitationimposedbyarticleX,section21,MissouriConstitution;andprovidedfurther, 23thatsuchmunicipalassemblyorcommoncouncilmayappropriateasuminexcessofsuch HCSHB1481 3 24limitationforanyfiscalyearbyanappropriationsordinanceenactedinconformitywiththe 25provisionsofthecharterofsuchcities. 26 4.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the 27boardofpolicecommissionersshallpayadditionalcompensationforallhoursofservice 28renderedbyprobationarypatrolmen[and],patrolmen, andsergeantsinexcessofthe 29establishedregularworkingperiod,andtherateofcompensationshallbeoneandone-half 30timestheregularhourlyrateofpaytowhicheachmembershallnormallybeentitled;except 31that,thecourttimeandcourtstandbytimeshallbepaidattheregularhourlyrateofpayto 32whicheachmembershallnormallybeentitled.Nocreditshallbegivenordeductionsmade 33frompaymentsforovertimeforthepurposeofretirementbenefits. 34 5.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary, 35probationarypatrolmen[and], patrolmen, andsergeantsshallreceiveadditional 36compensationforauthorizedovertime,courttimeandcourtstandbytimewheneverthe 37totalaccumulatedtimeexceedsfortyhours.Theaccumulatedfortyhoursshallbetakenas 38compensatorytimeoffattheofficer'sdiscretionwiththeapprovalofhissupervisor. 39 6.Theallowanceofcompensationorcompensatorytimeoffforcourtstandbytime 40shallbecomputedattherateofone-thirdofonehourforeachhourspentoncourtstandby 41time. 42 7.Theboardofpolicecommissioners[may] shalleffectprogramstoprovide 43additionalcompensationtoitsemployeesforsuccessfulcompletionofacademicworkatan 44accreditedcollegeoruniversity,inamountsnottoexceedtenpercentoftheiryearlysalaries 45orforfieldtrainingofficerandleadofficerresponsibilitiesinamountsnottoexceedthree 46percentoftheiryearlysalariesforfieldtrainingofficerresponsibilitiesandanadditionalthree 47percentoftheiryearlysalariesforleadofficerresponsibilities.Theboardmaydesignateup 48toonehundredfiftyemployeesasfieldtrainingofficersanduptofiftyemployeesaslead 49officers. 50 8.Theboardofpolicecommissioners: 51 (1)Shallprovideorcontractforlifeinsurancecoverageandforinsurancebenefits 52providinghealth,medicalanddisabilitycoverageforofficersandemployeesofthe 53department; 54 (2)Shallprovideorcontractforinsurancecoverageprovidingsalarycontinuation 55coverageforofficersandemployeesofthepolicedepartment; 56 (3)Shallprovidehealth,medical,andlifeinsurancecoverageforretiredofficersand 57employeesofthepolicedepartment.Health,medicalandlifeinsurancecoverageshallbe 58madeavailableforpurchasetothespousesordependentsofdeceasedretiredofficersand 59employeesofthepolicedepartmentwhoreceivepensionbenefitspursuanttosections86.200 HCSHB1481 4 60to86.364attheratethatsuchdependent'sorspouse'scoveragewouldcostunderthe 61appropriateplanifthedeceasedwereliving; 62 (4)Maypayanadditionalshiftdifferentialcompensationtomembersofthepolice 63forceforeveningandnighttourofdutyinanamountnottoexceedtenpercentoftheofficer's 64basehourlyrate. 65 9.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the 66boardofpolicecommissionersshallpayadditionalcompensationtomembersofthepolice 67forceuptoandincludingtherankofpoliceofficerforanyfullhourworkedbetweenthe 68hoursof11:00p.m.and7:00a.m.,inamountsequalto[five]tenpercentoftheofficer'sbase 69hourlypay. 70 10.Theboardofpolicecommissioners,fromtimetotimeandinitsdiscretion,may 71payadditionalcompensationtopoliceofficers,sergeantsandlieutenantsbypaying 72commissionedofficersintheaforesaidranksforaccumulated,unusedvacationtime.Any 73suchpaymentsshallbemadeinincrementsofnotlessthanfortyhours,andatrates 74equivalenttothebasestraight-timeratesbeingearnedbysaidofficersatthetimeofpayment; 75exceptthat,nosuchofficershallberequiredtoacceptpaymentforaccumulatedunused 76vacationtime. 