260.205.1.Itshallbeunlawfulforanypersontooperateasolidwasteprocessing 2facilityorsolidwastedisposalareaofasolidwastemanagementsystemwithoutfirst 3obtaininganoperatingpermitfromthedepartment.Itshallbeunlawfulforanypersonto 4constructasolidwasteprocessingfacilityorsolidwastedisposalareawithoutfirstobtaining 5aconstructionpermitfromthedepartmentpursuanttothissection.Acurrentauthorizationto 6operateissuedbythedepartmentpursuanttosections260.200to260.345shallbeconsidered 7tobeapermittooperateforpurposesofthissectionforallsolidwastedisposalareasand 8processingfacilitiesexistingonAugust28,1995.Apermitshallnotbeissuedforasanitary 9landfilltobelocatedinafloodarea,asdeterminedbythedepartment,wherefloodwatersare 10likelytosignificantlyerodefinalcover.Apermitshallnotberequiredtooperateawaste 11stabilizationlagoon,settlingpondorotherwatertreatmentfacilitywhichhasavalidpermit 12fromtheMissouricleanwatercommissioneventhoughthefacilitymayreceivesolidor 13semisolidwastematerials. 14 2.Nopersonoroperatormayapplyfororobtainapermittoconstructasolidwaste 15disposalareaunlessthepersonhasrequestedthedepartmenttoconductapreliminarysite 16investigationandobtainedpreliminaryapprovalfromthedepartment.Thedepartmentshall, EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17withinsixtydaysofsuchrequest,conductapreliminaryinvestigationandapproveor 18disapprovethesite. 19 3.Allproposedsolidwastedisposalareasforwhichapreliminarysiteinvestigation 20requestpursuanttosubsection2ofthissectionisreceivedbythedepartmentonorafter 21August28,1999,shallbesubjecttoapublicinvolvementactivityaspartofthepermit 22applicationprocess.Theactivityshallconsistofthefollowing: 23 (1)Theapplicantshallnotifythepublicofthepreliminarysiteinvestigationapproval 24withinthirtydaysafterthereceiptofsuchapproval.Suchpublicnotificationshallbeby 25certifiedmailtothegoverningbodyofthecountyorcityinwhichtheproposeddisposalarea 26istobelocatedandbycertifiedmailtothesolidwastemanagementdistrictinwhichthe 27proposeddisposalareaistobelocated; 28 (2)Withinninetydaysafterthepreliminarysiteinvestigationapproval,the 29departmentshallconductapublicawarenesssessioninthecountyinwhichtheproposed 30disposalareaistobelocated.Thedepartmentshallprovidepublicnoticeofsuchsessionby 31bothprintedandbroadcastmediaatleastthirtydayspriortosuchsession.Printed 32notificationshallincludepublicationinatleastonenewspaperhavinggeneralcirculation 33withinthecountyinwhichtheproposeddisposalareaistobelocated.Broadcastnotification 34shallincludepublicserviceannouncementsonradiostationsthathavebroadcastcoverage 35withinthecountyinwhichtheproposeddisposalareaistobelocated.Theintentofsuch 36publicawarenesssessionshallbetoprovidegeneralinformationtointerestedcitizensonthe 37designandoperationofsolidwastedisposalareas; 38 (3)Atleastsixtydayspriortothesubmissiontothedepartmentofareportonthe 39resultsofadetailedsiteinvestigationpursuanttosubsection4ofthissection,theapplicant 40shallconductacommunityinvolvementsessioninthecountyinwhichtheproposeddisposal 41areaistobelocated.Departmentstaffshallattendanysuchsession.Theapplicantshall 42providepublicnoticeofsuchsessionbybothprintedandbroadcastmediaatleastthirtydays 43priortosuchsession.Printednotificationshallincludepublicationinatleastonenewspaper 44havinggeneralcirculationwithinthecountyinwhichtheproposeddisposalareaistobe 45located.Broadcastnotificationshallincludepublicserviceannouncementsonradiostations 46thathavebroadcastcoveragewithinthecountyinwhichtheproposeddisposalareaistobe 47located.Suchpublicnoticesshallincludetheaddressesoftheapplicantandthedepartment 