190.142.1.(1)ForapplicationssubmittedbeforetherecognitionofEMSpersonnel
2licensureinterstatecompactundersections190.900to190.939takeseffect,thedepartment
3shall,withinareasonabletimeafterreceiptofanapplication,causesuchinvestigationasit
4deemsnecessarytobemadeoftheapplicantforanemergencymedicaltechnician'slicense.
5 (2)ForapplicationssubmittedaftertherecognitionofEMSpersonnellicensure
6interstatecompactundersections190.900to190.939takeseffect,anapplicantforinitial
7licensureasanemergencymedicaltechnicianinthisstateshallsubmittoabackgroundcheck
8bytheMissouristatehighwaypatrolandtheFederalBureauofInvestigationthrougha
9processapprovedbythedepartmentofhealthandseniorservices.Suchprocessesmay
10includetheuseofvendorsorsystemsadministeredbytheMissouristatehighwaypatrol.The
11departmentmaysharetheresultsofsuchacriminalbackgroundcheckwithanyemergency
12serviceslicensingagencyinanymemberstate,asthattermisdefinedundersection190.900,
13inrecognitionoftheEMSpersonnellicensureinterstatecompact.Thedepartmentshallnot
14issuealicenseuntilthedepartmentreceivestheresultsofanapplicant'scriminalbackground
15checkfromtheMissouristatehighwaypatrolandtheFederalBureauofInvestigation,but,
16notwithstandingthissubsection,thedepartmentmayissueatemporarylicenseasprovided
17undersection190.143.Anyfeesdueforacriminalbackgroundcheckshallbepaidbythe
18applicant.
19 (3)Thedirectormayauthorizeinvestigationsintocriminalrecordsinotherstatesfor
20anyapplicant.
21 2.Thedepartmentshallissuealicensetoalllevelsofemergencymedicaltechnicians,
22foraperiodoffiveyears,iftheapplicantmeetstherequirementsestablishedpursuantto
23sections190.001to190.245andtherulesadoptedbythedepartmentpursuanttosections
24190.001to190.245.Thedepartmentmaypromulgaterulesrelatingtotherequirementsforan

41 3.Applicationforalllevelsofemergencymedicaltechnicianlicenseshallbemade
42uponsuchformsasprescribedbythedepartmentinrulesadoptedpursuanttosections
43190.001to190.245.Theapplicationformshallcontainsuchinformationasthedepartment
44deemsnecessarytomakeadeterminationastowhethertheemergencymedicaltechnician
45meetsalltherequirementsofsections190.001to190.245andrulespromulgatedpursuantto
46sections190.001to190.245.
47 4.Alllevelsofemergencymedicaltechniciansmayperformonlythatpatientcare
48whichis:
49 (1)Consistentwiththetraining,educationandexperienceoftheparticularemergency
50medicaltechnician;and
51 (2)Orderedbyaphysicianorsetforthinprotocolsapprovedbythemedicaldirector.
52 5.Nopersonshallholdthemselvesoutasanemergencymedicaltechnicianor
53providetheservicesofanemergencymedicaltechnicianunlesssuchpersonislicensedbythe
54department.
55 6.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
56createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
57withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
58Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
59generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
60disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
61rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2002,shallbeinvalid
62andvoid.
HB1706	3 198.082.1.Eachcertifiednursingassistanthiredtoworkinaskillednursingor
2intermediatecarefacilityafterJanuary1,1980,shallhavesuccessfullycompletedanursing
3assistanttrainingprogramapprovedbythedepartmentorshallenrollinandbeginthefirst
4availableapprovedtrainingprogramwhichisscheduledtocommencewithinninetydaysof
5thedateofthecertifiednursingassistant'semploymentandwhichshallbecompletedwithin
6fourmonthsofemployment.Trainingprogramsshallbeofferedatanyfacilitylicensedby
7thedepartmentofhealthandseniorservices;anyskillednursingorintermediatecareunitina
8Missouriveteranshome,asdefinedinsection42.002;oranyhospital,asdefinedinsection
9197.020.Trainingprogramsshallbereasonablyaccessibletotheenrolleesineachclass.The
10programmaybeestablishedbyaskillednursingorintermediatecarefacility,unit,orhospital;
11byaprofessionalorganization;orbythedepartment,andtrainingshallbegivenbythe
12personnelofthefacility,unit,orhospital;byaprofessionalorganization;bythedepartment;
13byanycommunitycollege;orbythevocationaleducationdepartmentofanyhighschool.
