Thisbillempowersacourtafterissuinganorderofprotectionto
alsoprohibittherespondentfromknowinglypossessingor
purchasingafirearmwhiletheorderisineffect,informingthe
respondentinwriting,andforwardingtheordertotheState
HighwayPatrolsotheymayupdatetherespondent'srecordinthe
NationalInstantCriminalBackgroundCheckSystem(NICS).The
StateHighwayPatrolmustalsonotifytheFBIwithin24hours.
Thebillalsoprovidesthatuponaperson'sconvictionofdomestic
assaultinthefourthdegreeorstalkingintheseconddegree,the
courtshallforwardtherecordofconvictiontotheStateHighway
Patrolandtheyshallupdatetherespondent'srecordinNICSwithin
24hours.
Thebillalsoprovidesthatapersoncommitstheoffenseof
unlawfulpossessionofafirearmifsuchpersonknowinglyhasa
firearmintheirpossessionandhasbeenconvictedofdomestic
violenceorissubjecttoanorderofprotection.
Thebilldefines"Family","Householdmember",and"Misdemeanor
offenseofdomesticviolence"asthesetermspertaintotheact.
Thebillhasanemergencyclause.
