210.854.1.Intheeventoftheentryofajudgmentorjudgmentsofpaternityand
2support,whetherenteredinonejudgmentorseparately,apersonagainstwhomsucha
3judgmentorjudgmentshavebeenenteredmayfileapetitionrequestingacircuitcourtwith
4jurisdictionoverthesubjectchildorchildrentosetasidesaidjudgmentorjudgmentsinthe
5interestsofjusticeanduponthegroundssetforthinthissection.Suchapetitionmaybefiled
6atanytimepriortoDecember31,2011.Afterthatdate,thepetitionshallbefiledwithintwo
7yearsoftheentryoftheoriginaljudgmentofpaternityandsupportorwithintwoyearsof
8entryofthelaterjudgmentinthecaseofseparatejudgmentsofpaternityandsupportand
9shallbefiledinthecountywhichenteredthejudgmentorjudgmentsofpaternityandsupport.
10Anysuchpetitionshallbeserveduponthebiologicalmotherandanyotherlegalguardianor
11custodianinthesamemannerprovidedforserviceofprocessintherulesofcivilprocedure.
12Thechildorchildrenshallbemadeapartyandshallhaveaguardianadlitemappointedfor
13thechildorchildrenbeforeanyfurtherproceedingsarehad.Ifthechildorchildrenare
14recipientsofIV-Dservicesasdefinedinsubdivision(8)ofsection454.460,thefamily
15supportdivisionshallalsobemadeapartyandshallbedulyserved.

17evidenceexistswhichwasnotconsideredbeforeentryofjudgmentandeither:
18 (1)Anallegationthatgenetictestingwasconductedwithinninetydayspriortothe
19filingofsuchpetitionusingDNAmethodologytodeterminetheprobabilityorimprobability
20ofpaternity,andperformedbyanexpertasdefinedinsection210.834.Theaffidavitshall

31accurate,andindicatesthatthepersonsubjecttothechildsupportpaymentorderhasbeen
32excludedasthechild'sfather,thecourtshall,unlessitmakeswrittenfindingsoffactand
33conclusionsoflawthatitisinthebestinterestofthepartiesnottodoso:

54petitionerpledguiltyorwassentencedforanordertoexpungefromallofficialrecordsall
55recordationsofhisarrest,plea,trial,orconviction.Ifthecourtdetermines,afterhearing,that
56thepetitionerhashadajudgmentorjudgmentsofpaternityandsupportsetasideunderthis
57section,thecourtshallenteranorderofexpungement.Upongrantingoftheorderof
58expungementunderthissubsection,therecordsandfilesmaintainedinanyadministrativeor

68 9.Beginningin2010,thefamilysupportdivisionshalltrackandreporttothegeneral
69assemblythenumberofcasesknowntothedivisioninwhichacourt,withinthecalendar
70year,setasideapreviousjudgmentorjudgmentsofpaternityandsupportundersubsection4
71ofthissection.ThefamilysupportdivisionshallsubmitthereportannuallybyDecember
72thirty-first.
452.340.1.Inaproceedingfordissolutionofmarriage,legalseparationorchild
2support,thecourtmayordereitherorbothparentsowingadutyofsupporttoachildofthe
3marriagetopayanamountreasonableornecessaryforthesupportofthechild,includingan
4awardretroactivetothedateoffilingthepetition,withoutregardtomaritalmisconduct,after
5consideringallrelevantfactorsincluding:
6 (1)Thefinancialneedsandresourcesofthechild;
7 (2)Thefinancialresourcesandneedsoftheparents;
8 (3)Thestandardoflivingthechildwouldhaveenjoyedhadthemarriagenotbeen
9dissolved;
10 (4)Thephysicalandemotionalconditionofthechild,andthechild'seducational
11needs;
12 (5)Thechild'sphysicalandlegalcustodyarrangements,includingtheamountoftime
13thechildspendswitheachparentandthereasonableexpensesassociatedwiththecustodyor
14visitationarrangements;and
15 (6)Thereasonablework-relatedchildcareexpensesofeachparent.
