5Nofeeshallberequiredorcollectedforacertificationofbirth,death,ormarriageifthe
6requestforcertificationismadebythechildren'sdivision,thedivisionofyouthservices,a

10BeginningAugust28,2004,foreachvitalrecordsfeecollected,thedirectorofrevenueshall
11creditfourdollarstothegeneralrevenuefund,fivedollarstothechildren'strustfund,one
12dollarshallbecreditedtotheendowedcarecemeteryauditfund,onedollarforeach
13certificationorcopyofdeathrecordstotheMissouristatecoroners'trainingfundestablished
14insection58.208,andthreedollarsforthefirstcopyofdeathrecordsandfivedollarsfor

28filesandrecords,whennorecordisfound,thestateshallbeentitledtoafeeequaltothe
29amountforacertificationofavitalrecordforafive-yearsearchtobepaidbytheapplicant.
30Fortheprocessingofeachlegitimation,adoption,courtorderorrecordingafterthe
31registrant'stwelfthbirthday,thestateshallbeentitledtoafeeequaltotheamountfora
32certificationofavitalrecord.Exceptwheneveracertifiedcopyorcopiesofavitalrecordis
33requiredtoperfectanyclaimofanypersononrelief,oranydependentofanypersonwhowas
34onreliefforanyclaimuponthegovernmentofthestateorUnitedStates,thestateregistrar
35shall,uponrequest,furnishacertifiedcopyorsomanycertifiedcopiesasarenecessary,
36withoutanyfeeorcompensationtherefor.
37 2.Fortheissuanceofacertificationofadeathrecordbythelocalregistrar,the

47hundredthousandinhabitants,adonationofonedollarmaybecollectedbythelocalregistrar
48overandaboveanyfeesrequiredbylawwhenacertificationorcopyofanymarriagelicense
49orbirthcertificateisprovided,withsuchdonationscollectedtobeforwardedmonthlybythe

54suchcopies.Allfeescollectedunderthissubsection,otherthanthedonationscollectedin
55anycountywithacharterformofgovernmentandwithmorethansixhundredthousandbut
56fewerthansevenhundredthousandinhabitantsformarriagelicensesandbirthcertificates,
57shallbedepositedtotheofficialcityorcountyhealthagency.
58 4.Acertifiedcopyofadeathrecordbythelocalregistrarcanonlybeissuedafter
59acceptanceandregistrationwiththestateregistrar.Thefeespaidtotheofficialcountyhealth
60agencyshallberetainedbythelocalagencyforlocalpublichealthpurposes.
61 5.Nofeeunderthissectionshallberequiredorcollectedfromaparentorguardianof
62ahomelesschildorhomelessyouth,asdefinedinsubsection1ofsection167.020,oran
63unaccompaniedyouth,asdefinedin42U.S.C.Section11434a(6),fortheissuanceofa
64certification,orcopyofsuchcertification,ofbirthofsuchchildoryouth.Anunaccompanied
65youthshallbeeligibletoreceiveacertificationorcopyofhisorherownbirthrecordwithout
66theconsentorsignatureofhisorherparentorguardian;provided,thatonlyonecertificate
67underthisprovisionshallbeprovidedwithoutcosttotheunaccompaniedorhomelessyouth.
68Fortheissuanceofanyadditionalcertificates,thestatutoryfeeshallbepaid.
69 6.(1)Notwithstandinganyprovisionoflawtothecontrary,nofeeshallberequired
70orcollectedforacertificationofbirthiftherequestismadebyavictimofdomesticviolence
71orabuse,asthosetermsaredefinedinsection455.010,andthevictimprovides
72documentationsignedbyanemployee,agent,orvolunteerofavictimserviceprovider,an
73attorney,orahealthcareormentalhealthprofessional,fromwhomthevictimhassought
74assistancerelatingtothedomesticviolenceorabuse.Suchdocumentationshallstatethat,
75underpenaltyofperjury,theemployee,agent,orvolunteerofavictimserviceprovider,the
76attorney,orthehealthcareormentalhealthprofessionalbelievesthevictimhasbeen
77involvedinanincidentofdomesticviolenceorabuse.
78 (2)Avictimmaybeeligibleonlyonetimeforafeewaiverunderthissubsection.
HCSHB2064	3 79 7.Nofeeshallberequiredorcollectedforacertificationofbirth,death,or
80marriageiftherequestforcertificationismadebyaprosecutingattorney,acircuit
81attorney,ortheattorneygeneral.
287.200.1.Compensationforpermanenttotaldisabilityshallbepaidduringthe
2continuanceofsuchdisabilityfromthedateofmaximummedicalimprovementforthe
3lifetimeoftheemployeeattheweeklyrateofcompensationineffectunderthissubsectionon
4thedateoftheinjuryforwhichcompensationisbeingmade.Theword"employee"asused
5inthissectionshallnotincludetheinjuredworker'sdependents,estate,orotherpersonsto
6whomcompensationmaybepayableasprovidedinsubsection1ofsection287.020.The
7amountofsuchcompensationshallbecomputedasfollows:
8 (1)ForallinjuriesoccurringonorafterSeptember28,1983,butbeforeSeptember
928,1986,theweeklycompensationshallbeanamountequaltosixty-sixandtwo-thirds
10percentoftheinjuredemployee'saverageweeklyearningsduringtheyearimmediately
11precedingtheinjury,asofthedateoftheinjury;providedthattheweeklycompensationpaid
12underthissubdivisionshallnotexceedanamountequaltoseventypercentofthestate
13averageweeklywage,assuchwageisdeterminedbythedivisionofemploymentsecurity,as
14oftheJulyfirstimmediatelyprecedingthedateofinjury;
15 (2)ForallinjuriesoccurringonorafterSeptember28,1986,butbeforeAugust28,
161990,theweeklycompensationshallbeanamountequaltosixty-sixandtwo-thirdspercent
17oftheinjuredemployee'saverageweeklyearningsduringtheyearimmediatelyprecedingthe
18injury,asofthedateoftheinjury;providedthattheweeklycompensationpaidunderthis
19subdivisionshallnotexceedanamountequaltoseventy-fivepercentofthestateaverage
20weeklywage,assuchwageisdeterminedbythedivisionofemploymentsecurity,asofthe
21Julyfirstimmediatelyprecedingthedateofinjury;
22 (3)ForallinjuriesoccurringonorafterAugust28,1990,butbeforeAugust28,1991,
23theweeklycompensationshallbeanamountequaltosixty-sixandtwo-thirdspercentofthe

