17subsection1ofthissectionshallincludearequirementthateachjuvenileofficer 18annuallycompletesonehourofsexandhumantraffickingtrainingconsistentwiththe 19guidelinesestablishedinsection27.170.Theprovisionsofthissubsectionshallbecome 20effectiveonJanuary1,2025,andshallexpireonDecember31,2029. 335.059.1.Eachregisterednurse,licensedpracticalnurse,andadvanced 2practiceregisterednurselicensedunderthischaptershallannuallycompleteonehour 3ofsexandhumantraffickingtrainingconsistentwiththeguidelinesestablishedin 4section27.170. 5 2.Thestateboardofnursingshallnotrenewthelicenseofanursesubjecttothe 6requirementundersubsection1ofthissectionunlessthenursehasdemonstrated 7compliancewithsuchrequirement. 8 3.TheprovisionsofthissectionshallbecomeeffectiveonJanuary1,2025,and (b)Thechildorvulnerablepersonisunavailableasawitness;or 10 (c)Thechildorvulnerablepersonisotherwisephysicallyavailableasawitnessbut 11thecourtfindsthatthesignificantemotionalorpsychologicaltraumawhichwouldresult 12fromtestifyinginthepersonalpresenceofthedefendantmakesthechildorvulnerableperson 13unavailableasawitnessatthetimeofthecriminalproceeding. 14 2.Notwithstandingsubsection1ofthissectionoranyprovisionoflaworruleof 15evidencerequiringcorroborationofstatements,admissionsorconfessionsofthedefendant, 16andnotwithstandinganyprohibitionofhearsayevidence,astatementbyachildwhenunder 17theageof[fourteen] eighteen, oravulnerableperson,whoisallegedtobevictimofan 18offenseunderchapter565,566,568or573issufficientcorroborationofastatement, 19admissionorconfessionregardlessofwhetherornotthechildorvulnerablepersonis 20availabletotestifyregardingtheoffense. 21 3.Astatementmaynotbeadmittedunderthissectionunlesstheprosecutingattorney 22makesknowntotheaccusedortheaccused'scounselhisorherintentiontoofferthe 23statementandtheparticularsofthestatementsufficientlyinadvanceoftheproceedingsto 24providetheaccusedortheaccused'scounselwithafairopportunitytopreparetomeetthe 25statement. 26 4.Nothinginthissectionshallbeconstruedtolimittheadmissibilityofstatements, 27admissionsorconfessionsotherwiseadmissiblebylaw. 28 5.Forthepurposesofthissection,"vulnerableperson"shallmeanapersonwho,asa 29resultofaninadequatelydevelopedorimpairedintelligenceorapsychiatricdisorderthat 30materiallyaffectsabilitytofunction,lacksthementalcapacitytoconsent,orwhose 31developmentalleveldoesnotexceedthatofanordinarychildof[fourteen] seventeenyears 32ofage. 492.304.1.Inadditiontotheadmissibilityofastatementundertheprovisionsof 2section492.303,thevisualandauralrecordingofaverbalornonverbalstatementofachild 3whenundertheageof[fourteenwhoisallegedtobeavictimof]eighteen,oravulnerable HCSHBs1706&1539 10 4person,relatingtoanoffenseundertheprovisionsofchapter565,566[or],568,or573,if 5performedbyanother,isadmissibleintoevidenceif: 6 (1)Noattorneyforeitherpartywaspresentwhenthestatementwasmade;except 7that,foranystatementtakenatastate-fundedchildassessmentcenterasprovidedforin 8subsection2ofsection210.001,anattorneyrepresentingthestateofMissouriinacriminal 9investigationmay,asamemberofamultidisciplinaryinvestigationteam,observethetaking 10ofsuchstatement,butsuchattorneyshallnotbepresentintheroomwheretheinterviewis 11beingconducted; 12 (2)Therecordingisbothvisualandauralandisrecordedonfilmorvideotapeorby 13otherelectronicmeans; 14 (3)Therecordingequipmentwascapableofmakinganaccuraterecording,the 15operatoroftheequipmentwascompetent,andtherecordingisaccurateandhasnotbeen 16altered; 17 (4)Thestatementwasnotmadeinresponsetoquestioningcalculatedtoleadthechild 18orvulnerablepersontomakeaparticularstatementortoactinaparticularway; 19 (5)Everyvoiceontherecordingisidentified; 20 (6)Thepersonconductingtheinterviewofthechildorvulnerablepersoninthe 21recording, oracurrentemployeeofachildassessmentcenterifachildwasrecorded,is 22presentattheproceedingandavailabletotestifyorbecross-examinedbyeitherparty;and 23 (7)Thedefendantortheattorneyforthedefendantisaffordedanopportunitytoview 24therecordingbeforeitisofferedintoevidence. 