14 2.Asusedinthissectiontheterm"certifiednursingassistant"meansanemployee
15whohascompletedthetrainingrequiredundersubsection1ofthissection,whohaspassed
16thecertificationexam,andwhoisassignedbyaskillednursingorintermediatecarefacility,
17unit,orhospitaltoprovideorassistintheprovisionofdirectresidenthealthcareservices
18underthesupervisionofanurselicensedunderthenursingpracticelaw,chapter335.
19 3.Thissectionshallnotapplytoanypersonotherwiseregulatedorlicensedto
20performhealthcareservicesunderthelawsofthisstate.Itshallnotapplytovolunteersorto
21membersofreligiousorfraternalorderswhichoperateandadministerthefacility,ifsuch
22volunteersormembersworkwithoutcompensation.
23 4.Thetrainingprogramrequirementsshallbedefinedinregulationbythedepartment
24andshallrequireatleastseventy-fiveclassroomhoursoftrainingandonehundredhours
25supervisedandon-the-jobtraining.On-the-jobtrainingsitesshallincludesupervised
26practicaltraininginalaboratoryorothersettinginwhichthetraineedemonstratesknowledge
27whileperformingtasksonanindividualunderthedirectsupervisionofaregisterednurseora
28licensedpracticalnurse.Thetrainingshallbecompletedwithinfourmonthsofemployment
29andmayconsistofnormalemploymentasnurseassistantsorhospitalnursingsupportstaff
30underthesupervisionofalicensednurse.
31 5.Certifiednursingassistantswhohavenotsuccessfullycompletedthenursing
32assistanttrainingprogrampriortoemploymentmaybegindutiesasacertifiednursing
33assistantandmayprovidedirectresidentcareonlyifunderthedirectsupervisionofa
34licensednursepriortocompletionoftheseventy-fiveclassroomhoursofthetraining
35program.
HB1706	4 36 6.Thecompetencyevaluationshallbeperformedinafacility,asdefinedin42CFR
37Sec.483.5,orlaboratorysettingcomparabletothesettinginwhichtheindividualshall
38functionasacertifiednursingassistant.
39 7.Personscompletingthetrainingrequirementsofunlicensedassistivepersonnel
40under19CSR30-20.125oritssuccessorregulation,andwhohavecompletedthecompetency
41evaluation,shallbeallowedtositforthecertifiednursingassistantexaminationandbe
42deemedtohavefulfilledtheclassroomandclinicalstandardsfordesignationasacertified
43nursingassistant.
44 8.Thedepartmentofhealthandseniorservicesmayofferadditionaltraining
45programsandcertificationstostudentswhoarealreadycertifiedasnursingassistants
46accordingtoregulationspromulgatedbythedepartmentandcurriculumapprovedbythe
47board.
48 9.Eachcertifiednursingassistantshallannuallycompleteonehourofsexand
49humantraffickingtrainingconsistentwiththeguidelinesestablishedinsection27.170.
211.326.1.Thestatecourtsadministratorshall:
2 (1)Evaluateexistingservicesbyestablishingperformancestandardsincluding
3performancestandardsforjuvenilecourtsreceivingdiversionfunds;
4 (2)Developstandardsfororientationtrainingforallnewjuvenilecourtprofessional
5personnel,includingjuvenileofficers,deputyjuvenileofficersandotherpersonneldeemed
6necessarybythestatecourtsadministrator;
7 (3)Developstandardsforcontinuingeducationforexistingjuvenilecourt
8professionalpersonnel,includingjuvenileofficers,deputyjuvenileofficersandother
9personneldeemednecessarybythestatecourtsadministrator;
10 (4)Developaprocesstoevaluateservicesandcollectrelevantoutcomedata;
11 (5)Developastandardizedassessmentformforclassifyingjuvenileoffenders;and
12 (6)Developguidelinesforjuvenilecourtjudgestouseindeterminingthelengthof
13timeachildmaybedetainedpriortoinformaladjustmentorformaladjudication.
