Whileitisnotadefenseto prosecutionofthisoffensethattheofficerwasactingunlawfully, theprovisionsofthebilldonotbarcivilsuitsforunlawful arrest.Theoffenseofaggravatedfleeingastopordetentionwhen apersonoperatesavehicleatahighrateofspeedorinsucha waythatcreatesasubstantialriskofseriousphysicalinjuryor deathtoanypersonisaclassDfelonywithouteligibilityfor probation,parole,orconditionalreleaseuntilthepersonhas servedatleastoneyearofhisorhersentence. Theoffensewhen, asaresultofthefleeing,thepersoncausesphysicalinjuryto anotherpersonisaclassBfelony.If,asaresultofthe fleeing,apersoncausesdeathtoanotherperson,theoffenseisa classAfelony.