40 3.(1)Allclaimsforpermanenttotaldisabilityshallbedeterminedinaccordance
41withthefacts.[Whenaninjuredemployeereceivesanawardforpermanenttotaldisability
42butbytheuseofglasses,prostheticappliances,orphysicalrehabilitationtheemployeeis

51subsection1ofthissectionshallbesuspendedduringthetimeinwhichtheemployeeis
52restoredtohisorherregularworkoritsequivalent.Inanycasewherethelifepaymentis
53suspendedunderthis[subsection] subdivision, thecommissionmayatreasonabletimes
54reviewthecaseandeithertheemployeeortheemployermayrequestaninformalconference
55withthecommissionrelativetotheresumptionoftheemployee'sweeklylifepaymentinthe
56case.
57 (3)Uponfilingofawrittenagreementsignedbytheclaimantandhisorher
58attorney,thecommissionshallchangethename,information,orfeearrangementofthe
59attorneyorlawfirmassociatedwiththeclaimant’scase.
60 4.ForallclaimsfiledonorafterJanuary1,2014,foroccupationaldiseasesdueto
61toxicexposurewhichresultinapermanenttotaldisabilityordeath,benefitsinthischapter
62shallbeprovidedasfollows:
63 (1)Notwithstandinganyprovisionoflawtothecontrary,suchamountasduetothe
64employeeduringsaidemployee'slifeasprovidedforunderthischapterforanawardof
65permanenttotaldisabilityanddeath,exceptsuchamountshallonlybepaidwhenbenefits
66undersubdivisions(2)and(3)ofthissubsectionhavebeenexhausted;
67 (2)Foroccupationaldiseasesduetotoxicexposure,butnotincludingmesothelioma,
68anamountequaltotwohundredpercentofthestate'saverageweeklywageasofthedateof
69diagnosisforonehundredweekspaidbytheemployer;and

72 (a)Foremployersthathaveelectedtoacceptmesotheliomaliabilityunderthis
73subsection,anadditionalamountofthreehundredpercentofthestate'saverageweeklywage
74fortwohundredtwelveweeksshallbepaidbytheemployerorgroupofemployerssuch
75employerisamemberof.Employersthatelecttoacceptmesotheliomaliabilityunderthis
76subsectionmaydosobyeitherinsuringtheirliability,byqualifyingasaself-insurer,orby
77becomingamemberofagroupinsurancepool.Agroupofemployersmayenterintoan
78agreementtopooltheirliabilitiesunderthissubsection.Ifsuchgroupisjoined,individual
79membersshallnotberequiredtoqualifyasindividualself-insurers.Suchgroupshallcomply
80withsection287.223.Inorderforanemployertomakesuchanelection,theemployershall
81providethedepartmentwithnoticeofsuchanelectioninamannerestablishedbythe
82department.TheprovisionsofthisparagraphshallexpireonDecember31,2038;or
83 (b)Foremployerswhorejectmesotheliomaunderthissubsection,thentheexclusive
84remedyprovisionsundersection287.120shallnotapplytosuchliability.Theprovisionsof
85thisparagraphshallexpireonDecember31,2038;and
86 (4)Theprovisionsofsubdivision(2)andparagraph(a)ofsubdivision(3)ofthis
87subsectionshallnotbesubjecttosuspensionofbenefitsasprovidedinsubsection3ofthis
88section;and
89 (5)Notwithstandinganyotherprovisionofthischaptertothecontrary,shouldthe