48andinformationonapubliccommentperiod.Suchpubliccommentperiodshallbeginonthe 49dayofthecommunityinvolvementsessionandcontinueforatleastthirtydaysaftersuch 50session.Theapplicantshallrespondtoallpersonssubmittingcommentsduringthepublic 51commentperiodnomorethanthirtydaysafterthereceiptofsuchcomments; HB1751 2 52 (4)Ifaproposedsolidwastedisposalareaistobelocatedinacountyorcitythathas 53localplanningandzoningrequirements,theapplicantshallnotberequiredtoconducta 71siteapprovalfromthedepartment.Thedepartmentshallapproveordisapprovetheplan 72withinthirtydaysofreceipt.Theapplicantshallconducttheinvestigationpursuanttothe 73planandsubmittheresultstothedepartment.Thedepartmentshallprovideapprovalor 74disapprovalwithinsixtydaysofreceiptoftheinvestigationresults. 75 5.(1)Everypersondesiringtoconstructasolidwasteprocessingfacilityorsolid 76wastedisposalareashallmakeapplicationforapermitonformsprovidedforthispurposeby 77thedepartment.Everyapplicantshallsubmitevidenceoffinancialresponsibilitywiththe 78application.Anyapplicantwhoreliesinpartuponaparentcorporationforthisdemonstration 79shallalsosubmitevidenceoffinancialresponsibilityforthatcorporationandanyother 80subsidiarythereof. 81 (2)Everyapplicantshallprovideafinancialassuranceinstrumentorinstrumentsto 82thedepartmentpriortothegrantingofaconstructionpermitforasolidwastedisposalarea. 83Thefinancialassuranceinstrumentorinstrumentsshallbeirrevocable,meetallrequirements 84establishedbythedepartmentandshallnotbecancelled,revoked,disbursed,releasedor 85allowedtoterminatewithouttheapprovalofthedepartment.Afterthecessationofactive 86operationofasanitarylandfill,orothersolidwastedisposalareaasdesignedbythe 87department,neithertheguarantornortheoperatorshallcancel,revokeordisbursethe HB1751 3 88financialassuranceinstrumentorallowtheinstrumenttoterminateuntiltheoperatoris 89releasedfrompostclosuremonitoringandcareresponsibilitiespursuanttosection260.227. 90 (3)Theapplicantforapermittoconstructasolidwastedisposalareashallprovide 91thedepartmentwithplans,specifications,andsuchotherdataasmaybenecessarytocomply 92withthepurposeofsections260.200to260.345.Theapplicationshalldemonstrate 93compliancewithallapplicablelocalplanningandzoningrequirements.Thedepartmentshall 94makeaninvestigationofthesolidwastedisposalareaanddeterminewhetheritcomplieswith 95theprovisionsofsections260.200to260.345andtherulesandregulationsadoptedpursuant 96tosections260.200to260.345.Withintwelveconsecutivemonthsofthereceiptofan 97applicationforaconstructionpermitthedepartmentshallapproveordenytheapplication. 98Thedepartmentshallissuerulesandregulationsestablishingtimelimitsforpermit 99modificationsandrenewalofapermitforasolidwastedisposalarea.Thetimelimitshallbe 100consistentwiththischapter. 101 (4)Theapplicantforapermittoconstructasolidwasteprocessingfacilityshall 102providethedepartmentwithplans,specificationsandsuchotherdataasmaybenecessaryto 103complywiththepurposeofsections260.200to260.345.Withinonehundredeightydaysof 104receiptoftheapplication,thedepartmentshalldeterminewhetheritcomplieswiththe 105provisionsofsections260.200to260.345.Withintwelveconsecutivemonthsofthereceipt 106ofanapplicationforapermittoconstructanincineratorasdescribedinthedefinitionofsolid 107wasteprocessingfacilityinsection260.200oramaterialrecoveryfacilityasdescribedinthe 108definitionofsolidwasteprocessingfacilityinsection260.200,andwithinsixmonthsfor 109permitmodifications,thedepartmentshallapproveordenytheapplication.Permitsissued 110forsolidwastefacilitiesshallbefortheanticipatedlifeofthefacility. 