offensesinvolvingmotorvehicles,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section569.170,RSMo,isrepealedandtwonewsectionsenactedinlieu
2thereof,tobeknownassections569.170and569.175,toreadasfollows:
569.170.1.Apersoncommitstheoffenseofburglaryintheseconddegreewhenhe
2orsheknowingly:
3 (1)Entersunlawfullyorknowinglyremainsunlawfullyinabuildingorinhabitable
4structureforthepurposeofcommittingacrimetherein; or
5 (2)Entersunlawfullyintoamotorvehicleoranypartofamotorvehiclewiththe
6intenttocommitanyfelonyortheft.Asusedinthissubdivision,"enters"meansa
7personintrudeswith:
8 (a)Anypartofthebody;or
9 (b)Anyphysicalobjectconnectedwiththebody.
10 2.TheoffenseofburglaryintheseconddegreeisaclassDfelonyunlesscommitted
11undersubdivision(2)ofsubsection1ofthissectionandthepersonwasinpossessionofa
12firearmorstoleafirearmfromthemotorvehicleinwhichcaseitisaclassCfelony.
569.175.1.Apersoncommitstheoffenseofunlawfullygainingentryintomotor
2vehiclesifthepersonliftsthedoorhandlesorotherwisetriesthedoorsandlocksof
3successivemotorvehiclestogainentryintothemotorvehiclesunlessthepersonisthe
4ownerofthemotorvehiclesorhastheowners'permissiontoenterthemotorvehicles.