84.170.1.Whenanyvacancyshalltakeplaceinanygradeofofficers,itshallbe 2filledfromthenextlowestgrade;provided,however,thatprobationarypatrolmenshallserve 3atleastsixmonthsassuchbeforebeingpromotedtotherankofpatrolman;patrolmenshall 4serveatleastthreeyearsassuchbeforebeingpromotedtotherankofsergeant;sergeants 5shallserveatleastoneyearassuchbeforebeingpromotedtotherankoflieutenant; 6lieutenantsshallserveatleastoneyearassuchbeforebeingpromotedtotherankofcaptain; 7andinnocaseshallthechieforassistantchiefbeselectedfrommennotmembersoftheforce 8orbelowthegradeofcaptain.Patrolmenshallserveatleastthreeyearsassuchbefore 9promotiontotherankofdetective;theinspectorshallbetakenfrommenintheranknot 10belowthegradeoflieutenant. 11 2.Theboardsofpoliceareherebyauthorizedtomakeallsuchrulesandregulations, 12notinconsistentwithsections84.010to84.340,orotherlawsofthestate,astheymayjudge 13necessary,fortheappointment,employment,uniforming,discipline,trialandgovernmentof 14thepolice.Atthetimeoftheeffectivedateofthisactanduntilsuchtimeastheboard 15adoptsotherinvestigativeanddisciplinarypoliciesandproceduresnotinconsistentwith 16section590.502,disciplineandinvestigativeproceduresforcommissionedandcivilian 17employeesofthepoliceforceshallberegulatedbyrule7ofthepolicemanualofthe 18policedepartmentineffectasofNovember4,2013;exceptthat,whererule7isin 19conflictwithsection590.502,theboardshallcomplywiththerequirementsofsection 20590.502.Undernocircumstancesshalltheboardinitiallyorhereafteradopt HCSHB1481 5 21investigativeanddisciplinaryproceduresthatdonotincludethesummaryhearing 22boardproceduresprovidedforinrule7ofthepolicemanualofthepolicedepartmentin 23effectasofNovember4,2013.Thesaidboardsshallalsohavepowertorequireofany 24officerorpolicemanbondwithsuretieswhentheymayconsideritdemandedbythepublic 25interests.Alllawfulrulesandregulationsoftheboardshallbeobeyedbythepoliceforceon 26painofdismissalorsuchlighterpunishment,eitherbysuspension,fine,reductionor 27forfeitureofpay,orotherwiseastheboardsmayadjudge. 28 3.Theauthoritypossessedbytheboardofpoliceincludes,butisnotlimitedto,the 29authoritytodelegateportionsofitspowersauthorizedinsection84.120,includingpresiding 30overadisciplinaryhearing,toahearingofficerasdeterminedbytheboard. 84.225.Anyofficerorservantofthemayororcommoncouncilormunicipal 2assemblyofthecities,orotherpersonswhatsoever,whoforciblyresistsorobstructsthe 3executionorenforcementofanyoftheprovisionsofsections84.012to84.340orrelating 4tothesame,orwhodisbursesorfailstodisburseanymoneyinviolationthereof,orwho 5hindersorobstructstheorganizationormaintenanceoftheboardofpoliceorthepolice 6forcethereinprovidedtobeorganizedandmaintained,orwhomaintainsorcontrols 7anypoliceforceotherthantheonethereinprovidedfor,orwhodelaysorhindersthe 8dueenforcementofsections84.012to84.340byfailingorneglectingtoperformthe 9dutiesbysuchsectionsimposeduponhimorher,shallbesubjecttoapenaltyofone 10thousanddollarsforeachoffense,recoverablebytheboardsbyactionatlawinthe 11nameofthestate,andshallforeverthereafterbedisqualifiedfromholdingorexercising 12anyofficeoremploymentwhatsoeverunderthemayororcommoncouncilormunicipal 13assemblyofsuchcities,orundersections84.012to84.340;providedthat,nothinginthis 14sectionshallbeconstruedtointerferewiththepunishment,underanyexistingorany 15futurelawsofthisstate,ofanycriminaloffensethatiscommittedbythepartiesinor 16abouttheresistance,obstruction,hindrance,conspiracy,combination,ordisbursement 17aforesaid. 84.325.1.OnAugust28,2024,theboardofpolicecommissionersshallassume 2controlofanymunicipalpoliceforceestablishedwithinanycitynotwithinacounty, 3accordingtotheproceduresandrequirementsofthissectionandanyrulespromulgated 4undersubsection6ofthissection.Thepurposeoftheseproceduresandrequirementsis 5toprovideforanorderlyandappropriatetransitioninthegovernanceofthepolice 6forceandprovideforanequitableemploymenttransitionforcommissionedandcivilian 7personnel. 