HCSHBs1692&1748 2 51 5.Forpurposesofthissection,theterm"minimumprisonterm"shallmeantime 52requiredtobeservedbytheoffenderbeforeheorsheiseligibleforparole,conditional 53releaseorotherearlyreleasebythedepartmentofcorrections. 54 6.Anoffenderwhowasconvictedof,orpledguiltyto,afelonyoffenseotherthan 55thoseoffenseslistedinsubsection2ofthissectionpriortoAugust28,2019,shallnolonger 56besubjecttotheminimumprisontermprovisionsundersubsection2ofthissection,andshall 57beeligibleforparole,conditionalrelease,orotherearlyreleasebythedepartmentof 58correctionsaccordingtotherulesandregulationsofthedepartment. 59 7.(1)Asentencingadvisorycommissionisherebycreatedtoconsistofeleven 60members.Onemembershallbeappointedbythespeakerofthehouse.Onemembershallbe 61appointedbythepresidentprotemofthesenate.Onemembershallbethedirectorofthe 62departmentofcorrections.Sixmembersshallbeappointedbyandserveatthepleasureofthe 63governorfromamongthefollowing:thepublicdefendercommission;privatecitizens;a 64privatememberoftheMissouriBar;theboardofprobationandparole;andaprosecutor. 65Twomembersshallbeappointedbythesupremecourt,onefromametropolitanareaandone 66fromaruralarea.Allmembersshallbeappointedtoafour-yearterm.Allmembersofthe 67sentencingcommissionappointedpriortoAugust28,1994,shallcontinuetoserveonthe 68sentencingadvisorycommissionatthepleasureofthegovernor. 69 (2)Thecommissionshallstudysentencingpracticesinthecircuitcourtsthroughout 70thestateforthepurposeofdeterminingwhetherandtowhatextentdisparitiesexistamong 71thevariouscircuitcourtswithrespecttothelengthofsentencesimposedandtheuseof 72probationforoffendersconvictedofthesameorsimilaroffensesandwithsimilarcriminal 73histories.Thecommissionshallalsostudyandexaminewhetherandtowhatextent 74sentencingdisparityamongeconomicandsocialclassesexistsinrelationtothesentenceof 75deathandifso,thereasonstherefor,ifsentencesarecomparabletootherstates,ifthelength 76ofthesentenceisappropriate,andtherateofrehabilitationbasedonsentence.Itshall 77compilestatistics,examinecases,drawconclusions,andperformotherdutiesrelevanttothe 78researchandinvestigationofdisparitiesindeathpenaltysentencingamongeconomicand 79socialclasses. 80 (3)Thecommissionshallstudyalternativesentences,prisonworkprograms,work 81release,home-basedincarceration,probationandparoleoptions,andanyotherprogramsand 82reportthefeasibilityoftheseoptionsinMissouri. 83 (4)Thegovernorshallselectachairpersonwhoshallcallmeetingsofthecommission 84asrequiredorpermittedpursuanttothepurposeofthesentencingcommission. 85 (5)Themembersofthecommissionshallnotreceivecompensationfortheirduties 86onthecommission,butshallbereimbursedforactualandnecessaryexpensesincurredinthe HCSHBs1692&1748 3 87performanceofthesedutiesandforwhichtheyarenotreimbursedbyreasonoftheirother 88paidpositions. 89 (6)Thecircuitandassociatecircuitcourtsofthisstate,theofficeofthestatecourts 90administrator,thedepartmentofpublicsafety,andthedepartmentofcorrectionsshall 91cooperatewiththecommissionbyprovidinginformationoraccesstoinformationneededby 92thecommission.Theofficeofthestatecourtsadministratorwillprovideneededstaffing 93resources. 94 8.Courtsshallretaindiscretiontolowerorexceedthesentencerecommendedbythe 95commissionasotherwiseallowablebylaw,andtoorderrestorativejusticemethods,when 96applicable. 