25 2.Ifthechildorvulnerablepersondoesnottestifyattheproceeding,thevisualand 26auralrecordingofaverbalornonverbalstatementofthechildorvulnerablepersonshallnot 27beadmissibleunderthissectionunlesstherecordingqualifiesforadmissionundersection 28491.075. 29 3.Ifthevisualandauralrecordingofaverbalornonverbalstatementofachildor 30vulnerablepersonisadmissibleunderthissectionandthechildorvulnerableperson 31testifiesattheproceeding,itshallbeadmissibleinadditiontothetestimonyofthechildor 32vulnerablepersonattheproceedingwhetherornotitrepeatsorduplicatesthechild'sor 33vulnerableperson'stestimony. 34 4.Asusedinthissection,anonverbalstatementshallbedefinedasany 35demonstrationofthechildorvulnerablepersonbyhisorheractions,facialexpressions, 36demonstrationswithadollorothervisualaidwhetherornotthisdemonstrationis 37accompaniedbywords. 38 5.Forthepurposesofthissection,"vulnerableperson"shallmeanaperson 39who,asaresultofaninadequatelydevelopedorimpairedintelligenceorapsychiatric 40disorderthatmateriallyaffectstheabilitytofunction,lacksthementalcapacityto HCSHBs1706&1539 11 41consent,orwhosedevelopmentalleveldoesnotexceedthatofanordinarychildof 42seventeenyearsofage. 566.151.1.Apersontwenty-oneyearsofageoroldercommitstheoffenseof 2enticementofachildifheorshepersuades,solicits,coaxes,entices,orlureswhetherby 3words,actionsorthroughcommunicationviatheinternetoranyelectroniccommunication, 4anypersonwhoislessthan[fifteen] seventeenyearsofageforthepurposeofengagingin 5sexualconduct. 6 2.Itisnotadefensetoaprosecutionforaviolationofthissectionthattheother 7personwasapeaceofficermasqueradingasaminor. 8 3.Enticementofachildoranattempttocommitenticementofachildisafelonyfor 9whichtheauthorizedtermofimprisonmentshallbenotlessthanfiveyearsandnotmorethan 10thirtyyears.Nopersonconvictedunderthissectionshallbeeligibleforparole,probation, 11conditionalrelease,orsuspendedimpositionorexecutionofsentenceforaperiodoffive 12calendaryears. 567.030.1.Apersoncommitstheoffenseofpatronizingprostitutionifheorshe: 2 (1)Pursuanttoapriorunderstanding,givessomethingofvaluetoanotherpersonas 3compensationforhavingengagedinsexualconductwithanyperson;or 4 (2)Givesoragreestogivesomethingofvaluetoanotherpersonwiththe 5understandingthatsuchpersonoranotherpersonwillengageinsexualconductwithany 6person;or 7 (3)Solicitsorrequestsanotherpersontoengageinsexualconductwithanypersonin 8returnforsomethingofvalue. 9 2.Itshallnotbeadefensethatthepersonbelievedthattheindividualheorshe 10patronizedforprostitutionwaseighteenyearsofageorolder. 11 3.Theoffenseofpatronizingprostitutionisaclass[Bmisdemeanor] Efelony, unless 12theindividualwhothepersonpatronizesislessthaneighteenyearsofagebutolderthan 13[fourteen] fifteenyearsofage,inwhichcasepatronizingprostitutionisaclass[E]Dfelony. 14 4.Theoffenseofpatronizingprostitutionisaclass[D]Bfelonyiftheindividualwho 15thepersonpatronizesis[fourteen] fifteenyearsofageoryounger.Nothinginthissection 16shallprecludetheprosecutionofanindividualfortheoffensesof: 17 (1)Statutoryrapeinthefirstdegreepursuanttosection566.032; 18 (2)Statutoryrapeintheseconddegreepursuanttosection566.034; 19 (3)Statutorysodomyinthefirstdegreepursuanttosection566.062;or 20 (4)Statutorysodomyintheseconddegreepursuanttosection566.064. 