8 2.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder 9subsection1ofthissection,anymunicipalpolicedepartmentwithinanycitynotwithin 10acountyshallconvey,assign,andotherwisetransfertotheboardtitleandownershipof HCSHB1481 6 11allindebtednessandassets,including,butnotlimitedto,allfundsandrealandpersonal 12propertyheldinthenameoforcontrolledbythemunicipalpolicedepartment.Such 13cityshallthereafterceasetheoperationofanypolicedepartmentorpoliceforce. 14 3.Theboardofpolicecommissionersshallinitiallyemploy,withoutareduction 15inrank,salary,orbenefits,allcommissionedandcivilianpersonnelofthemunicipal 16policedepartmentwhowereemployedbythemunicipalpolicedepartmentimmediately 17priortothedatetheboardassumedcontrol.Theboardshallrecognizeallaccrued 18yearsofservicethatsuchcommissionedandcivilianpersonnelhadwiththemunicipal 19policedepartment,aswellasallaccruedyearsofservicethatsuchcommissionedand 20civilianpersonnelhadpreviouslywiththeboardofpolicecommissioners.Such 21personnelshallbeentitledtothesameholidays,vacation,sickleave,sickbonustime, 22andannualstep-increasestheywereentitledtoasemployeesofthemunicipalpolice 23department. 24 4.Thecommissionedandcivilianpersonnelwhoretirefromservicewiththe 25municipalpolicedepartmentbeforetheboardofpolicecommissionersassumedcontrol 26ofthedepartmentundersubsection1ofthissectionshallcontinuetobeentitledtothe 27samepensionbenefitsprovidedasemployeesofthemunicipalpolicedepartmentand 28thesamebenefitssetforthinsubsection5ofthissection.Anypolicepensionsystem 29createdunderchapter86forthebenefitofapoliceforceestablishedundersections 3084.012to84.340shallcontinuetobegovernedbychapter86andshallapplytoany 31comprehensivepolicingplanandanypoliceforceestablishedundersections84.012to 3284.340.Otherthananyprovisionthatmakeschapter86applicabletoamunicipal 33policeforceestablishedundersections84.343to84.346,nothinginsections84.012to 3484.340shallbeconstruedaslimitingorchangingtherightsorbenefitsprovidedunder 35chapter86. 36 5.Theboardofpolicecommissionersmaypromulgateallnecessaryrulesand 37regulationsfortheimplementationandadministrationofthissection.Anyruleor 38portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe 39authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis 40subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This 41sectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 42generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 43disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof lawsandregulationsapplicabletopoliceofficers;provided,however,thatthe 10 citycouncilorothergoverningbodyofanysuchcitymayinitsdiscretionfixa 11 totalinnumberwhichthereserveforcemaynotexceed. 12 2.Ineventofriotorotheremergenciesasdeclaredanddefinedbythe 13 mayor,inconcurrencewiththeboard,theboard,uponrecommendationofthe 14 chief,mayappointspecialofficersorpatrolmenfortemporaryservicein 15 additiontothepolicereserveforcehereinprovidedfor,butthelengthoftime 16 forwhichsuchofficersorpatrolmenshallbeemployedshallbelimitedtothe 17 timeduringwhichsuchemergencyshallexist.] [84.240.Theboardofpolicecommissionersshallestablishthe 2 Bertillonsystemofidentificationofcriminalsandothersbymeansof 3 anthropometricindications,andtheyarefurtherrequiredtoemploysuch 4 additionalassistanceasmaybenecessarytoproperlyconductandmanagethis 5 department.] [84.341.Noelectedorappointedofficialofthestateoranypolitical 2 subdivisionthereofshallactorrefrainfromactinginanymannertoimpede, 3 obstruct,hinder,orotherwiseinterferewithanymemberofamunicipalpolice 4 forceestablishedundersections84.343to84.346intheperformanceofhisor 5 herjobduties,orwithanyaspectofanyinvestigationarisingfromthe 6 performanceofsuchjobduties.Thissectionshallnotbeconstruedtoprevent 7 suchofficialsfromactingwithinthenormalcourseandscopeoftheir 8 