97 9.Iftheimpositionorexecutionofasentenceissuspended,thecourtmayorderany 98orallofthefollowingrestorativejusticemethods,oranyothermethodthatthecourtfinds 99justorappropriate: 100 (1)Restitutiontoanyvictimorastatutorilycreatedfundforcostsincurredasaresult 101oftheoffender'sactions; 102 (2)Offendertreatmentprograms; 103 (3)Mandatorycommunityservice; 104 (4)Workreleaseprogramsinlocalfacilities;and 105 (5)Community-basedresidentialandnonresidentialprograms. 106 10.Pursuanttosubdivision(1)ofsubsection9ofthissection,thecourtmayorderthe 107assessmentandpaymentofadesignatedamountofrestitutiontoacountylawenforcement 108restitutionfundestablishedbythecountycommissionpursuanttosection50.565.Such 109contributionshallnotexceedthreehundreddollarsforanychargedoffense.Anyrestitution 110moneysdepositedintothecountylawenforcementrestitutionfundpursuanttothissection 111shallonlybeexpendedpursuanttotheprovisionsofsection50.565. 112 11.Ajudgemayorderpaymenttoarestitutionfundonlyifsuchfundhadbeen 113createdbyordinanceorresolutionofacountyofthestateofMissouripriortosentencing.A 114judgeshallnothaveanydirectsupervisoryauthorityoradministrativecontroloveranyfund 115towhichthejudgeisorderingapersontomakepayment. 116 12.Apersonwhofailstomakeapaymenttoacountylawenforcementrestitution 117fundmaynothavehisorherprobationrevokedsolelyforfailingtomakesuchpayment 118unlessthejudge,afterevidentiaryhearing,makesafindingsupportedbyapreponderanceof 119theevidencethatthepersoneitherwillfullyrefusedtomakethepaymentorthattheperson 120willfully,intentionally,andpurposefullyfailedtomakesufficientbonafideeffortstoacquire 121theresourcestopay. HCSHBs1692&1748 4 122 13.Nothinginthissectionshallbeconstruedtoallowthesentencingadvisory 123commissiontoissuerecommendedsentencesinspecificcasespendinginthecourtsofthis 124state. 575.150.1.Apersoncommitstheoffenseofresisting[or],interferingwith, 2escaping,orattemptingtoescapefromarrest,detention,[or]stop,orcustodyifheorshe 3knowsorreasonablyshouldknowthatalawenforcementofficerismakinganarrestor 4attemptingtolawfullydetainorstopanindividualorvehicle,andforthepurposeof 5preventingtheofficerfromeffectingthearrest,stop,ordetentionormaintainingcustody 6aftersuchstop,detention,orarrest,heorshe: 7 (1)Resiststhearrest,stopordetentionofsuchpersonbyusingorthreateningtheuse 8ofviolenceorphysicalforceorbyfleeingfromsuchofficer;[or] 9 (2)Interfereswiththearrest,stopordetentionofanotherpersonbyusingor 10threateningtheuseofviolence,physicalforceorphysicalinterference; or 11 (3)Whilebeingheldincustodyafterastop,detention,orarresthasbeenmade, 12escapesorattemptstoescapefromsuchcustody. 13 2.Thissectionappliesto: 14 (1)Arrests,stops,ordetentions,withorwithoutwarrants; 15 (2)Arrests,stops,[or]detentions,orcustodiesforanyoffense,infraction,or 16ordinanceviolation;and 17 (3)Arrestsforwarrantsissuedbyacourtoraprobationandparoleofficer. 18 3.Apersonispresumedtobefleeingavehiclestopifheorshecontinuestooperatea 19motorvehicleafterheorshehasseenorshouldhaveseenclearlyvisibleemergencylightsor 20hasheardorshouldhaveheardanaudiblesignalemanatingfromthelawenforcementvehicle 21pursuinghimorher.Nothinginthissectionshallbeconstruedtorequirethestateto 22proveinaprosecutionagainstadefendantthatthedefendantknewwhyheorshewas 23beingstopped,detained,orarrested. 