                    HB1737--IDEOLOGICALDISCRIMINATION

Thisbilldefines"discriminatory ideology"asincludingany
ideologythatpromotesthedifferentialtreatmentofanyindividual
orgroupofindividualsbasedoncharacteristics ofrace,color,
religion,sex,gender,sexuality,ethnicity,nationalorigin,or
ancestry.
Thebillprohibitsanypublicinstitutionofpostsecondary
educationfromrequiringanyapplicant,employee,studentor
contractortoendorsesuchdiscriminatory ideology. Thebillalso
preventsinstitutionsfromrequiringa"diversity,equity,and
inclusionstatement"asdefinedinthebillfromsuchindividuals.
Anyindividualthatisdeterminedtohavebeencompelledtoendorse
adiscriminatory ideologyorsubmitadiversity,equity,and
inclusionstatement,orthatisadverselyaffectedbypreferential
considerations providedtoanyindividualthatendorsessuch
ideologyorsubmitssuchstatement,maypursueanactionfor
injunctiveordeclaratoryreliefagainstsuchinstitution,as
providedinthebill.
Thisbillrequiresacademicinstitutionstodevelopapolicyfor
compliance. Thepolicyshallincludedisciplinarymeasuresforan
employeewhoviolatesthepolicy.BeginningJuly1,2026,
institutionsshallsubmitanannualwrittenreportoncomplianceto
theJointCommitteeonHigherEducation.
