Thisbillamendsthepenaltyfortheoffenseofresistingor
interferingwitharrest,whichiscurrentlyaclassAmisdemeanor
undercertaincircumstancesandaclassEfelonyunderother
circumstances. Thisbillspecifiesthatresistingorinterfering
withorescapingorattemptingtoescapefromastop,detention,or
arrestorfromcustodyaftersuchstop,detention,orarrestisa
classAmisdemeanor,unlessitfallswithinoneoftheexceptions
listedinthebill,inwhichcaseitisaclassEfelony.Ifthe
escapeorattemptedescapeiscommittedbymeansofadeadlyweapon
oradangerousinstrumentorbyholdinganotherpersonhostage,it
isaclassAfelony.
Thebillalsospecifiesthatapersoncommitstheoffenseof
resistingarrestbyfleeinginoronamotorvehicleifheorshe
resistsanarrest,stop,ordetentionbyfleeingfromlaw
enforcementinoronamotorvehicleand,duringthecourseof
fleeing,drivesataspeedorinamannerthatdemonstratesa
disregardforthesafetyofapersonorproperty,includingthatof
thepursuingofficerorotheroccupantsofthefleeingvehicle.
Theoffenseofresistingarrestbyfleeinginoronamotorvehicle
isaclassEfelony.Forasecondorsubsequentconviction,itis
aclassDfelony.
If,duringthecommissionofresistingarrestbyfleeinginorona
motorvehicle,seriousbodilyinjuryordeathtoanotherperson,
includinganyofficer,results,thepersonisguiltyoftheoffense
ofaggravatedresistingarrestbyfleeinginoronamotorvehicle,
whichisaclassDfelony.Forasecondorsubsequentconviction,
itisaclassCfelony.
Aprosecutingattorneyshallnotberequiredtoprovethatthe
defendantknewwhyheorshewasbeingstopped,arrested,or
detained.
Thisbilladdsresistingarrestbyfleeinginoronamotorvehicle
tothelistofoffensesforwhichapersonconvictedofsuch
offenseoroffensesmustserveaminimumprisontermanditadds
resistingorinterferingwithorescapingfromarrest,detention,
orstopandresistingarrestbyfleeinginoronamotorvehicleto
thelistofoffensesthatcannotbeexpunged.
