36accordancewithsection287.230.Therighttounaccruedcompensationforpermanenttotal 37disabilityofaninjuredemployeeterminatesonthedateoftheinjuredemployee'sdeathin 38accordancewithsection287.230,anddoesnotsurvivetotheinjuredemployee'sdependents, 39estate,orotherpersonstowhomcompensationmightotherwisebepayable. 40 3.(1)Allclaimsforpermanenttotaldisabilityshallbedeterminedinaccordance 41withthefacts.[Whenaninjuredemployeereceivesanawardforpermanenttotaldisability 42butbytheuseofglasses,prostheticappliances,orphysicalrehabilitationtheemployeeis 43restoredtohisorherregularworkoritsequivalent,thelifepaymentmentionedinsubsection 49butbytheuseofglasses,prostheticappliances,orphysicalrehabilitationtheemployee 50isrestoredtohisorherregularworkoritsequivalent,thelifepaymentmentionedin 51subsection1ofthissectionshallbesuspendedduringthetimeinwhichtheemployeeis 52restoredtohisorherregularworkoritsequivalent.Inanycasewherethelifepaymentis 53suspendedunderthis[subsection] subdivision, thecommissionmayatreasonabletimes 54reviewthecaseandeithertheemployeeortheemployermayrequestaninformalconference 55withthecommissionrelativetotheresumptionoftheemployee'sweeklylifepaymentinthe 56case. 57 (3)Uponfilingofawrittenagreementsignedbytheclaimantandhisorher 58attorney,thecommissionshallchangethename,information,orfeearrangementofthe 59attorneyorlawfirmassociatedwiththeclaimant’scase. 60 4.ForallclaimsfiledonorafterJanuary1,2014,foroccupationaldiseasesdueto 61toxicexposurewhichresultinapermanenttotaldisabilityordeath,benefitsinthischapter 62shallbeprovidedasfollows: 63 (1)Notwithstandinganyprovisionoflawtothecontrary,suchamountasduetothe 64employeeduringsaidemployee'slifeasprovidedforunderthischapterforanawardof 65permanenttotaldisabilityanddeath,exceptsuchamountshallonlybepaidwhenbenefits 66undersubdivisions(2)and(3)ofthissubsectionhavebeenexhausted; 67 (2)Foroccupationaldiseasesduetotoxicexposure,butnotincludingmesothelioma, 68anamountequaltotwohundredpercentofthestate'saverageweeklywageasofthedateof 69diagnosisforonehundredweekspaidbytheemployer;and HCSHB2064 5 70 (3)Incaseswhereoccupationaldiseasesduetotoxicexposurearediagnosedtobe 71mesothelioma: 72 (a)Foremployersthathaveelectedtoacceptmesotheliomaliabilityunderthis 73subsection,anadditionalamountofthreehundredpercentofthestate'saverageweeklywage 74fortwohundredtwelveweeksshallbepaidbytheemployerorgroupofemployerssuch 75employerisamemberof.Employersthatelecttoacceptmesotheliomaliabilityunderthis 76subsectionmaydosobyeitherinsuringtheirliability,byqualifyingasaself-insurer,orby 77becomingamemberofagroupinsurancepool.Agroupofemployersmayenterintoan 78agreementtopooltheirliabilitiesunderthissubsection.Ifsuchgroupisjoined,individual 79membersshallnotberequiredtoqualifyasindividualself-insurers.Suchgroupshallcomply 80withsection287.223.Inorderforanemployertomakesuchanelection,theemployershall 81providethedepartmentwithnoticeofsuchanelectioninamannerestablishedbythe 82department.TheprovisionsofthisparagraphshallexpireonDecember31,2038;or 83 (b)Foremployerswhorejectmesotheliomaunderthissubsection,thentheexclusive 84remedyprovisionsundersection287.120shallnotapplytosuchliability.Theprovisionsof 85thisparagraphshallexpireonDecember31,2038;and 86 (4)Theprovisionsofsubdivision(2)andparagraph(a)ofsubdivision(3)ofthis 87subsectionshallnotbesubjecttosuspensionofbenefitsasprovidedinsubsection3ofthis 88section;and 89 (5)Notwithstandinganyotherprovisionofthischaptertothecontrary,shouldthe 90employeediebeforetheadditionalbenefitsprovidedforinsubdivision(2)andparagraph(a) 91ofsubdivision(3)ofthissubsectionarepaid,theadditionalbenefitsarepayabletothe 92employee'sspouseorchildren,naturaloradopted,legitimateorillegitimate,inadditionto 100 5.Anyemployeewhoobtainsbenefitsundersubdivision(2)ofsubsection4ofthis 101sectionforacquiringasbestosiswholaterobtainsanawardformesotheliomashallnotreceive 102morebenefitsthansuchemployeewouldreceivehavingonlyobtainedbenefitsfor 103mesotheliomaunderthissection. 