97 (6)Theprovisionsofsubdivision(1)ofthissubsectionshallnotbeconstruedto
98affecttheemployee'sabilitytoobtainmedicaltreatmentattheemployer'sexpenseorany
99otherbenefitsotherwiseavailableunderthischapter.
100 5.Anyemployeewhoobtainsbenefitsundersubdivision(2)ofsubsection4ofthis
101sectionforacquiringasbestosiswholaterobtainsanawardformesotheliomashallnotreceive
102morebenefitsthansuchemployeewouldreceivehavingonlyobtainedbenefitsfor
103mesotheliomaunderthissection.
287.470.1.Uponitsownmotionorupontheapplicationofanypartyinintereston
2thegroundofachangeincondition,thecommissionmayatanytimeuponarehearingafter
3duenoticetothepartiesinterestedreviewanyawardandonsuchreviewmaymakeanaward

5maximumorminimumprovidedinthischapter,andshallimmediatelysendtothepartiesand
6theemployer'sinsureracopyoftheaward.Nosuchreviewshallaffectsuchawardasregards
7anymoneyspaid.
8 2.Uponthefilingofawrittenagreementsignedbytheclaimantandhisorher
9attorney,thecommissionshallchangethename,information,orfeearrangementofthe
10attorneyorlawfirmassociatedwiththeclaimant’scase.
287.610.1.AfterAugust28,2005,thedivisionmayappointadditional
2administrativelawjudgesforamaximumoffortyauthorizedadministrativelawjudges.
3Appropriationsshallbebaseduponnecessity,measuredbytherequirementsandneedsof
4eachdivisionoffice.Administrativelawjudgesshallbedulylicensedlawyersunderthelaws
5ofthisstate.Administrativelawjudgesshallnotpracticelawordolawbusinessandshall
6devotetheirwholetimetothedutiesoftheiroffice.Thedirectorofthedivisionofworkers'
7compensationshallpublishandmaintainonthedivision'swebsitetheappointmentdatesor
8initialdatesofserviceforalladministrativelawjudges.
9 2.[Thethirteenadministrativelawjudgeswiththemostyearsofserviceshallbe
10subjecttoaretentionvoteonAugust28,2008.Thenextthirteenadministrativelawjudges
11withthemostyearsofserviceindescendingordershallbesubjecttoaretentionvoteon
12August28,2012.Administrativelawjudgesappointedandnotpreviouslyreferencedinthis
13subsectionshallbesubjecttoaretentionvoteonAugust28,2016.Subsequentretention
14votesshallbeheldeverytwelveyears.Anyadministrativelawjudgewhohasreceivedtwo
15ormorevotesofnoconfidenceunderperformanceauditsbythecommitteeshallnotreceivea
16voteofretention.
17 3.Theadministrativelawjudgereviewcommitteemembersshallnothaveanydirect
18orindirectemploymentorfinancialconnectionwithaworkers'compensationinsurance
19company,claimsadjustmentcompany,healthcareprovidernorbeapracticingworkers'
20compensationattorney.Allmembersofthecommitteeshallhaveaworkingknowledgeof
21workers'compensation.
22 4.Thecommitteeshallwithinthirtydaysofcompletingeachperformanceauditmake
23arecommendationofconfidenceornoconfidenceforeachadministrativelawjudge.
24 5.]Theadministrativelawjudgesappointedbythedivisionshallonlyhave
25jurisdictiontohearanddetermineclaimsuponoriginalhearingandshallhavenojurisdiction
26uponanyreviewhearing,eitherinthewayofanappealfromanoriginalhearingorbywayof
27reopeninganyprioraward,excepttocorrectaclericalerrorinanawardorsettlementifthe

53Suchtrainingmaybecreditedtowardanycontinuinglegaleducationrequirements.
54 [8.(1)Theadministrativelawjudgereviewcommitteeshallconductaperformance
55auditofalladministrativelawjudgeseverytwoyears.Theauditresults,statingthe
56committee'srecommendationofconfidenceornoconfidenceofeachadministrativelaw
57judgeshallbesenttothegovernornolaterthanthefirstweekofeachlegislativesession
58immediatelyfollowingsuchaudit.Anyadministrativelawjudgewhohasreceivedthreeor
59morevotesofnoconfidenceundertwosuccessiveperformanceauditsbythecommitteemay
60havetheirappointmentimmediatelywithdrawn.
61 (2)Thereviewcommitteeshallconsistofonememberappointedbythepresidentpro
62temofthesenate,onememberappointedbytheminorityleaderofthesenate,onemember
63appointedbythespeakerofthehouseofrepresentatives,andonememberappointedbythe
64minorityleaderofthehouseofrepresentatives.Thegovernorshallappointtothecommittee

66Thismembershallactasamemberexofficioandshallnothaveavoteinthecommittee.The