16 2.Theobligationoftheparentorderedtomakesupportpaymentsshallabate,in
17wholeorinpart,forsuchperiodsoftimeinexcessofthirtyconsecutivedaysthattheother

19childsupport,notwithstandinganyperiodsofvisitationortemporaryphysicalandlegalor
20physicalorlegalcustodypursuanttoajudgmentofdissolutionorlegalseparationorany
21modificationthereof.InaIV-Dcase,thefamilysupportdivisionmaydeterminetheamount
22oftheabatementpursuanttothissubsectionforanychildsupportorderandshallrecordthe
23amountofabatementintheautomatedchildsupportsystemrecordestablishedpursuantto
24chapter454.IfthecaseisnotaIV-Dcaseanduponcourtorder,thecircuitclerkshallrecord
25theamountofabatementintheautomatedchildsupportsystemrecordestablishedinchapter
26454.
27 3.Unlessthecircumstancesofthechildmanifestlydictateotherwiseandthecourt
28specificallysoprovides,theobligationofaparenttomakechildsupportpaymentsshall
29terminatewhenthechild:
30 (1)Dies;
31 (2)Marries;
32 (3)Entersactivedutyinthemilitary;
33 (4)Becomesself-supporting,providedthatthecustodialparenthasrelinquishedthe
34childfromparentalcontrolbyexpressorimpliedconsent;or
35 (5)Reachesageeighteenorreceivesahighschooldiplomaoranequivalent
36certificateofgraduationinlieuofahighschooldiploma, unlesstheprovisionsofthe
37childsupportorderspecificallyextendtheparentalsupportorderpastthechild's
38eighteenthbirthdayforreasonsprovidedbysubsection4[or5]ofthissection[apply;or
39 (6)Reachesagetwenty-one,unlesstheprovisionsofthechildsupportorder
40specificallyextendtheparentalsupportorderpastthechild'stwenty-firstbirthdayforreasons
41providedbysubsection4ofthissection].
42 4.Ifthechildisphysicallyormentallyincapacitatedfromsupportinghimselfand
43insolventandunmarried,thecourtmayextendtheparentalsupportobligationpastthechild's
44eighteenthbirthday.
45 5.[Ifwhenachildreachesageeighteen,thechildisenrolledinandattendinga
46secondaryschoolprogramofinstruction,theparentalsupportobligationshallcontinue,ifthe
47childcontinuestoattendandprogressestowardcompletionofsaidprogram,untilthechild
48completessuchprogramorreachesagetwenty-one,whicheverfirstoccurs.Ifthechildis
49enrolledinaninstitutionofvocationalorhighereducationnotlaterthanOctoberfirst
50followinggraduationfromasecondaryschoolorcompletionofagraduationequivalence
51degreeprogramandsolongasthechildenrollsforandcompletesatleasttwelvehoursof
52crediteachsemester,notincludingthesummersemester,ataninstitutionofvocationalor
53highereducationandachievesgradessufficienttoreenrollatsuchinstitution,theparental
54supportobligationshallcontinueuntilthechildcompleteshisorhereducation,oruntilthe
HB2148	4 55childreachestheageoftwenty-one,whicheverfirstoccurs.Toremaineligibleforsuch
56continuedparentalsupport,atthebeginningofeachsemesterthechildshallsubmittoeach
57parentatranscriptorsimilarofficialdocumentprovidedbytheinstitutionofvocationalor
58highereducationwhichincludesthecoursesthechildisenrolledinandhascompletedfor
59eachterm,thegradesandcreditsreceivedforeachsuchcourse,andanofficialdocument
60fromtheinstitutionlistingthecourseswhichthechildisenrolledinfortheupcomingterm
61andthenumberofcreditsforeachsuchcourse.Whenenrolledinatleasttwelvecredithours,
62ifthechildreceivesfailinggradesinhalformoreofhisorhercourseloadinanyone
63semester,paymentofchildsupportmaybeterminatedandshallnotbeeligiblefor
64reinstatement.Uponrequestfornotificationofthechild'sgradesbythenoncustodialparent,
65thechildshallproducetherequireddocumentstothenoncustodialparentwithinthirtydaysof
66receiptofgradesfromtheeducationinstitution.Ifthechildfailstoproducetherequired
67documents,paymentofchildsupportmayterminatewithouttheaccrualofanychildsupport
68arrearageandshallnotbeeligibleforreinstatement.Ifthecircumstancesofthechild
69manifestlydictate,thecourtmaywaivetheOctoberfirstdeadlineforenrollmentrequiredby
70thissubsection.Ifthechildisenrolledinsuchaninstitution,thechildorparentobligatedto
71paysupportmaypetitionthecourttoamendtheordertodirecttheobligatedparenttomake
72thepaymentsdirectlytothechild.Asusedinthissection,an"institutionofvocational
73education"meansanypostsecondarytrainingorschoolingforwhichthestudentisassesseda
74feeandattendsclassesregularly."Highereducation"meansanycommunitycollege,college,
75oruniversityatwhichthechildattendsclassesregularly.Achildwhohasbeendiagnosed
76withadevelopmentaldisability,asdefinedinsection630.005,orwhosephysicaldisabilityor
77diagnosedhealthproblemlimitsthechild'sabilitytocarrythenumberofcredithours
78prescribedinthissubsection,shallremaineligibleforchildsupportsolongassuchchildis
79enrolledinandattendinganinstitutionofvocationalorhighereducation,andthechild
80continuestomeettheotherrequirementsofthissubsection.Achildwhoisemployedatleast
81fifteenhoursperweekduringthesemestermaytakeasfewasninecredithourspersemester
82andremaineligibleforchildsupportsolongasallotherrequirementsofthissubsectionare
83compliedwith.