111 (5)Ifthedepartmentfailstoapproveordenyanapplicationforapermitorapermit 112modificationwithinthetimelimitsspecifiedinsubdivisions(3)and(4)ofthissubsection,the 113applicantmaymaintainanactioninthecircuitcourtofColeCountyorthatofthecountyin 114whichthefacilityislocatedoristobesited.Thecourtshallorderthedepartmenttoshow 115causewhyithasnotactedonthepermitandthecourtmay,uponthepresentationofevidence 116satisfactorytothecourt,orderthedepartmenttoissueordenysuchpermitorpermit 117modification.Permitsforsolidwastedisposalareas,whetherissuedbythedepartmentor 118orderedtobeissuedbyacourt,shallbefortheanticipatedlifeofthefacility. 119 (6)Theapplicantforapermittoconstructasolidwasteprocessingfacilityshallpay 120anapplicationfeeofonethousanddollars.Uponcompletionofthedepartment'sevaluation 121oftheapplication,butbeforereceivingapermit,theapplicantshallreimbursethedepartment 122forallreasonablecostsincurredbythedepartmentuptoamaximumoffourthousanddollars. 123Theapplicantforapermittoconstructasolidwastedisposalareashallpayanapplicationfee 124oftwothousanddollars.Uponcompletionofthedepartment'sevaluationsoftheapplication, HB1751 4 125butbeforereceivingapermit,theapplicantshallreimbursethedepartmentforallreasonable 126costsincurredbythedepartmentuptoamaximumofeightthousanddollars.Applicantswho 127withdrawtheirapplicationbeforethedepartmentcompletesitsevaluationshallberequiredto 128reimbursethedepartmentforcostsincurredintheevaluation.Thedepartmentshallnot 129collectthefeesauthorizedinthissubdivisionunlessitcomplieswiththetimelimits 130establishedinthissection. 131 (7)Whenthereviewrevealsthatthefacilityorareadoesconformwiththeprovisions 132ofsections260.200to260.345andtherulesandregulationsadoptedpursuanttosections 133260.200to260.345,thedepartmentshallapprovetheapplicationandshallissueapermitfor 134theconstructionofeachsolidwasteprocessingfacilityorsolidwastedisposalareaasset 135forthintheapplicationandwithanypermittermsandconditionswhichthedepartmentdeems 136appropriate.Intheeventthatthefacilityorareafailstomeettherulesandregulations 137adoptedpursuanttosections260.200to260.345,thedepartmentshallissueareporttothe 138applicantstatingthereasonfordenialofapermit. 139 6.Plans,designs,andrelevantdatafortheconstructionofsolidwasteprocessing 140facilitiesandsolidwastedisposalareasshallbesubmittedtothedepartmentbyaregistered 141professionalengineerlicensedbythestateofMissouriforapprovalpriortotheconstruction, 142alterationoroperationofsuchafacilityorarea. 143 7.Anypersonoroperatorasdefinedinsection260.200whointendstoobtaina 144constructionpermitinasolidwastemanagementdistrictwithanapprovedsolidwaste 145managementplanshallrequestarecommendationinsupportoftheapplicationfromthe 146executiveboardcreatedinsection260.315.Theexecutiveboardshallconsidertheimpactof 147theproposalon,andtheextenttowhichtheproposalconformsto,theapproveddistrictsolid 148wastemanagementplanpreparedpursuanttosection260.325.Theexecutiveboardshallact 149upontherequestforarecommendationwithinsixtydaysofreceiptandshallsubmita 150resolutiontothedepartmentspecifyingitspositionanditsrecommendationregarding 151conformityoftheapplicationtothesolidwasteplan.Theboard'sfailuretosubmita 152resolutionconstitutesrecommendationoftheapplication.Thedepartmentmayconsiderthe 153application,regardlessoftheboard'sactionthereonandmaydenytheconstructionpermitif 154theapplicationfailstomeettherequirementsofsections260.200to260.345,orifthe 155applicationisinconsistentwiththedistrict'ssolidwastemanagementplan. 