Thisbillestablishesthe"CommitteeonSexandHumanTrafficking
Training",whichwillbecomposedofsixmembers,including,among
others,arepresentative oftheAttorneyGeneral'sOffice,a
representative oftheDepartmentofPublicSafety,andajuvenile
officer. Thecommitteemustannuallyevaluateandestablish
guidelinesforrequiredsexandhumantraffickingtraining. The
committeewilldissolveonAugust28,2029.
TheDepartmentofHealthandSeniorServiceswillrequireeachEMT,
includingeachparamedic,toreceivefivehoursofsexandhuman
traffickingtrainingaspartofcontinuingeducationrequirements
forrelicensureeveryfiveyears.Eachcertifiednursing
assistant,registerednurse,licensedpracticalnurse,advanced
practiceregisterednurse,andjuvenileofficermustcompleteone
hourofsexandhumantraffickingtrainingannually. Social
workerswillberequiredtocompletetwohoursofsexandhuman
traffickingtrainingforlicenserenewal. Lastly,eachpeace
officerwillberequiredtoreceivetwohoursofsexandhuman
traffickingtrainingwithinthelawenforcementcontinuing
educationone-yearreportingperiod.
Currently,undercertaincircumstances, astatementmadebyachild
undertheageof14orbyavulnerableperson,orthevisualand
auralrecordingofaverbalornonverbalstatementofsuchchildor
vulnerableperson,isadmissibleintoevidenceincriminal
proceedingsassubstantiveevidencetoprovethetruthofthe
matterasserted. Thisbillincreasestheagetoachildunderthe
ageof18anditamendsthedefinitionof"vulnerableperson"to
includeapersonwhosedevelopmentalleveldoesnotexceedthatof
anordinarychildof17yearsofage,increasedfrom14yearsof
age.
Currently,aperson21yearsoldoroldercommitstheoffenseof
enticementofachildifheorshesatisfiestheelementsofthe
offenseandthechildisunder15yearsold.Thisbillincreases
theageofthechildtounder17yearsold.
Thebillalsoprovidesthatapersonwhopledguiltytoorwas
foundguiltyofcertainsexualoffenses,specifiedinthebill,
willberequiredtopay$5,000inrestitutionpayabletothestate
tobedepositedintotheHumanTraffickingandSexualExploitation
Fund.UponreceiptofmoneyfromtheFund,acountymustallocate
disbursementofthefundsaccordingtotherequirementsinthe
bill.
