HB1560--PROHIBITSARECIPIENTFROMABUSINGTANFORSNAPBENEFITS SPONSOR: Cook ThisbillchangesthelawregardingtheuseofTemporaryAssistance forNeedyFamilies(TANF)andSupplementalNutritionAssistance Program(SNAP)benefitsviaelectronicbenefittransfer(EBT) transaction. Thebilladdspornographytothelistofitemsthat areprohibitedfrombeingpurchasedwithTANForSNAPbenefits usinganEBTcard. Thebillrequiresthatuponafirstviolationoftheprohibition againstusingTANFbenefitsviaanEBTcardinaprohibited establishmentortopurchaseprohibiteditems,aTANFrecipient willbedisqualifiedfromreceivingbenefitsforthreemonths;upon asecondviolation,therecipientwillbedisqualifiedforsix months;anduponanythirdorsubsequentviolation,therecipient willbedisqualifiedforfiveyears.Anindividualmayresume participationintheprogramattheendofthedisqualification periodbyapplyingagain. ThebillprohibitsarecipientofTANForSNAPfromusinghisor herEBTcardatanyautomatedtellermachine(ATM),toreceivecash backonapurchase,ortootherwiseaccessthebenefitsascash. IftheDepartmentofSocialServicesdeterminesthatawaiveris necessaryforimplementation oftheprohibition,theDepartment willapplyforawaiverfromtheFederalDepartmentofHealthand HumanServices. Thebillalsorepealsprovisionsregardingpilotprojectsin certaincountiestoprovideEBTcardstopublicassistance recipients. ThisbillissimilartoHB338(2023)andHB2085(2022).