156 8.Ifthesiteproposedforasolidwastedisposalareaisnotownedbytheapplicant, 157theownerorownersofthesiteshallacknowledgethatanapplicationpursuanttosections 158260.200to260.345istobesubmittedbysignatureorsignaturesthereon.Thedepartment 159shallprovidetheownerwithcopiesofallcommunicationwiththeoperator,including 160inspectionreportsandordersissuedpursuanttosection260.230. HB1751 5 161 9.Thedepartmentshallnotissueapermitfortheoperationofasolidwastedisposal 162areadesignedtoserveacitywithapopulationofgreaterthanfourhundredthousandlocated 163inmorethanonecounty,ifthesiteislocatedwithin[one-half] onemileofanadjoining 164municipality,withouttheapprovalofthegoverningbodyofsuchmunicipality.The 165governingbodyshallconductapublichearingwithinfifteendaysofnotice,shallpublicize 166thehearinginatleastonenewspaperhavinggeneralcirculationinthemunicipality,andshall 167votetoapproveordisapprovethelanddisposalfacilitywithinthirtydaysafterthecloseofthe 168hearing. 169 10.(1)Uponreceiptofanapplicationforapermittoconstructasolidwaste 170processingfacilityordisposalarea,thedepartmentshallnotifythepublicofsuchreceipt: 171 (a)Bylegalnoticepublishedinanewspaperofgeneralcirculationintheareaofthe 172proposeddisposalareaorprocessingfacility; 173 (b)Bycertifiedmailtothegoverningbodyofthecountyorcityinwhichthe 174proposeddisposalareaorprocessingfacilityistobelocated;and 175 (c)Bymailtothelastknownaddressofallrecordownersofcontiguousrealproperty 176orrealpropertylocatedwithinonethousandfeetoftheproposeddisposalareaand,fora 177proposedprocessingfacility,noticeasprovidedinsection64.875orsection89.060, 178whicheverisapplicable. 179 (2)Ifanapplicationforaconstructionpermitmeetsallstatutoryandregulatory 180requirementsforissuance,apublichearingonthedraftpermitshallbeheldbythedepartment 181inthecountyinwhichtheproposedsolidwastedisposalareaistobelocatedpriortothe 182issuanceofthepermit.Thedepartmentshallprovidepublicnoticeofsuchhearingbyboth 183printedandbroadcastmediaatleastthirtydayspriortosuchhearing.Printednotification 184shallincludepublicationinatleastonenewspaperhavinggeneralcirculationwithinthe 185countyinwhichtheproposeddisposalareaistobelocated.Broadcastnotificationshall 186includepublicserviceannouncementsonradiostationsthathavebroadcastcoveragewithin 187thecountyinwhichtheproposeddisposalareaistobelocated. 188 11.Aftertheissuanceofaconstructionpermitforasolidwastedisposalarea,but 189priortothebeginningofdisposaloperations,theownerandthedepartmentshallexecutean 190easementtoallowthedepartment,itsagentsoritscontractorstoenterthepremisesto 191completeworkspecifiedintheclosureplan,ortomonitorormaintainthesiteortotake 192remedialactionduringthepostclosureperiod.Afterissuanceofaconstructionpermitfora 193solidwastedisposalarea,butpriortothebeginningofdisposaloperations,theownershall 194submitevidencethatsuchownerhasrecorded,intheofficeoftherecorderofdeedsinthe 195countywherethedisposalareaislocated,anoticeandcovenantrunningwiththelandthatthe 196propertyhasbeenpermittedasasolidwastedisposalareaandprohibitsuseofthelandinany HB1751 6 197mannerwhichinterfereswiththeclosureand,whereappropriate,postclosureplansfiledwith 198thedepartment. 199 12.Everypersondesiringtoobtainapermittooperateasolidwastedisposalareaor 200processingfacilityshallsubmitapplicableinformationandapplyforanoperatingpermitfrom 201thedepartment.Thedepartmentshallreviewtheinformationanddetermine,withinsixty 202daysofreceipt,whetheritcomplieswiththeprovisionsofsections260.200to260.345and 203therulesandregulationsadoptedpursuanttosections260.200to260.345.Whenthereview 204revealsthatthefacilityorareadoesconformwiththeprovisionsofsections260.200to 205260.345andtherulesandregulationsadoptedpursuanttosections260.200to260.345,the 206departmentshallissueapermitfortheoperationofeachsolidwasteprocessingfacilityor 207solidwastedisposalareaandwithanypermittermsandconditionswhichthedepartment 208deemsappropriate.Intheeventthatthefacilityorareafailstomeettherulesandregulations 209adoptedpursuanttosections260.200to260.345,thedepartmentshallissueareporttothe 210applicantstatingthereasonfordenialofapermit. 