287.470.1.Uponitsownmotionorupontheapplicationofanypartyinintereston 2thegroundofachangeincondition,thecommissionmayatanytimeuponarehearingafter 3duenoticetothepartiesinterestedreviewanyawardandonsuchreviewmaymakeanaward HCSHB2064 6 4ending,diminishingorincreasingthecompensationpreviouslyawarded,subjecttothe 5maximumorminimumprovidedinthischapter,andshallimmediatelysendtothepartiesand 4.Thecommitteeshallwithinthirtydaysofcompletingeachperformanceauditmake 23arecommendationofconfidenceornoconfidenceforeachadministrativelawjudge. 24 5.]Theadministrativelawjudgesappointedbythedivisionshallonlyhave 25jurisdictiontohearanddetermineclaimsuponoriginalhearingandshallhavenojurisdiction 57judgeshallbesenttothegovernornolaterthanthefirstweekofeachlegislativesession 58immediatelyfollowingsuchaudit.Anyadministrativelawjudgewhohasreceivedthreeor 59morevotesofnoconfidenceundertwosuccessiveperformanceauditsbythecommitteemay 60havetheirappointmentimmediatelywithdrawn. 61 (2)Thereviewcommitteeshallconsistofonememberappointedbythepresidentpro 25 (2)Thealternativedisputeresolutioncommunicationisasubstantialthreator 26statementofaplantoinflictbodilyinjurycapableofcausingdeathorsubstantialbodily 27harmthatisreasonablycertaintooccur; 28 (3)Thealternativedisputeresolutioncommunicationisintentionallyusedto 29planacrime,attempttocommitanoffense,ortoconcealanongoingcrimeorongoing 30criminalactivity;or 31 (4)Thealternativedisputeresolutioncommunicationisnecessarytoestablishor 32defendagainstaclaimofprofessionalmisconductormalpracticethatisfiledagainstor 33onbehalfofaparticipantbasedonconductoccurringduringthealternativedispute 34resolutionprocess. 35 4.Theadmissionofevidenceinaproceedingunderanyoftheexceptionsstated 36undersubsection3ofthissectionshallnotinitselfrendertheevidenceoranyother 37alternativedisputeresolutioncommunicationdiscoverableoradmissibleforanyother 38purposeorproceeding. 39 5.Anyparticipantinanalternativedisputeresolutionprocesshasstandingto 40interveneinanyproceedingtoobjecttotheadmissibilityofanalternativedispute 41resolutioncommunicationmadebythatparticipantduringorrelatingtothat 42alternativedisputeresolutionprocess.Aneutralwhoparticipatedinanalternative 43disputeresolutionprocessalsohasstandingtointerveneinanyproceedingtoobjectto 44theadmissibilityofanalternativedisputeresolutioncommunicationmadebythe HCSHB2064 20 45neutraloranagentoremployeeofaneutralorofanorganizationthroughwhichthe 46neutralprovidedthealternativedisputeresolutionservicesforsuchprocess,butthe 47neutralisundernorequirementtodoso. 48 6.Exceptasprovidedundersubsection7ofthissection,noneutral,agentor 49employeeofthatneutral,oragentoremployeeofanorganizationthroughwhichthe 50neutralprovidedalternativedisputeresolutionservicesshallbesubpoenaedor 51otherwisecompelledtodiscloseanyalternativedisputeresolutioncommunication, 52includinganyalternativedisputeresolutioncommunicationthatwouldotherwisefall 53withintheexceptionsidentifiedundersubsection3ofthissection.Noneutralwhoisa 54licensedattorney,oranagentoremployeeofsuchneutralorofanorganizationthrough 55whichtheneutralprovidedalternativedisputeresolutionservicesundersections 56435.300to435.312,shallberequiredtodiscloseanyalternativedisputeresolution 57communicationtowhichareportingobligationmightotherwiseapplyundertherules 58regulatingtheprofessionalconductofattorneys. 