14 2.Standards,trainingandassessmentformsdevelopedpursuanttosubsection1of
15thissectionshallbedevelopedconsideringracialdisparitiesinthejuvenilejusticesystem.
16 3.Continuingeducationstandardsestablishedundersubdivision(3)of
17subsection1ofthissectionshallincludearequirementthateachjuvenileofficer
18annuallycompletesonehourofsexandhumantraffickingtrainingconsistentwiththe
19guidelinesestablishedinsection27.170.
335.059.Eachregisterednurse,licensedpracticalnurse,andadvancedpractice
2registerednurselicensedunderthischaptershallannuallycompleteonehourofsexand
3humantraffickingtrainingconsistentwiththeguidelinesestablishedinsection27.170.
HB1706	5 337.618.Eachlicenseissuedpursuanttotheprovisionsofsections337.600to
2337.689shallexpireonarenewaldateestablishedbythedirector.Thetermoflicensureshall
3betwenty-fourmonths.Thecommitteeshallrequireaminimumnumberofthirtyclockhours
4ofcontinuingeducationforrenewalofalicenseissuedpursuanttosections337.600to
5337.689,includingtwohoursofsuicideassessment,referral,treatment,andmanagement
6trainingandtwohoursofsexandhumantraffickingtrainingconsistentwiththe
7guidelinesestablishedinsection27.170. Thecommitteeshallrenewanylicenseupon
8applicationforarenewal,completionoftherequiredcontinuingeducationhoursandupon
9paymentofthefeeestablishedbythecommitteepursuanttotheprovisionsofsection
10337.612.Asprovidedbyrule,theboardmaywaiveorextendthetimerequirementsfor
11completionofcontinuingeducationforreasonsrelatedtohealth,militaryservice,foreign
12residency,orforothergoodcause.Allrequestsforwaiversorextensionsoftimeshallbe
13madeinwritingandsubmittedtotheboardbeforetherenewaldate.
491.075.1.Astatementmadebyachildundertheageof[fourteen] eighteen, ora
2vulnerableperson,relatingtoanoffenseunderchapter565,566,568or573,performedby
3another,nototherwiseadmissiblebystatuteorcourtrule,isadmissibleinevidencein
4criminalproceedingsinthecourtsofthisstateassubstantiveevidencetoprovethetruthof
5thematterassertedif:
6 (1)Thecourtfinds,inahearingconductedoutsidethepresenceofthejurythatthe
7time,contentandcircumstancesofthestatementprovidesufficientindiciaofreliability;and
8 (2)(a)Thechildorvulnerablepersontestifiesattheproceedings;or
9 (b)Thechildorvulnerablepersonisunavailableasawitness;or
10 (c)Thechildorvulnerablepersonisotherwisephysicallyavailableasawitnessbut
11thecourtfindsthatthesignificantemotionalorpsychologicaltraumawhichwouldresult
12fromtestifyinginthepersonalpresenceofthedefendantmakesthechildorvulnerableperson
13unavailableasawitnessatthetimeofthecriminalproceeding.
14 2.Notwithstandingsubsection1ofthissectionoranyprovisionoflaworruleof
15evidencerequiringcorroborationofstatements,admissionsorconfessionsofthedefendant,
16andnotwithstandinganyprohibitionofhearsayevidence,astatementbyachildwhenunder
17theageof[fourteen] eighteen, oravulnerableperson,whoisallegedtobevictimofan
18offenseunderchapter565,566,568or573issufficientcorroborationofastatement,
19admissionorconfessionregardlessofwhetherornotthechildorvulnerablepersonis
20availabletotestifyregardingtheoffense.
21 3.Astatementmaynotbeadmittedunderthissectionunlesstheprosecutingattorney
22makesknowntotheaccusedortheaccused'scounselhisorherintentiontoofferthe
23statementandtheparticularsofthestatementsufficientlyinadvanceoftheproceedingsto
HB1706	6 24providetheaccusedortheaccused'scounselwithafairopportunitytopreparetomeetthe
25statement.