211 13.Eachsolidwastedisposalarea,exceptutilitywastelandfillsunlessotherwiseand 212totheextentrequiredbythedepartment,andthosesolidwasteprocessingfacilities 213designatedbyrule,shallbeoperatedunderthedirectionofacertifiedsolidwastetechnician 214inaccordancewithsections260.200to260.345andtherulesandregulationspromulgated 215pursuanttosections260.200to260.345. 216 14.Basedataforthequalityandquantityofgroundwaterinthesolidwastedisposal 217areashallbecollectedandsubmittedtothedepartmentpriortotheoperationofanewor 218expansionofanexistingsolidwastedisposalarea.Basedatashallincludeachemical 219analysisofgroundwaterdrawnfromtheproposedsolidwastedisposalarea. 220 15.Leachatecollectionandremovalsystemsshallbeincorporatedintonewor 221expandedsanitarylandfillswhicharepermittedafterAugust13,1986.Thedepartmentshall 222assesstheneedforaleachatecollectionsystemforalltypesofsolidwastedisposalareas, 223otherthansanitarylandfills,andtheneedformonitoringwellswhenitevaluatesthe 224applicationforallneworexpandedsolidwastedisposalareas.Thedepartmentmayrequire 225anoperatorofasolidwastedisposalareatoinstallaleachatecollectionsystembeforethe 226beginningofdisposaloperations,atanytimeduringdisposaloperationsforunfilledportions 227ofthearea,orforanyportionofthedisposalareaasapartofaremedialplan.The 228departmentmayrequiretheoperatortoinstallmonitoringwellsbeforethebeginningof 229disposaloperationsoratanytimeduringtheoperationallifeorpostclosurecareperiodifit 230concludesthatconditionsattheareawarrantsuchmonitoring.Theoperatorofademolition 231landfillorutilitywastelandfillshallnotberequiredtoinstallaleachatecollectionand 232removalsystemormonitoringwellsunlessotherwiseandtotheextentthedepartmentso HB1751 7 233requiresbasedonhazardouswastecharacteristiccriteriaorsitespecificgeohydrological 234characteristicsorconditions. 235 16.Permitsgrantedbythedepartment,asprovidedinsections260.200to260.345, 236shallbesubjecttosuspensionforadesignatedperiodoftime,civilpenaltyorrevocation 237wheneverthedepartmentdeterminesthatthesolidwasteprocessingfacilityorsolidwaste 238disposalareais,orhasbeen,operatedinviolationofsections260.200to260.345ortherules 239orregulationsadoptedpursuanttosections260.200to260.345,orhasbeenoperatedin 240violationofanypermittermsandconditions,oriscreatingapublicnuisance,healthhazard, 241orenvironmentalpollution.Intheeventapermitissuspendedorrevoked,thepersonnamed 242inthepermitshallbefullyinformedastothereasonsforsuchaction. 243 17.Eachpermitforoperationofafacilityorareashallbeissuedonlytotheperson 244namedintheapplication.Permitsaretransferableasamodificationtothepermit.An 245applicationtotransferownershipshallidentifytheproposedpermittee.Adisclosure 246statementfortheproposedpermitteelistingviolationscontainedinthedefinitionof 247disclosurestatementfoundinsection260.200shallbesubmittedtothedepartment.The 248operationanddesignplansforthefacilityorareashallbeupdatedtoprovidecompliancewith 249thecurrentlyapplicablelawandrules.Afinancialassuranceinstrumentinsuchanamount 250andformasprescribedbythedepartmentshallbeprovidedforsolidwastedisposalareasby 251theproposedpermitteepriortotransferofthepermit.Thefinancialassuranceinstrumentof 252theoriginalpermitteeshallnotbereleaseduntilthenewpermittee'sfinancialassurance 253instrumenthasbeenapprovedbythedepartmentandthetransferofownershipiscomplete. 