24 4.Itisnodefensetoaprosecutionpursuanttosubsection1ofthissectionthatthelaw 25enforcementofficerwasactingunlawfullyinmakingthearrest.However,nothinginthis 26sectionshallbeconstruedtobarcivilsuitsforunlawfularrest. 27 5.Theoffenseofresisting[or],interferingwith[an],orescapingorattemptingto 28escapefromastop,detention,orarrestorfromcustodyaftersuchstop,detention,or 29arrestisaclass[Efelonyforanarrestfora: 30 (1)Felony; 31 (2)Warrantissuedforfailuretoappearonafelonycase;or 32 (3)Warrantissuedforaprobationviolationonafelonycase. 33 HCSHBs1692&1748 5 34Theoffenseofresistinganarrest,detentionorstopinviolationofsubdivision(1)or(2)of 35subsection1ofthissectionisaclass] Amisdemeanor,unless[thepersonfleeingcreatesa 36substantialriskofseriousphysicalinjuryordeathtoanyperson,inwhichcaseitisaclassE 37felony]: 38 (1)Thestop,detention,arrest,orcustodywasforafelony; 39 (2)Thestop,detention,arrest,orcustodywasforawarrantissuedforfailureto 40appearonafelonycase; 41 (3)Thestop,detention,arrest,orcustodywasforawarrantissuedfora 42probationviolationonafelonycase; 43 (4)Whileresisting,interferingwith,orescapingorattemptingtoescapefroma 44stop,detention,orarrestorfromcustody,thepersonfleesandduringsuchflightcreates 45asubstantialriskofseriousphysicalinjuryordeathtoanyperson;or 46 (5)Theescapeorattempttoescapewhileincustodyorunderarrestwasfora 47felony, 48 49inwhichcaseitisaclassEfelony;exceptthat,ifsuchescapeorattemptedescapeis 50committedbymeansofadeadlyweaponordangerousinstrumentorbyholdingany 51personhostageitisaclassAfelony. 575.151.1.Thissectionshallbeknownandmaybecitedas"Valentine'sLaw". 2 2.Apersoncommitstheoffenseofaggravatedfleeingastopordetentionofa 3motorvehicleifheorsheknowsorreasonablyshouldknowthatalawenforcement 4officerisattemptingtodetainorstopamotorvehicle,andforthepurposeofpreventing 5theofficerfromeffectingthestopordetention,heorshefleesand: 6 (1)Suchpersonoperatesamotorvehicleatahighspeed,definedastenmilesper 7hourorgreaterabovethepostedspeedlimit,orinanymannerwhichcreatesa 8substantialriskofseriousphysicalinjuryordeathtoanyperson; 9 (2)Asaresultofsuchflightcausesphysicalinjurytoanotherperson;or 10 (3)Asaresultofsuchflightcausesdeathtoanotherperson. 11 3.Apersonispresumedtobefleeingavehiclestopordetentionifheorshe 12continuestooperateamotorvehicleatahighspeedafterheorshehasseenor 13reasonablyshouldhaveseenclearlyvisibleemergencylightsorhasheardorreasonably 14shouldhaveheardanaudiblesignalemanatingfromthelawenforcementvehicle 15pursuinghimorher.Theprovisionsofthissectionshallnotapplytoadriverwho 16maintainsasafespeedandcontinuesdrivinginsearchofasafe,well-litlocationtopull 17over. HCSHBs1692&1748 6 18 4.Nothinginthissectionshallbeconstruedtorequirethestatetoproveina 19prosecutionagainstadefendantthatthedefendantknewwhyheorshewasbeing 20stopped,detained,orarrested. 21 5.Theoffenseofaggravatedfleeingastopordetentioninviolationof 22subdivision(1)ofsubsection2ofthissectionshallbeaclassDfelony,withouteligibility 23forprobation,parole,orconditionalreleaseuntilthedefendanthasservednolessthan 24oneyearofsuchsentence.Theoffenseofaggravatedfleeingastopordetentionin 25violationofsubdivision(2)ofsubsection2ofthissectionshallbeaclassBfelony.The 26offenseofaggravatedfleeingastopordetentioninviolationofsubdivision(3)of 27subsection2ofthissectionshallbeaclassAfelony. 