59 7.Aneutral,anagentoremployeeofthatneutral,oranagentoremployeeofan 60organizationthroughwhichtheneutralprovidedthealternativedisputeresolution 61servicesmaybesubpoenaedinanactiontoenforceawrittenagreementasdescribed 62undersubsection2ofsection435.309,butonlyforthelimitedpurposeoftestifyingthat 63thewrittenagreementwassignedbythepartiesinthepresenceoftheneutral. 64 8.Thecourtmayrequestthattheneutralorthepartiesprovidethecourtwith 65progressreportsonalternativedisputeresolutionprocessesrelatedtopendingcivil 66actions;providedthat,suchreportsshallbelimitedtoastatementthatthematterhas 67beenresolvedinitsentirety,partiallyresolved,ornotresolvedandwhetherfuturedates 68foranalternativedisputeresolutionprocessarescheduled.Aneutralmayalsoreportto 69thecourtthatapaymenthasnotbeenreceivedfromoneormoreparties.Acourtshall 70notrequirethedisclosureofalternativedisputeresolutioncommunicationinanysuch 71report. 72 9.Thecourtmayorderthepartyorpartiesseekingadmissionofanalternative 73disputeresolutioncommunicationtopaythecostsandfeesoftheneutralorother 74personparticipatinginanalternativedisputeresolutionprocesswhointervenesto 75contestthedisclosureandadmissionofalternativedisputeresolutioncommunicationor 76whorespondstoasubpoenaprohibitedundersubsection6ofthissectionorasubpoena 77undersubsection7ofthissection. 435.309.1.Unlessthepartieshaveenteredintoawrittenagreementproviding 2forentryintoabindingalternativedisputeresolutionprocess,allalternativedispute 3resolutionprocessesundersections435.300to435.312shallbenonbinding. 16 (2)Thefinancialneedsandresourcesofthesurvivingparentorguardianor 17othercurrentguardianofthechild,includingthestateifthestateistheguardian; 18 (3)Thestandardoflivingtowhichthechildisaccustomed; 19 (4)Thephysicalandemotionalconditionofthechildandthechild'seducational 20needs; Thetreatmentcourtdivisionmayinclude,butnotbelimitedto, 58casesassignedtoanadulttreatmentcourt,DWIcourt,familytreatmentcourt,juvenile 59treatmentcourt,mentalhealthcourt,veteranstreatmentcourt,oranycombinationthereof. 60Atreatmentcourtshallcombinejudicialsupervision,drugoralcoholtesting,andtreatmentof 61participants.Exceptforgoodcausefoundbythecourt,atreatmentcourtmakingareferralfor 62substanceuseormentalhealthdisordertreatment,whensuchprogramwillreceivestateor 63federalfundsinconnectionwithsuchreferral,shallreferthepersononlytoaprogramwhich 64iscertifiedbythedepartmentofmentalhealth,unlessnoappropriatecertifiedtreatment 65programislocatedwithinthesamecountyasthetreatmentcourt.Uponsuccessful 66completionofthetreatmentcourtprogram,thecharges,petition,orpenaltyagainsta 67treatmentcourtparticipantmaybedismissed,reduced,ormodified,unlessotherwisestated. 68Anyfeesreceivedbyacourtfromadefendantaspaymentforsubstanceormentalhealth 69treatmentprogramsshallnotbeconsideredcourtcosts,chargesorfines. 70 3.Anadulttreatmentcourtmaybeestablishedbyanycircuitcourt[undersections 71478.001to478.009] toprovideanalternativeforthejudicialsystemtodisposeofcaseswhich 72stemfromsubstanceuse. HCSHB2064 35 73 4.[Undersections478.001to478.009,] ADWIcourtmaybeestablishedbyany 74circuitcourttoprovideanalternativeforthejudicialsystemtodisposeofcasesthatstem 75fromdrivingwhileintoxicated. 