employmentorfromactingtoimplementsections84.343to84.346.Any 9 personwhoviolatesthissectionshallbeliableforapenaltyoftwothousand 10 fivehundreddollarsforeachoffenseandshallforeverbedisqualifiedfrom 11 holdinganyofficeoremploymentwhatsoeverwiththegovernmentalentity 12 thepersonservedatthetimeoftheviolation.Thepenaltyshallnotbepaidby 13 thefundsofanycommitteeasthetermcommitteeisdefinedinsection 14 130.011.Thissectionshallnotbeconstruedtointerferewiththepunishment, 15 underanylawsofthisstate,ofacriminaloffensecommittedbysuchofficials, 16 norshallthissectionapplytodulyappointedmembersofthemunicipalpolice 17 force,ortheirappointingauthorities,whoseconductisotherwiseprovidedfor 18 bylaw.] [84.342.1.Itshallbeanunlawfulemploymentpracticeforanofficial, 2 employee,oragentofamunicipalpoliceforceestablishedundersections 3 84.343to84.346todischarge,demote,reducethepayof,orotherwiseretaliate 4 againstanemployeeofthemunicipalpoliceforceforreportingtoany HCSHB1481 9 5 superior,governmentagency,orthepresstheconductofanotheremployee 6 thatthereportingemployeebelieves,ingoodfaith,isillegal. 7 2.Anyemployeeofthemunicipalpoliceforcemaybringacauseof 8 actionforgeneralorspecialdamagesbasedonaviolationofthissection.] [84.343.1.Subjecttotheprovisionsofsections84.344to84.346,any 2 citynotwithinacountymayestablishamunicipalpoliceforceforthe 3 purposesof: 4 (1)Preservingthepublicpeace,welfare,andorder; 5 (2)Preventingcrimeandarrestingsuspectedoffenders; 6 (3)Enforcingthelawsofthestateandordinancesofthecity; 7 (4)Exercisingallpowersavailabletoapoliceforceundergenerally 8 applicablestatelaw;and 9 (5)Regulatingandlicensingallprivatewatchmen,privatedetectives, 10 andprivatepolicemenservingoractingassuchinsaidcity. 11 2.Anypersonwhoactsasaprivatewatchman,privatedetective,or 12 privatepolicemaninsaidcitieswithouthavingobtainedawrittenlicensefrom 13 saidcitiesisguiltyofaclassAmisdemeanor.] [84.344.1.Notwithstandinganyprovisionsofthischaptertothe 2 contrary,anycitynotwithinacountymayestablishamunicipalpoliceforce 3 onorafterJuly1,2013,accordingtotheproceduresandrequirementsofthis 4 section.Thepurposeoftheseproceduresandrequirementsistoprovideforan 5 orderlyandappropriatetransitioninthegovernanceofthepoliceforceand 6 provideforanequitableemploymenttransitionforcommissionedandcivilian 7 personnel. 8 2.Upontheestablishmentofamunicipalpoliceforcebyacityunder 9 sections84.343to84.346,theboardofpolicecommissionersshallconvey, 10 assign,andotherwisetransfertothecitytitleandownershipofall 11 indebtednessandassets,including,butnotlimitedto,allfundsandrealand 12 personalpropertyheldinthenameoforcontrolledbytheboardofpolice 13 commissionerscreatedundersections84.010to84.340.Theboardofpolice 14 commissionersshallexecutealldocumentsreasonablyrequiredtoaccomplish 15 suchtransferofownershipandobligations. 16 3.Ifthecityestablishesamunicipalpoliceforceandcompletesthe 17 transferdescribedinsubsection2ofthissection,thecityshallprovidethe 18 necessaryfundsforthemaintenanceofthemunicipalpoliceforce. 19 4.Beforeacitynotwithinacountymayestablishamunicipalpolice 20 forceunderthissection,thecityshalladoptanordinanceaccepting 21 responsibility,ownership,andliabilityassuccessor-in-interestfor 22 contractualobligations,indebtedness,andotherlawfulobligationsofthe 23 boardofpolicecommissionerssubjecttotheprovisionsofsubsection2of 24 section84.345. 25 5.Acitynotwithinacountythatestablishesamunicipalpoliceforce 26 shallinitiallyemploy,withoutareductioninrank,salary,orbenefits,all 27 commissionedandcivilianpersonneloftheboardofpolicecommissioners 28 createdundersections84.010to84.340thatwereemployedbytheboard 29 immediatelypriortothedatethemunicipalpoliceforcewasestablished.Such HCSHB1481 10 30 commissionedpersonnelwhopreviouslywereemployedbytheboardmay 31 onlybeinvoluntarilyterminatedbythecitynotwithinacountyforcause.The 32 cityshallalsorecognizeallaccruedyearsofservicethatsuchcommissioned 33 andcivilianpersonnelhadwiththeboardofpolicecommissioners.Such 34 personnelshallbeentitledtothesameholidays,vacation,andsickleavethey 35 wereentitledtoasemployeesoftheboardofpolicecommissioners. 