610.140.1.Notwithstandinganyotherprovisionoflawandsubjecttotheprovisions 2ofthissection,anypersonmayapplytoanycourtinwhichsuchpersonwaschargedorfound 3guiltyofanyoffenses,violations,orinfractionsforanordertoexpungerecordsofsucharrest, 4plea,trial,orconviction.Subjecttothelimitationsofsubsection12ofthissection,aperson 5mayapplytohaveoneormoreoffenses,violations,orinfractionsexpungedifsuchoffense, 6violation,orinfractionoccurredwithinthestateofMissouriandwasprosecutedunderthe 7jurisdictionofaMissourimunicipal,associatecircuit,orcircuitcourt,solongassuchperson 8listsalltheoffenses,violations,andinfractionsheorsheisseekingtohaveexpungedinthe 9petitionandsolongasallsuchoffenses,violations,andinfractionsarenotexcludedunder 10subsection2ofthissection.Iftheoffenses,violations,orinfractionswerechargedascounts 11inthesameindictmentorinformationorwerecommittedaspartofthesamecourseof 12criminalconduct,thepersonmayincludealltherelatedoffenses,violations,andinfractions 13inthepetition,regardlessofthelimitsofsubsection12ofthissection,andthepetitionshall 14onlycountasapetitionforexpungementofthehighestlevelviolationoroffensecontainedin 15thepetitionforthepurposeofdeterminingfutureeligibilityforexpungement. 16 2.Thefollowingoffenses,violations,andinfractionsshallnotbeeligiblefor 17expungementunderthissection: 18 (1)AnyclassAfelonyoffense; 87 (3)Thepersonhassatisfiedallobligationsrelatingtoanysuchdisposition,including 88thepaymentofanyfinesorrestitution; 89 (4)Thepersondoesnothavechargespending; 90 (5)Thepetitioner'shabitsandconductdemonstratethatthepetitionerisnotathreat 91tothepublicsafetyofthestate;and 92 (6)Theexpungementisconsistentwiththepublicwelfareandtheinterestsofjustice 93warranttheexpungement. 94 95Apleadingbythepetitionerthatsuchpetitionermeetstherequirementsofsubdivisions(5) 96and(6)ofthissubsectionshallcreatearebuttablepresumptionthattheexpungementis 97warrantedsolongasthecriteriacontainedinsubdivisions(1)to(4)ofthissubsectionare 98otherwisesatisfied.Theburdenshallshifttotheprosecutingattorney,circuitattorney,or 99municipalprosecutingattorneytorebutthepresumption.Avictimofanoffense,violation,or HCSHBs1692&1748 9 100infractionlistedinthepetitionshallhaveanopportunitytobeheardatanyhearingheldunder 101thissection,andthecourtmaymakeadeterminationbasedsolelyonsuchvictim'stestimony. 102 6.Apetitiontoexpungerecordsrelatedtoanarrestforaneligibleoffense,violation, 103orinfractionmaybemadeinaccordancewiththeprovisionsofthissectiontoacourtof 104competentjurisdictioninthecountywherethepetitionerwasarrestednoearlierthanthree 105yearsfromthedateofarrest;providedthat,duringsuchtime,thepetitionerhasnotbeen 106chargedandthepetitionerhasnotbeenfoundguiltyofanymisdemeanororfelonyoffense. 107 7.Ifthecourtdeterminesthatsuchpersonmeetsallthecriteriasetforthinsubsection 1085ofthissectionforeachoftheoffenses,violations,orinfractionslistedinthepetitionfor 109expungement,thecourtshallenteranorderofexpungement.Inallcasesunderthissection, 110thecourtshallissueanorderofexpungementordismissalwithinsixmonthsofthefilingof 111thepetition.Acopyoftheorderofexpungementshallbeprovidedtothepetitionerandeach 112entitypossessingrecordssubjecttotheorder,and,uponreceiptoftheorder,eachentityshall 113closeanyrecordinitspossessionrelatingtoanyoffense,violation,orinfractionlistedinthe 114petition,inthemannerestablishedbysection610.120.Therecordsandfilesmaintainedin 115anyadministrativeorcourtproceedinginamunicipal,associate,orcircuitcourtforany 116offense,infraction,orviolationorderedexpungedunderthissectionshallbeconfidentialand 117onlyavailabletothepartiesorbyorderofthecourtforgoodcauseshown.Thecentral 118repositoryshallrequesttheFederalBureauofInvestigationtoexpungetherecordsfromits 119files. 