589.700.1.Inadditiontoanyfineimposedforaviolationofsection566.203, 2566.206,566.209,566.210,566.211,or566.215,thecourtshallenterajudgmentof 3restitutionintheamountspecifiedinthissubsectioninfavorofthestateofMissouri, HCSHBs1706&1539 12 4payabletothehumantraffickingandsexualexploitationfundestablishedunderthis 5section,uponapleaofguiltyorafindingofguiltforaviolationofsection566.203, 6566.206,566.209,566.210,566.211,or566.215.Thejudgmentofrestitutionshallbein 7theamountof: 8 (1)Tenthousanddollarspereachidentifiedvictimoftheoffenseoroffensesfor 9whichrestitutionisrequiredunderthissubsection;and 10 (2)Twothousandfivehundreddollarsforeachcountyinwhichsuchoffenseor 11offensesoccurred. 12 2.Thereisherebycreatedinthestatetreasurythe"HumanTraffickingand 13SexualExploitationFund",whichshallconsistofproceedsfromthehumantrafficking 14restitutioncollectedforviolationsofsections566.203,566.206,566.209,566.210,566.211, 15and566.215.Thestatetreasurershallbecustodianofthefund.Inaccordancewith 16sections30.170and30.180,thestatetreasurermayapprovedisbursements.Thefund 17shallbeadedicatedfundand,uponappropriation,moneysinthisfundshallbe 18distributedtothecountyorcountieswherethehumantraffickingoffenseoroffenses 19occurred.Uponreceiptofmoneysfromthefund,acountyshallallocatethe 20disbursementasfollows: 21 (1)Tenthousanddollarspereachidentifiedvictimoftheoffenseoroffensesthat 22occurredinthecountytowardlocalrehabilitationservicesforvictimsofhuman 23traffickingincluding,butnotlimitedto,mentalhealthandsubstanceabusecounseling; 24generaleducation,includingparentingskills;housingrelief;vocationaltraining;and 25employmentcounseling;and 26 (2)Twothousandfivehundreddollarstowardlocaleffortstopreventhuman 27traffickingincluding,butnotlimitedto,educationprogramsforpersonsconvictedof 28humantraffickingoffensesandincreasingthenumberoflocallawenforcement 29memberschargedwithenforcinghumantraffickinglaws. 30 3.Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 31remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe 32generalrevenuefund. 33 4.Thestatetreasurershallinvestmoneysinthefundinthesamemanneras 34otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe 35creditedtothefund. 590.050.1.(1)ThePOSTcommissionshallestablishrequirementsforthe 2continuingeducationofallpeaceofficers. 3 (2)Eachpeaceofficershallberequiredtoreceivetwohoursofsexandhuman 4traffickingtrainingconsistentwiththeguidelinesestablishedinsection27.170within 5thelawenforcementcontinuingeducationone-yearreportingperiod.Theprovisionsof HCSHBs1706&1539 13 6thissubdivisionshallbecomeeffectiveonJanuary1,2025,andshallexpireonDecember 731,2029. 8 (3)Peaceofficerswhomaketrafficstopsshallberequiredtoreceive[threehours] 9onehouroftrainingwithinthelawenforcementcontinuingeducation[three-year] one-year 10reportingperiodconcerningtheprohibitionagainstracialprofilingandsuchtrainingshall 11promoteunderstandingandrespectforracialandculturaldifferencesandtheuseofeffective, 12noncombativemethodsforcarryingoutlawenforcementdutiesinaraciallyandculturally 13diverseenvironment. 14 2.Thedirectorshalllicensecontinuingeducationprovidersandmayprobate,suspend 15andrevokesuchlicensesuponwrittennoticestatingthereasonsforsuchaction.Anyperson 16aggrievedbyadecisionofthedirectorpursuanttothissubsectionmayappealasprovidedin 17chapter536. 18 3.Thecostsofcontinuinglawenforcementeducationshallbereimbursedinpartby 19moneysfromthepeaceofficerstandardsandtrainingcommissionfundcreatedinsection 20590.178,subjecttoavailabilityoffunds,exceptthatnosuchfundsshallbeusedforthe 21trainingofanypersonnotactivelycommissionedoremployedbyacountyormunicipallaw 22enforcementagency. 23 4.Thedirectormayengageinanyactivityintendedtofurthertheprofessionalismof 24peaceofficersthroughtrainingandeducation,includingtheprovisionofspecializedtraining 25throughthedepartmentofpublicsafety. ✔