36 6.Commissionedandcivilianpersonnelofamunicipalpoliceforce 37 establishedunderthissectionshallnotbesubjecttoaresidencyrequirementof 38 retainingaprimaryresidenceinacitynotwithinacountybutmayberequired 39 tomaintainaprimaryresidencelocatedwithinaone-hourresponsetime. 40 7.Thecommissionedandcivilianpersonnelwhoretirefromservice 41 withtheboardofpolicecommissionersbeforetheestablishmentofa 42 municipalpoliceforceundersubsection1ofthissectionshallcontinuetobe 43 entitledtothesamepensionbenefitsprovidedunderchapter86andthesame 44 benefitssetforthinsubsection5ofthissection. 45 8.Ifthecitynotwithinacountyelectstoestablishamunicipalpolice 46 forceunderthissection,thecityshallestablishaseparatedivisionforthe 47 operationofitsmunicipalpoliceforce.Thecivilservicecommissionofthe 48 citymayadoptrulesandregulationsappropriatefortheuniqueoperationofa 49 policedepartment.Suchrulesandregulationsshallreserveexclusive 50 authorityoverthedisciplinaryprocessandproceduresaffectingcommissioned 51 officerstothecivilservicecommission;however,untilsuchtimeasthecity 52 adoptssuchrulesandregulations,thecommissionedpersonnelshallcontinue 53 tobegovernedbytheboardofpolicecommissioner'srulesandregulationsin 54 effectimmediatelypriortotheestablishmentofthemunicipalpoliceforce, 55 withthepolicechiefactinginplaceoftheboardofpolicecommissionersfor 56 purposesofapplyingtherulesandregulations.Unlessotherwiseprovidedfor, 57 existingcivilservicecommissionrulesandregulationsgoverningtheappealof 58 disciplinarydecisionstothecivilservicecommissionshallapplytoall 59 commissionedandcivilianpersonnel.Thecivilservicecommission'srules 60 andregulationsshallprovidethatrecordspreparedfordisciplinarypurposes 61 shallbeconfidential,closedrecordsavailablesolelytothecivilservice 62 commissionandthosewhopossessauthoritytoconductinvestigations 63 regardingdisciplinarymatterspursuanttothecivilservicecommission'srules 64 andregulations.Ahearingofficershallbeappointedbythecivilservice 65 commissiontohearanysuchappealsthatinvolvedisciplineresultingina 66 suspensionofgreaterthanfifteendays,demotion,ortermination,butthecivil 67 servicecommissionshallmakethefinalfindingsoffact,conclusionsoflaw, 68 anddecisionwhichshallbesubjecttoanyrightofappealunderchapter536. 69 9.Acitynotwithinacountythatestablishesandmaintainsa 70 municipalpoliceforceunderthissection: 71 (1)Shallprovideorcontractforlifeinsurancecoverageandfor 72 insurancebenefitsprovidinghealth,medical,anddisabilitycoveragefor 73 commissionedandcivilianpersonnelofthemunicipalpoliceforcetothesame 74 extentaswasprovidedbytheboardofpolicecommissionersundersection 75 84.160; 76 (2)Shallprovideorcontractformedicalandlifeinsurancecoverage 77 foranycommissionedorcivilianpersonnelwhoretiredfromservicewiththe HCSHB1481 11 78 boardofpolicecommissionersorwhowereemployedbytheboardofpolice 79 commissionersandretirefromthemunicipalpoliceforceofacitynotwithina 80 countytothesameextentsuchmedicalandlifeinsurancecoveragewas 81 providedbytheboardofpolicecommissionersundersection84.160; 82 (3)Shallmakeavailablemedicalandlifeinsurancecoveragefor 83 purchasetothespousesordependentsofcommissionedandcivilianpersonnel 84 whoretirefromservicewiththeboardofpolicecommissionersorthe 85 municipalpoliceforceanddeceasedcommissionedandcivilianpersonnelwho 86 receivepensionbenefitsundersections86.200to86.366attheratethatsuch 87 dependent'sorspouse'scoveragewouldcostundertheappropriateplanifthe 88 deceasedwereliving;and 89 (4)Maypayanadditionalshiftdifferentialcompensationto 90 commissionedandcivilianpersonnelforeveningandnighttoursofdutyin 91 anamountnottoexceedtenpercentoftheofficer'sbasehourlyrate. 