120 8.Theordershallnotlimitanyofthepetitioner'srightsthatwererestrictedasa 121collateralconsequenceofsuchperson'scriminalrecord,andsuchrightsshallberestored 122uponissuanceoftheorderofexpungement.Forpurposesof18U.S.C.Section921(a)(33)(B) 123(ii),anorderorexpungementgrantedpursuanttothissectionshallbeconsideredacomplete 124removalofalleffectsoftheexpungedconviction.Exceptasotherwiseprovidedunderthis 125section,theeffectofsuchordershallbetorestoresuchpersontothestatusheorsheoccupied 126priortosucharrests,pleas,trials,orconvictionsasifsucheventshadnevertakenplace.No 127personastowhomsuchorderhasbeenenteredshallbeheldthereafterunderanyprovisionof 128lawtobeguiltyofperjuryorotherwisegivingafalsestatementbyreasonofhisorherfailure 129toreciteoracknowledgesucharrests,pleas,trials,convictions,orexpungementinresponse 130toaninquirymadeofhimorherandnosuchinquiryshallbemadeforinformationrelatingto 131anexpungement,exceptthepetitionershalldisclosetheexpungedoffense,violation,or 132infractiontoanycourtwhenaskedoruponbeingchargedwithanysubsequentoffense, 133violation,orinfraction.Theexpungedoffense,violation,orinfractionmaybeconsidereda 134prioroffenseindeterminingasentencetobeimposedforanysubsequentoffensethatthe 135personisfoundguiltyofcommitting. HCSHBs1692&1748 10 136 9.Notwithstandingtheprovisionsofsubsection8ofthissectiontothecontrary,a 137persongrantedanexpungementshalldiscloseanyexpungedoffense,violation,orinfraction 138whenthedisclosureofsuchinformationisnecessarytocompleteanyapplicationfor: 139 (1)Alicense,certificate,orpermitissuedbythisstatetopracticesuchindividual's 140profession; 141 (2)Anylicenseissuedunderchapter313orpermitissuedunderchapter571; 142 (3)Paidorunpaidemploymentwithanentitylicensedunderchapter313,anystate- 143operatedlottery,oranyemergencyservicesprovider,includinganylawenforcementagency; 144 (4)Employmentwithanyfederallyinsuredbankorsavingsinstitutionorcreditunion 145oranaffiliateofsuchinstitutionorcreditunionforthepurposesofcompliancewith12 146U.S.C.Section1829and12U.S.C.Section1785; 147 (5)Employmentwithanyentityengagedinthebusinessofinsuranceoranyinsurer 148forthepurposeofcomplyingwith18U.S.C.Section1033,18U.S.C.Section1034,orother 149similarlawwhichrequiresanemployerengagedinthebusinessofinsurancetoexclude 150applicantswithcertaincriminalconvictionsfromemployment;or 151 (6)Employmentwithanyemployerthatisrequiredtoexcludeapplicantswithcertain 152criminalconvictionsfromemploymentduetofederalorstatelaw,includingcorresponding 153rulesandregulations. 154 155Anemployershallnotifyanapplicantoftherequirementsundersubdivisions(4)to(6)ofthis 156subsection.Notwithstandinganyprovisionoflawtothecontrary,anexpungedoffense, 157violation,orinfractionshallnotbegroundsforautomaticdisqualificationofanapplicant,but 158maybeafactorfordenyingemployment,oraprofessionallicense,certificate,orpermit; 159exceptthat,anoffense,violation,orinfractionexpungedundertheprovisionsofthissection 160maybegroundsforautomaticdisqualificationiftheapplicationisforemploymentunder 161subdivisions(4)to(6)ofthissubsection. 