76 5.Afamilytreatmentcourtmaybeestablishedbyanycircuitcourt.Thejuvenile 77divisionofthecircuitcourtorthefamilycourt,ifoneisestablishedundersection487.010, 78mayreferoneormoreparentsorotherhouseholdmemberssubjecttoitsjurisdictiontothe 79familytreatmentcourtifheorshehasbeendeterminedtohaveasubstanceusedisorderor 80co-occurringdisorderthatimpactsthesafetyandwell-beingofthechildreninthefamily. 81 6.Ajuveniletreatmentcourtmaybeestablishedbythejuveniledivisionofany 82circuitcourt.Thejuveniledivisionmayreferajuveniletothejuveniletreatmentcourtifthe 83juvenileisdeterminedtohavecommittedactsthatviolatethecriminallawsofthestateor 84ordinancesofamunicipalityorcountyandasubstanceusedisorderorco-occurringdisorder 85contributedtothecommissionoftheoffense. 86 7.Thegeneralassemblyfindsanddeclaresthatitisthepublicpolicyofthisstateto 87encourageandprovideanalternativemethodforthedisposalofcasesformilitaryveterans 88andcurrentmilitarypersonnelwithsubstanceusedisorders,mentalhealthdisorders,orco- 89occurringdisorders.Inordertoeffectuatethispublicpolicy,aveteranstreatmentcourtmay 90beestablishedbyanycircuitcourt,orcombinationofcircuitcourtsuponagreementofthe 91presidingjudgesofsuchcircuitcourts,toprovideanalternativeforthejudicialsystemto 92disposeofcasesthatstemfromasubstanceusedisorder,mentalhealthdisorder,orco- 93occurringdisorderofmilitaryveteransorcurrentmilitarypersonnel.Aveteranstreatment 94courtshallcombinejudicialsupervision,drugoralcoholtesting,andsubstanceuseand 95mentalhealthdisordertreatmenttoparticipantswhohaveservedorarecurrentlyservingthe 96UnitedStatesArmedForces,includingmembersoftheReservesorNationalGuard,with 97preferencegiventoindividualswhohavecombatservice.Forthepurposesofthissection, 98combatserviceshallbeshownthroughmilitaryservicedocumentationthatreflectsservicein 99acombattheater,receiptofcombatservicemedals,orreceiptofimminentdangerorhostile 100firepayortaxbenefits.Exceptforgoodcausefoundbythecourt,aveteranstreatmentcourt 101shallmakeareferralforsubstanceuseormentalhealthdisordertreatment,oracombination 102ofsubstanceuseandmentalhealthdisordertreatment,throughtheDepartmentofDefense 103healthcare,theVeteransAdministration,oracommunity-basedsubstanceusedisorder 104treatmentprogram.Community-basedprogramsutilizedshallreceivestateorfederalfunds 105inconnectionwithsuchreferralandshallonlyrefertheindividualtoaprogramcertifiedby 106thedepartmentofmentalhealth,unlessnoappropriatecertifiedtreatmentprogramislocated 107withinthesamecircuitastheveteranstreatmentcourt. HCSHB2064 36 108 8.Amentalhealthcourtmaybeestablishedbyanycircuitcourttoprovidean 109alternativeforthejudicialsystemtodisposeofcasesthatstemfromamentalhealth 110disorderorco-occurringdisorder. 488.040.[1.]Eachgrandandpetitjurorshall[, pursuanttotheprovisionsofsection 2494.455,receivesixdollarsperdayforeverydayheorshemayactuallyserveassuchand 3sevencentsforeverymileheorshemaynecessarilytravelgoingfromhisorherplaceof 4residencetothecourthouseandreturning,tobepaidfromfundsofthecountyoracitynot 5withinacounty. 6 2.Providedthatacountyoracitynotwithinacountyauthorizesdailycompensation 7payablefromcountyorcityfundsforjurorswhoserveinthatcountypursuanttosubsection3 8ofthissectionintheamountofatleastsixdollarsperdayinadditiontotheamountrequired 9bysubsection1ofthissection,apersonshallreceiveanadditionalsixdollarsperday, 10pursuanttotheprovisionsofsection494.455,tobereimbursedbythestateofMissouriso 11thatthetotalcompensationpayableshallbeatleasteighteendollars,plusmileageas 12indicatedinsubsection1ofthissection,foreachdaythatthepersonactuallyservesasapetit 13jurorinaparticularcase;orforeachdaythatapersonactuallyservesasagrandjurorduring 14atermofagrandjury.Thestateshallreimbursethecountyforsixdollarsoftheadditional 15jurorcompensationprovidedbythissubsection. 