84 6.]Thecourtshallconsiderorderingaparenttowaivetherighttoclaimthetax
85dependencyexemptionforachildenrolledinaninstitutionofvocationalorhighereducation
86infavoroftheotherparentiftheapplicationofstateandfederaltaxlawsandeligibilityfor
87financialaidwillmakeanawardoftheexemptiontotheotherparentappropriate.
88 [7.]6.Thegeneralassemblyfindsanddeclaresthatitisthepublicpolicyofthisstate
89thatfrequent,continuingandmeaningfulcontactwithbothparentsaftertheparentshave
90separatedordissolvedtheirmarriageisinthebestinterestofthechildexceptforcaseswhere
91thecourtspecificallyfindsthatsuchcontactisnotinthebestinterestofthechild.Inorderto
HB2148	5 92effectuatethispublicpolicy,acourtwithjurisdictionshallenforcevisitation,custodyand
93childsupportordersinthesamemanner.Acourtwithjurisdictionmayabate,inwholeorin
94part,anypastorfutureobligationofsupportandmaytransferthephysicalandlegalor
95physicalorlegalcustodyofoneormorechildrenifitfindsthataparenthas,withoutgood
96cause,failedtoprovidevisitationorphysicalandlegalorphysicalorlegalcustodytothe
97otherparentpursuanttothetermsofajudgmentofdissolution,legalseparationor
98modificationsthereof.Thecourtshallalsoaward,ifrequestedandforgoodcauseshown,
99reasonableexpenses,attorney'sfeesandcourtcostsincurredbytheprevailingparty.
100 [8.]7.TheMissourisupremecourtshallhaveineffectaruleestablishingguidelines
101bywhichanyawardofchildsupportshallbemadeinanyjudicialoradministrative
102proceeding.Saidguidelinesshallcontainspecific,descriptiveandnumericcriteriawhich
103willresultinacomputationofthesupportobligation.Theguidelinesshalladdresshowthe
104amountofchildsupportshallbecalculatedwhenanawardofjointphysicalcustodyresultsin
105thechildorchildrenspendingequalorsubstantiallyequaltimewithbothparentsandthe
106directionsandcommentsandanytabularrepresentationsofthedirectionsandcommentsfor
107completionofthechildsupportguidelinesandasubsequentformdevelopedtoreflectthe
108guidelinesshallreflecttheabilitytoobtainuptoafiftypercentadjustmentorcreditbelowthe
109basicchildsupportamountforjointphysicalcustodyorvisitationasdescribedinsubsection
110[11]10ofthissection.TheMissourisupremecourtshallpublishchildsupportguidelinesand
111specificallylistandexplaintherelevantfactorsandassumptionsthatwereusedtocalculate
112thechildsupportguidelines.Anyrulemadepursuanttothissubsectionshallbereviewedby
113thepromulgatingbodynotlessthanonceeveryfouryearstoensurethatitsapplicationresults
114inthedeterminationofappropriatechildsupportawardamounts.