162 10.Apersonwhohasbeengrantedanexpungementofrecordspertainingtoa 163misdemeanororfelonyoffense,anordinanceviolation,oraninfractionmayanswer"no"to 164anemployer'sinquiryintowhetherthepersonhaseverbeenconvictedofacrimeif,afterthe 165grantingoftheexpungement,thepersonhasnopublicrecordofamisdemeanororfelony 166offense,anordinanceviolation,oraninfraction.Theperson,however,shallanswersuchan 167inquiryaffirmativelyanddisclosehisorhercriminalconvictions,includinganyoffenseor 168violationexpungedunderthissectionorsimilarlaw,iftheemployerisrequiredtoexclude 169applicantswithcertaincriminalconvictionsfromemploymentduetofederalorstatelaw, 170includingcorrespondingrulesandregulations. 171 11.Ifthecourtdeterminesthatthepetitionerhasnotmetthecriteriaforanyofthe 172offenses,violations,orinfractionslistedinthepetitionforexpungementorthepetitionerhas HCSHBs1692&1748 11 173knowinglyprovidedfalseinformationinthepetition,thecourtshallenteranorderdismissing 174thepetition.Anypersonwhosepetitionforexpungementhasbeendismissedbythecourtfor 175failuretomeetthecriteriasetforthinsubsection5ofthissectionmaynotrefileanother 176petitionuntilayearhaspassedsincethedateoffilingforthepreviouspetition. 177 12.Apersonmaybegrantedmorethanoneexpungementunderthissectionprovided 178thatduringhisorherlifetime,thetotalnumberofoffenses,violations,orinfractionsfor 179whichordersofexpungementaregrantedtothepersonshallnotexceedthefollowinglimits: 180 (1)Notmorethantwomisdemeanoroffensesorordinanceviolationsthathavean 181authorizedtermofimprisonment;and 182 (2)Notmorethanonefelonyoffense. 183 184Apersonmaybegrantedexpungementunderthissectionforanynumberofinfractions. 185Nothinginthissectionshallpreventthecourtfrommaintainingrecordstoensurethatan 186individualhasnotexceededthelimitationsofthissubsection.Nothinginthissectionshallbe 187construedtolimitorimpairinanywaythesubsequentuseofanyrecordexpungedunderthis 188sectionofanyarrestsorfindingsofguiltbyalawenforcementagency,criminaljustice 189agency,prosecutingattorney,circuitattorney,ormunicipalprosecutingattorney,includingits 190useasaprioroffense,violation,orinfraction. 191 13.Thecourtshallmakeavailableaformforprosepetitionersseekingexpungement, 192whichshallincludethefollowingstatement:"Ideclareunderpenaltyofperjurythatthe 193statementsmadehereinaretrueandcorrecttothebestofmyknowledge,information,and 194belief.". 195 14.Nothinginthissectionshallbeconstruedtolimitorrestricttheavailabilityof 196expungementtoanypersonunderanyotherlaw. [575.200.1.Apersoncommitstheoffenseofescapefromcustodyor 2 attemptedescapefromcustodyif,whilebeingheldincustodyafterarrestfor 3 anyoffenseorviolationofprobationorparole,heorsheescapesorattemptsto 4 escapefromcustody. 5 2.TheoffenseofescapeorattemptedescapefromcustodyisaclassA 6 misdemeanorunless: 7 (1)Thepersonescapingorattemptingtoescapeisunderarrestfora 8 felony,inwhichcaseitisaclassEfelony;or 9 (2)Theoffenseiscommittedbymeansofadeadlyweaponor 10 dangerousinstrumentorbyholdinganypersonashostage,inwhichcaseitisa 11 classAfelony.] ✔ HCSHBs1692&1748 12