26 4.Nothinginthissectionshallbeconstruedtolimittheadmissibilityofstatements,
27admissionsorconfessionsotherwiseadmissiblebylaw.
28 5.Forthepurposesofthissection,"vulnerableperson"shallmeanapersonwho,asa
29resultofaninadequatelydevelopedorimpairedintelligenceorapsychiatricdisorderthat
30materiallyaffectsabilitytofunction,lacksthementalcapacitytoconsent,orwhose
31developmentalleveldoesnotexceedthatofanordinarychildof[fourteen] seventeenyears
32ofage.
492.304.1.Inadditiontotheadmissibilityofastatementundertheprovisionsof
2section492.303,thevisualandauralrecordingofaverbalornonverbalstatementofachild
3whenundertheageof[fourteenwhoisallegedtobeavictimof]eighteen,oravulnerable
4person,relatingtoanoffenseundertheprovisionsofchapter565,566[or],568,or573,if
5performedbyanother,isadmissibleintoevidenceif:
6 (1)Noattorneyforeitherpartywaspresentwhenthestatementwasmade;except
7that,foranystatementtakenatastate-fundedchildassessmentcenterasprovidedforin
8subsection2ofsection210.001,anattorneyrepresentingthestateofMissouriinacriminal
9investigationmay,asamemberofamultidisciplinaryinvestigationteam,observethetaking
10ofsuchstatement,butsuchattorneyshallnotbepresentintheroomwheretheinterviewis
11beingconducted;
12 (2)Therecordingisbothvisualandauralandisrecordedonfilmorvideotapeorby
13otherelectronicmeans;
14 (3)Therecordingequipmentwascapableofmakinganaccuraterecording,the
15operatoroftheequipmentwascompetent,andtherecordingisaccurateandhasnotbeen
16altered;
17 (4)Thestatementwasnotmadeinresponsetoquestioningcalculatedtoleadthechild
18orvulnerablepersontomakeaparticularstatementortoactinaparticularway;
19 (5)Everyvoiceontherecordingisidentified;
20 (6)Thepersonconductingtheinterviewofthechildorvulnerablepersoninthe
21recording, oracurrentemployeeofachildassessmentcenterifachildwasrecorded,is
22presentattheproceedingandavailabletotestifyorbecross-examinedbyeitherparty;and
23 (7)Thedefendantortheattorneyforthedefendantisaffordedanopportunitytoview
24therecordingbeforeitisofferedintoevidence.
25 2.Ifthechildorvulnerablepersondoesnottestifyattheproceeding,thevisualand
26auralrecordingofaverbalornonverbalstatementofthechildorvulnerablepersonshallnot
27beadmissibleunderthissectionunlesstherecordingqualifiesforadmissionundersection

30vulnerablepersonisadmissibleunderthissectionandthechildorvulnerableperson
31testifiesattheproceeding,itshallbeadmissibleinadditiontothetestimonyofthechildor
32vulnerablepersonattheproceedingwhetherornotitrepeatsorduplicatesthechild'sor
33vulnerableperson'stestimony.
34 4.Asusedinthissection,anonverbalstatementshallbedefinedasany
35demonstrationofthechildorvulnerablepersonbyhisorheractions,facialexpressions,
36demonstrationswithadollorothervisualaidwhetherornotthisdemonstrationis
37accompaniedbywords.
38 5.Forthepurposesofthissection,"vulnerableperson"shallmeanaperson
39who,asaresultofaninadequatelydevelopedorimpairedintelligenceorapsychiatric
40disorderthatmateriallyaffectstheabilitytofunction,lacksthementalcapacityto
41consent,orwhosedevelopmentalleveldoesnotexceedthatofanordinarychildof
42seventeenyearsofage.
566.151.1.Apersontwenty-oneyearsofageoroldercommitstheoffenseof
2enticementofachildifheorshepersuades,solicits,coaxes,entices,orlureswhetherby
3words,actionsorthroughcommunicationviatheinternetoranyelectroniccommunication,
4anypersonwhoislessthan[fifteen] seventeenyearsofageforthepurposeofengagingin
5sexualconduct.