254 18.ThosesolidwastedisposalareaspermittedonJanuary1,1996,shall,upon 255submissionofarequestforpermitmodification,begrantedasolidwastemanagementarea 256operatingpermitiftherequestmeetsreasonablerequirementssetoutbythedepartment. 257 19.Incaseapermitrequiredpursuanttothissectionisdeniedorrevoked,theperson 258mayrequestahearinginaccordancewithsection260.235. 259 20.Everyapplicantforapermitshallfileadisclosurestatementwiththeinformation 260requiredbyandonaformdevelopedbythedepartmentofnaturalresourcesatthesametime 261theapplicationforapermitisfiledwiththedepartment. 262 21.Uponrequestofthedirectorofthedepartmentofnaturalresources,theapplicant 263forapermit,anypersonthatcouldreasonablybeexpectedtobeinvolvedinmanagement 264activitiesofthesolidwastedisposalareaorsolidwasteprocessingfacility,oranypersonwho 265hasacontrollinginterestinanypermitteeshallberequiredtosubmittoacriminal 266backgroundcheckundersection43.543. 267 22.Allpersonsrequiredtofileadisclosurestatementshallprovideanyassistanceor 268informationrequestedbythedirectororbytheMissouristatehighwaypatrolandshall 269cooperateinanyinquiryorinvestigationconductedbythedepartmentandanyinquiry, HB1751 8 270investigationorhearingconductedbythedirector.If,uponissuanceofaformalrequestto 271answeranyinquiryorproduceinformation,evidenceortestimony,anypersonrequiredtofile 272adisclosurestatementrefusestocomply,theapplicationofanapplicantorthepermitofa 273permitteemaybedeniedorrevokedbythedirector. 274 23.Ifanyoftheinformationrequiredtobeincludedinthedisclosurestatement 275changes,orifanyadditionalinformationshouldbeaddedafterthefilingofthestatement,the 276personrequiredtofileitshallprovidethatinformationtothedirectorinwriting,withinthirty 277daysafterthechangeoraddition.Thefailuretoprovidesuchinformationwithinthirtydays 278mayconstitutethebasisfortherevocationofordenialofanapplicationforanypermitissued 279orappliedforinaccordancewiththissection,butonlyif,priortoanysuchdenialor 280revocation,thedirectornotifiestheapplicantorpermitteeofthedirector'sintentiontodoso 281andgivestheapplicantorpermitteefourteendaysfromthedateofthenoticetoexplainwhy 282theinformationwasnotprovidedwithintherequiredthirty-dayperiod.Thedirectorshall 26.Anycounty,district,municipality,authority,orotherpoliticalsubdivisionofthis 303statewhichownsandoperatesasanitarylandfillshallbeexemptfromtherequirementforthe 304filingofthedisclosurestatementandannualupdatetothedisclosurestatement. 305 27.Anypersonseekingapermittooperateasolidwastedisposalarea,asolidwaste 306processingfacility,oraresourcerecoveryfacilityshall,concurrentlywiththefilingofthe HB1751 9 307applicationforapermit,discloseanyconvictionsinthisstate,countyorcounty-equivalent 308publichealthorlanduseordinancesrelatedtothemanagementofsolidwaste.Ifthe 309departmentfindsthattherehasbeenacontinuingpatternofadjudicatedviolationsbythe 310applicant,thedepartmentmaydenytheapplication. 311 28.Nopermittoconstructorpermittooperateshallberequiredpursuanttothis 312sectionforanyutilitywastelandfilllocatedinacountyofthethirdclassificationwitha 313townshipformofgovernmentwhichhasapopulationofatleasteleventhousandinhabitants 314andnomorethantwelvethousandfivehundredinhabitantsaccordingtothemostrecent 315decennialcensus,ifsuchutilitywastelandfillcomplieswithalldesignandoperating 316standardsandclosurerequirementsapplicabletoutilitywastelandfillspursuanttosections 317260.200to260.345andprovidedthatnowastedisposedofatsuchutilitywastelandfillis 318consideredhazardouswastepursuanttotheMissourihazardouswastelaw. 319 29.Advancedrecyclingfacilitiesarenotsubjecttotherequirementsofthissectionas