16 3.Thegoverningbodyofeachcountyoracitynotwithinacountymayauthorize 17additionaldailycompensationandmileageallowanceforjurors,whichadditional 18compensationshallbepaidfromthefundsofthecountyoracitynotwithinacounty. 19Thegoverningbodyofeachcountyoracitynotwithinacountymayauthorizeadditional 20dailycompensationandmileageallowanceforjurorsattendingacoroner'sinquest.Jurors 21mayreceivetheadditionalcompensationandmileageallowanceauthorizedbythissubsection 22onlyifthegoverningbodyofthecountyorthecitynotwithinacountyauthorizesthe 23additionalcompensation.Theprovisionsofthissubsectionauthorizingadditional 24compensationshallterminateupontheissuanceofamandatebytheMissourisupreme 25courtwhichresultsinthestateofMissouribeingobligatedorrequiredtopayanysuch 26additionalcompensationevenifsuchadditionalcompensationisformallyapprovedor 27authorizedbythegoverningbodyofacountyoracitynotwithinacounty. 28 4.Wheneachpanelofjurorssummonedandattendingcourthascompletedits 29service,theboardofjurycommissionersshallcausetobesubmittedtothegoverningbodyof 30thecountyoracitynotwithinacountyastatementoffeesearnedbyeachjuror.Withinthirty 31daysofthesubmissionofthestatementoffees,thegoverningbodyshallcausepaymenttobe 32madetothosejurorssummonedthefeesearnedduringtheirserviceasjurors] receivedaily 33compensationandmileageallowanceintheamountprovidedbylawpursuanttosection 34494.455. HCSHB2064 37 488.2300.1.A"FamilyServicesandJusticeFund"isherebyestablishedineach 2countyorcircuitwithafamilycourt,forthepurposeofaidingwiththeoperationofthe 3familycourtdivisionsandservicesprovidedbythosedivisions.Incircuitsorcountieshaving 4afamilycourt,thecircuitclerkshallchargeandcollectasurchargeofthirtydollarsinall 5proceedingsfallingwithinthejurisdictionofthefamilycourt.Thesurchargeshallnotbe 6chargedwhennocourtcostsareotherwiserequired,shallnotbechargedagainstthepetitioner 7foractionsfiledpursuanttotheprovisionsofchapter455,butmaybechargedtothe 8respondentinsuchactions,shallnotbechargedtoagovernmentagencyandshallnotbe 9chargedinanyproceedingwhencostsarewaivedoraretobepaidbythestate,countyor 10municipality. 11 2.Injuvenileproceedingsunderchapter211,ajudgmentofuptothirtydollarsmay 12beassessedagainstthechild,parentorcustodianofthechild,inadditiontootheramounts 13authorizedbylaw,ininformaladjustmentsmadeundertheprovisionsofsections211.081and 14211.083,andinanorderofdispositionortreatmentundertheprovisionsofsection211.181. 15Thejudgmentmaybeorderedpaidtotheclerkofthecircuitwheretheassessmentis 16imposed. 17 3.Allsumscollectedpursuanttothissectionandsection487.140shallbepayableto 18thevariouscountyfamilyservicesandjusticefunds. 19 4.Nothinginthissectionprohibitsthegeneralassemblyfromappropriating 20moneysintothevariouscountyfamilyservicesandjusticefundstobeexpendedforthe 21purposesprovidedforinthissection. 22 5.Anymoneysinthefamilyservicesandjusticefundnotexpendedforsalariesof 23commissioners,familycourtadministratorsandfamilycourtstaffshallbeusedtoward 24fundingtheenhancedservicesprovidedasaresultoftheestablishmentofafamilycourt; 25however,itshallnotreplaceorreducethecurrentandongoingresponsibilitiesofthecounties 26toprovidefundingforthecourtsasrequiredbylaw.Moneyscollectedforthefamilyservices 27andjusticefundshallbeexpendedforthebenefitoflitigantsandrecipientsofservicesinthe 28familycourt,withprioritygiventofeesincurredundersubsection5or7ofsection475.075 29orexpensesincurredundersection475.063,andtoservicessuchasguardiansadlitem, 30mediation,counseling,homestudies,psychologicalevaluationandotherformsofalternative 31dispute-resolutionservices.Expendituresshallbemadeatthediscretionofthepresiding 32judgeorfamilycourtadministrativejudge,asdesignatedbythecircuitandassociatecircuit 33judgesenbanc,fortheimplementationofthefamilycourtsystemassetforthinthissection. 