6 2.Itisnotadefensetoaprosecutionforaviolationofthissectionthattheother
7personwasapeaceofficermasqueradingasaminor.
8 3.Enticementofachildoranattempttocommitenticementofachildisafelonyfor
9whichtheauthorizedtermofimprisonmentshallbenotlessthanfiveyearsandnotmorethan
10thirtyyears.Nopersonconvictedunderthissectionshallbeeligibleforparole,probation,
11conditionalrelease,orsuspendedimpositionorexecutionofsentenceforaperiodoffive
12calendaryears.
566.203.1.Apersoncommitstheoffenseofabusinganindividualthroughforced
2laborbyknowinglyprovidingorobtainingthelabororservicesofaperson:
3 (1)Bycausingorthreateningtocauseseriousphysicalinjurytoanyperson;
4 (2)Byphysicallyrestrainingorthreateningtophysicallyrestrainanotherperson;
5 (3)Byblackmail;
6 (4)Bymeansofanyscheme,plan,orpatternofbehaviorintendedtocausesuch
7persontobelievethat,ifthepersondoesnotperformthelaborservices,thepersonoranother
8personwillsufferseriousphysicalinjury,physicalrestraint,orfinancialharm;or
9 (5)Bymeansoftheabuseorthreatenedabuseofthelaworthelegalprocess.
HB1706	8 10 2.Apersonwhoisfoundguiltyofthecrimeofabusethroughforcedlaborshallnot
11berequiredtoregisterasasexualoffenderpursuanttotheprovisionsofsection589.400,
12unlesssuchpersonisotherwiserequiredtoregisterpursuanttotheprovisionsofsuchsection.
13 3.Theoffenseofabusethroughforcedlaborisafelonypunishablebyimprisonment
14foratermofyearsnotlessthanfiveyearsandnotmorethantwentyyearsandafinenotto
15exceedtwohundredfiftythousanddollars.Ifdeathresultsfromaviolationofthissection,or
16iftheviolationincludeskidnappingoranattempttokidnap,sexualabusewhenpunishableas
17aclassBfelony,oranattempttocommitsexualabusewhenpunishableasaclassBfelony,or
18anattempttokill,itshallbepunishableforatermofyearsnotlessthanfiveyearsorlifeand
19afinenottoexceedtwohundredfiftythousanddollars.
20 4.Inadditiontoanyfineimposed,thecourtshallenterajudgmentofrestitution
21intheamountoffivethousanddollarsinfavorofthestateofMissouri,payabletothe
22humantraffickingandsexualexploitationfundestablishedundersection589.700,upon
23apleaofguiltyorafindingofguiltforaviolationofthissection.
566.206.1.Apersoncommitstheoffenseoftraffickingforthepurposesofslavery,
2involuntaryservitude,peonage,orforcedlaborifheorsheknowinglyrecruits,entices,
3harbors,transports,provides,orobtainsbyanymeans,includingbutnotlimitedtothrough
4theuseofforce,abduction,coercion,fraud,deception,blackmail,orcausingorthreateningto
5causefinancialharm,anotherpersonforlabororservices,forthepurposesofslavery,
6involuntaryservitude,peonage,orforcedlabor,orbenefits,financiallyorbyreceiving
7anythingofvalue,fromparticipationinsuchactivities.
8 2.Apersonwhoisfoundguiltyoftheoffenseoftraffickingforthepurposesof
9slavery,involuntaryservitude,peonage,orforcedlaborshallnotberequiredtoregisterasa
10sexualoffenderpursuanttotheprovisionsofsection589.400,unlessheorsheisotherwise
11requiredtoregisterpursuanttotheprovisionsofsuchsection.
12 3.Exceptasprovidedinsubsection4ofthissection,theoffenseoftraffickingforthe
13purposesofslavery,involuntaryservitude,peonage,orforcedlaborisafelonypunishableby
14imprisonmentforatermofyearsnotlessthanfiveyearsandnotmorethantwentyyearsand
15afinenottoexceedtwohundredfiftythousanddollars.
16 4.Ifdeathresultsfromaviolationofthissection,oriftheviolationincludes