92 10.Acitynotwithinacountythatestablishesamunicipalpoliceforce 93 undersections84.343to84.346shallestablishatransitioncommitteeoffive 94 membersforthepurposeof:coordinatingandimplementingthetransitionof 95 authority,operations,assets,andobligationsfromtheboardofpolice 96 commissionerstothecity;windingdowntheaffairsoftheboard;making 97 nonbindingrecommendationsforthetransitionofthepoliceforcefromthe 98 boardtothecity;andotherrelatedduties,ifany,establishedbyexecutive 99 orderofthecity'smayor.Oncetheordinancereferencedinthissectionis 100 enacted,thecityshallprovidewrittennoticetotheboardofpolice 101 commissionersandthegovernorofthestateofMissouri.Withinthirty 102 daysofsuchnotice,themayorshallappointthreememberstothecommittee, 103 twoofwhomshallbemembersofastatewidelawenforcementassociation 104 thatrepresentsatleastfivethousandlawenforcementofficers.Theremaining 105 membersofthecommitteeshallincludethepolicechiefofthemunicipal 106 policeforceandapersonwhocurrentlyorpreviouslyservedasa 107 commissionerontheboardofpolicecommissioners,whoshallbeappointed 108 tothecommitteebythemayorofsuchcity.] [84.345.1.Exceptasrequiredfortheboardofpolicecommissioners 2 toconcludeitsaffairsandpursuelegalclaimsanddefenses,uponthe 3 establishmentofamunicipalpoliceforce,thetermsofofficeofthe 4 commissionersoftheboardofpolicecreatedundersections84.020and 5 84.030shallexpire,andtheprovisionsofsections84.010to84.340shallnot 6 applytoanycitynotwithinacountyoritsmunicipalpoliceforceasofsuch 7 date.Theboardshallcontinuetooperate,ifnecessary,towinddownthe 8 board'saffairsuntilthetransferofownershipandobligationsundersubsection 9 2ofsection84.344hasbeencompleted.Duringsuchtime,theboardofpolice 10 commissionersshalldesignateandauthorizeitssecretarytoactonbehalfof 11 theboardforpurposesofperformingtheboard'sdutiesandanyotheractions 12 incidenttothetransferandwindingdownoftheboard'saffairs. 13 2.Foranyclaim,lawsuit,orotheractionarisingoutofactions 14 occurringbeforethedateofcompletionofthetransferprovidedunder 15 subsection2ofsection84.344,thestateshallcontinuetoprovidelegal 16 representationassetforthinsection105.726,andthestatelegalexpensefund HCSHB1481 12 17 shallcontinuetoprovidereimbursementforsuchclaimsundersection 18 105.726.Thissubsectionappliestoallclaims,lawsuits,andotheractions 19 broughtagainstanycommissioner,policeofficer,employee,agent, 20 representative,oranyindividualorentityactingorpurportingtoactonits 21 ortheirbehalf. 22 3.Notwithstandinganyotherprovisionoflaw,rule,orregulationto 23 thecontrary,anycitynotwithinacountythatestablishesamunicipalpolice 24 forceundersections84.343to84.346shallnotberestrictedorlimitedinany 25 wayintheselectionofapolicechieforchiefofthedivisioncreatedunder 26 subsection8ofsection84.344. 27 4.Itshallbethedutyofthesheriffforanycitynotwithinacounty, 28 whenevercalleduponbythepolicechiefofthemunicipalpoliceforce,toact 29 underthepolicechief'scontrolforthepreservationofthepublicpeaceand 30 quiet;and,whenevertheexigencyorcircumstancesmay,inthepolicechief's 31 judgment,warrantit,saidpolicechiefshallhavethepowertoassumethe 32 controlandcommandofalllocalandmunicipalconservatorsofthepeaceof 33 thecity,whethersheriff,constable,policemenorothers,andtheyshallact 34 undertheordersofthesaidpolicechiefandnototherwise.] [84.346.Anypolicepensionsystemcreatedunderchapter86forthe 2 benefitofapoliceforceestablishedundersections84.010to84.340shall 3 continuetobegovernedbychapter86,andshallapplytoanypoliceforce 4 establishedundersection84.343to84.346.Otherthananyprovisionthat 5 makeschapter86applicabletoamunicipalpoliceforceestablishedunder 6 section84.343to84.346,nothinginsections84.343to84.346shallbe 7 construedaslimitingorchangingtherightsorbenefitsprovidedunderchapter 8