34Nomoneysfromthefamilyservicesandjusticefundmaybeusedtopayformediationinany 35causeofactioninwhichdomesticviolenceisalleged. 36 [5.]6.Fromthefundscollectedpursuanttothissectionandretainedinthefamily 37servicesandjusticefund,eachcircuitorcountyinwhichafamilycourtcommissionerin HCSHB2064 38 38additiontothosecommissionersexistingasjuvenilecourtcommissionersonAugust28, 391993,havebeenappointedpursuanttosections487.020to487.040shallpaytoand 40reimbursethestatefortheactualcostsofthatportionofthesalariesoffamilycourt 41commissionersappointedpursuanttotheprovisionsofsections487.020to487.040. 42 [6.]7.Nomoneysdepositedinthefamilyservicesandjusticefundmaybeexpended 43forcapitalimprovements. 494.430.1.Upontimelyapplicationtothecourt,thefollowingpersonsshallbe 2excusedfromserviceasapetitorgrandjuror: 3 (1)Anypersonwhohasservedonastateorfederalpetitorgrandjurywithinthe 4precedingtwoyears; 5 (2)Anynursingmother,uponherrequest,andwithacompletedwrittenstatement 6fromherphysiciantothecourtcertifyingsheisanursingmother; 7 (3)Anypersonwhoseabsencefromhisorherregularplaceofemploymentwould,in 8thejudgmentofthecourt,tendmateriallyandadverselytoaffectthepublicsafety,health, 9welfareorinterest; 10 (4)Anypersonuponwhomserviceasajurorwouldinthejudgmentofthecourt 11imposeanundueorextremephysicalorfinancialhardship; 12 (5)Anypersonlicensedasahealthcareproviderassuchtermisdefinedinsection seventyyearsofageorolder.Anyjuryduty 20notificationsenttoapotentialjurorshallincludelanguageinthenotificationspecifying 21thatapersonmaybeexcusedfromserviceasapetitorgrandjurorifthepersonis 22seventyyearsofageorolder. 23 2.Ajudgeofthecourtforwhichtheindividualwascalledtojuryserviceshallmake 24undueorextremephysicalorfinancialhardshipdeterminations.Theauthoritytomakethese 25determinationsisdelegableonlytocourtofficialsorpersonnelwhoareauthorizedbythe 26lawsofthisstatetofunctionasmembersofthejudiciary. 27 3.Apersonaskingtobeexcusedbasedonafindingofundueorextremephysicalor 28financialhardshipmusttakeallactionsnecessarytohaveobtainedarulingonthatrequestby 29nolaterthanthedateonwhichtheindividualisscheduledtoappearforjuryduty. 30 4.Unlessitisapparenttothecourtthatthephysicalhardshipwouldsignificantly 42factthataprospectivejurorwillberequiredtobeabsentfromhisorherplaceofemployment. 43 6.Apersonaskingajudgetograntanexcusebasedonundueorextremephysicalor 44financialhardshipshallprovidethejudgewithdocumentationasrequiredbythejudge,such 45as,butnotlimitedto,federalandstateincometaxreturns,medicalstatementsfromlicensed 46physicians,proofofdependencyorguardianship,andsimilardocuments,whichthejudge 47findstoclearlysupporttherequesttobeexcused.Failuretoprovidesatisfactory 48documentationshallresultinadenialoftherequesttobeexcused.Suchdocumentsshallbe 49filedunderseal. 50 7.Aftertwoyears,apersonexcusedfromjuryserviceshallbecomeeligibleonce 51againforqualificationasajurorunlessthepersonwasexcusedfromservicepermanently.A 52personisexcusedfromjuryservicepermanentlyonlywhenthedecidingjudgedetermines 53thattheunderlyinggroundsforbeingexcusedareofapermanentnature. 494.455.1.[Eachcountyorcitynotwithinacountymayelecttocompensateits 2jurorspursuanttosubsection2ofthissectionexceptasotherwiseprovidedinsubsection3of 3thissection. 