115 [9.]8.Thereshallbearebuttablepresumption,inanyjudicialoradministrative
116proceedingfortheawardofchildsupport,thattheamountoftheawardwhichwouldresult
117fromtheapplicationoftheguidelinesestablishedpursuanttosubsection[8]7ofthissection
118isthecorrectamountofchildsupporttobeawarded.Awrittenfindingorspecificfindingon
119therecordinajudicialoradministrativeproceedingthattheapplicationoftheguidelines
120wouldbeunjustorinappropriateinaparticularcase,afterconsideringallrelevantfactors,
121includingthefactorssetoutinsubsection1ofthissection,shallberequiredandshallbe
122sufficienttorebutthepresumptioninthecase.Thewrittenfindingorspecificfindingonthe
123recordshalldetailthespecificrelevantfactorsthatrequiredadeviationfromtheapplication
124oftheguidelines.
125 [10.]9.Pursuanttothisoranyotherchapter,whenacourtdeterminestheamount
126owedbyaparentforsupportprovidedtoachildbyanotherperson,otherthanaparent,prior
127tothedateoffilingofapetitionrequestingsupport,orwhenthedirectorofthefamilysupport
128divisionestablishestheamountofstatedebtduepursuanttosubdivision(2)ofsubsection1of
HB2148	6 129section454.465,thecourtordirectorshallusetheguidelinesestablishedpursuantto
130subsection[8]7ofthissection.Theamountofchildsupportresultingfromtheapplicationof
131theguidelinesshallbeappliedretroactivelyforaperiodpriortotheestablishmentofa
132supportorderandthelengthoftheperiodofretroactivityshallbelefttothediscretionofthe
133courtordirector.Thereshallbearebuttablepresumptionthattheamountresultingfrom
134applicationoftheguidelinesundersubsection[8]7ofthissectionconstitutestheamount
135owedbytheparentfortheperiodpriortothedateofthefilingofthepetitionforsupportor
136theperiodforwhichstatedebtisbeingestablished.Inapplyingtheguidelinestodeterminea
137retroactivesupportamount,wheninformationastoaveragemonthlyincomeisavailable,the
138courtordirectormayusetheaveragemonthlyincomeofthenoncustodialparent,asaveraged
139overtheperiodofretroactivity,indeterminingtheamountofpresumedchildsupportowed
140fortheperiodofretroactivity.Thecourtordirectormayenteradifferentamountina
141particularcaseuponfinding,afterconsiderationofallrelevantfactors,includingthefactors
142setoutinsubsection1ofthissection,thatthereissufficientcausetorebutthepresumed
143amount.
144 [11.]10.Ifthecourt[mayaward] awardschildsupport[inanamountthatprovides
145upto],thereshallbearebuttablepresumptionincasesinwhichthereisacustodyaward
146ofjointphysicalcustodywherethechildorchildrenspendequalorsubstantiallyequal
147timewithbothparentsthatthecalculationofchildsupportbeginswithafiftypercent
148creditforovernightvisitationorcustodyadjustmentbelowthebasicchildsupportamount
149authorizedbythechildsupportguidelinesdescribedundersubsection[8]7ofthissection[for
150custodyawardsofjointphysicalcustodywherethechildorchildrenspendequalor
151substantiallyequaltimewithbothparents].
152 [12.]11.Theobligationofaparenttomakechildsupportpaymentsmaybe
153terminatedasfollows:
154 (1)Providedthatthestatecaseregistryorchildsupportordercontainsthechild'sdate
155ofbirth,theobligationshallbedeemedterminatedwithoutfurtherjudicialoradministrative
156processwhenthechildreachesage[twenty-one] eighteenifthechildsupportorderdoesnot
157specificallyrequirepaymentofchildsupportbeyondage[twenty-one] eighteenforreasons
158providedbysubsection4ofthissection;
159 (2)Theobligationshallbedeemedterminatedwithoutfurtherjudicialor
160administrativeprocesswhentheparentreceivingchildsupportfurnishesaswornstatement
161oraffidavitnotifyingtheobligorparentofthechild'semancipationinaccordancewiththe
162requirementsofsubsection4ofsection452.370,andacopyofsuchswornstatementor
163affidavitisfiledwiththecourtwhichenteredtheorderestablishingthechildsupport
164obligation,orthefamilysupportdivisionforanorderenteredundersection454.470;

190obligeeparents.Thesupremecourtmaypromulgateuniformformsforswornstatementsand
191affidavitstoterminateordersofchildsupportobligationsforusepursuanttosubsection[12]