4 2.]Eachgrandandpetitjurorshallreceiveaminimumofsixdollarsperday,for 5everyday[heorshe]thejurormayactuallyserveas[such] ajuror,and[sevencents] the 6mileagerateasprovidedbysection33.095forstateemployeesforeverymile[heorshe] 7thejurormaynecessarilytravelgoingfrom[hisorher]thejuror'splaceofresidencetothe 8courthouseandreturning,tobepaidfromfundsofthecountyoracitynotwithinacounty. 9Eachcountyorcitynotwithinacountymayelecttocompensateitsjurorsunder 10subsection2ofthissection,exceptasotherwiseprovidedinsubsection3ofthissection. 11 2.Thegoverningbodyofeachcountyoracitynotwithinacountymayauthorize 12additionaldailycompensationandmileageallowanceforjurors,whichadditional 13compensationshallbepaidfromthefundsofthecountyoracitynotwithinacounty. 14Thegoverningbodyofeachcountyoracitynotwithinacountymayauthorizeadditional 15dailycompensationandmileageallowanceforjurorsattendingacoroner'sinquest.Jurors HCSHB2064 40 16mayreceivetheadditionalcompensationandmileageallowanceauthorizedbythissubsection 17onlyifthegoverningbodyofthecountyorthecitynotwithinacountyauthorizesthe 18additionalcompensation.Theprovisionsofthissubsectionauthorizingadditional 19compensationshallterminateupontheissuanceofamandatebytheMissourisupreme 20courtwhichresultsinthestateofMissouribeingobligatedorrequiredtopayanysuch 21additionalcompensationevenifsuchadditionalcompensationisformallyapprovedor 22authorizedbythegoverningbodyofacountyoracitynotwithinacounty.Providedthata 23countyoracitynotwithinacountyauthorizesdailycompensationpayablefromcountyor 24cityfundsforjurorswhoserveinthatcountypursuanttothissubsectionintheamountofat 25leastsixdollarsperdayinadditiontotheamountrequiredbythissubsection,apersonshall 26receiveanadditionalsixdollarsperdaytobereimbursedbythestateofMissourisothatthe 27totalcompensationpayableshallbeatleasteighteendollars,plusmileageforeachdaythat 28thepersonactuallyservesasapetitjurorinaparticularcase;orforeachdaythataperson 29actuallyservesasagrandjurorduringatermofagrandjury.Thestateshallreimbursethe 30countyforsixdollarsoftheadditionaljurorcompensationprovidedbythissubsection. 31 3.[Inanycountyofthefirstclassificationwithoutacharterformofgovernmentand 32withapopulationofatleasttwohundredthousandinhabitants,nograndorpetitjurorshall 33receivecompensationforthefirsttwodaysofservice,butshallreceivefiftydollarsperday 34forthethirddayandeachsubsequentdayheorshemayactuallyserveassuch,andseven 35centsforeverymileheorshemaynecessarilytravelgoingfromhisorherplaceofresidence 36tothecourthouseandreturning,tobepaidfromfundsofthecounty.]Notwithstandingthe 37provisionsofsubsection1or2ofthissection,byamajorityvote,thegoverningbodyof 38acountyorcitynotwithinacountymayadoptasystemforjurorcompensationinacity 39notwithinacountyoracountywithinthecircuit,asfollows:eachgrandorpetitjuror 40shallreceivefiftydollarsperdayforthethirddaythejurormayactuallyserveasa 41jurorandforeachsubsequentdayofactualservice,andthemileagerateasprovidedby 42section33.095forstateemployeesforeverymilethejurormaynecessarilytravelfrom 43thejuror'splaceofresidencetothecourthouseandreturning,tobepaidfromfundsof 44thecountyoracitynotwithinacounty,providedthatnograndorpetitjurorshall 45receivecompensationforthefirsttwodaysthejurormayactuallyserveassuch. 46 4.Wheneachpanelofjurorssummonedandattendingcourthascompletedits 47service,theboardofjurycommissionersshallcausetobesubmittedtothegoverningbodyof 48thecountyoracitynotwithinacountyastatementoffeesearnedbyeachjuror.Withinthirty
