210.854.1.Intheeventoftheentryofajudgmentorjudgmentsofpaternityand
2support,whetherenteredinonejudgmentorseparately,apersonagainstwhomsucha
3judgmentorjudgmentshavebeenenteredmayfileapetitionrequestingacircuitcourtwith
4jurisdictionoverthesubjectchildorchildrentosetasidesaidjudgmentorjudgmentsinthe
5interestsofjusticeanduponthegroundssetforthinthissection.Suchapetitionmaybefiled
6atanytimepriortoDecember31,2011.Afterthatdate,thepetitionshallbefiledwithintwo
7yearsoftheentryoftheoriginaljudgmentofpaternityandsupportorwithintwoyearsof
8entryofthelaterjudgmentinthecaseofseparatejudgmentsofpaternityandsupportand
9shallbefiledinthecountywhichenteredthejudgmentorjudgmentsofpaternityandsupport.
10Anysuchpetitionshallbeserveduponthebiologicalmotherandanyotherlegalguardianor
11custodianinthesamemannerprovidedforserviceofprocessintherulesofcivilprocedure.
12Thechildorchildrenshallbemadeapartyandshallhaveaguardianadlitemappointedfor
13thechildorchildrenbeforeanyfurtherproceedingsarehad.Ifthechildorchildrenare
14recipientsofIV-Dservicesasdefinedinsubdivision(8)ofsection454.460,thefamily
15supportdivisionshallalsobemadeapartyandshallbedulyserved.
16 2.Thepetitionshallincludeanaffidavitexecutedbythepetitionerallegingthat
17evidenceexistswhichwasnotconsideredbeforeentryofjudgmentandeither:

28submittogeneticpaternitytesting.Thegeneticpaternitytestingcostsshallbepaidbythe

30 4.Uponafindingthatthegenetictestreferredtohereinwasproperlyconducted,
31accurate,andindicatesthatthepersonsubjecttothechildsupportpaymentorderhasbeen
32excludedasthechild'sfather,thecourtshall,unlessitmakeswrittenfindingsoffactand
33conclusionsoflawthatitisinthebestinterestofthepartiesnottodoso:
34 (1)Grantreliefonthepetitionandenterjudgmentsettingasidethepreviousjudgment
35orjudgmentsofpaternityandsupport,oracknowledgmentofpaternityundersection210.823

53tobethebiologicalchildorchildrenofthepetitioner,mayapplytothecourtinwhichthe
54petitionerpledguiltyorwassentencedforanordertoexpungefromallofficialrecordsall

56thepetitionerhashadajudgmentorjudgmentsofpaternityandsupportsetasideunderthis

58expungementunderthissubsection,therecordsandfilesmaintainedinanyadministrativeor

68 9.Beginningin2010,thefamilysupportdivisionshalltrackandreporttothegeneral
69assemblythenumberofcasesknowntothedivisioninwhichacourt,withinthecalendar
70year,setasideapreviousjudgmentorjudgmentsofpaternityandsupportundersubsection4
71ofthissection.ThefamilysupportdivisionshallsubmitthereportannuallybyDecember
72thirty-first.
452.340.1.Inaproceedingfordissolutionofmarriage,legalseparationorchild
2support,thecourtmayordereitherorbothparentsowingadutyofsupporttoachildofthe
3marriagetopayanamountreasonableornecessaryforthesupportofthechild,includingan
4awardretroactivetothedateoffilingthepetition,withoutregardtomaritalmisconduct,after
5consideringallrelevantfactorsincluding:
6 (1)Thefinancialneedsandresourcesofthechild;
7 (2)Thefinancialresourcesandneedsoftheparents;
8 (3)Thestandardoflivingthechildwouldhaveenjoyedhadthemarriagenotbeen
9dissolved;
10 (4)Thephysicalandemotionalconditionofthechild,andthechild'seducational
11needs;
12 (5)Thechild'sphysicalandlegalcustodyarrangements,includingtheamountoftime
13thechildspendswitheachparentandthereasonableexpensesassociatedwiththecustodyor
14visitationarrangements;and
15 (6)Thereasonablework-relatedchildcareexpensesofeachparent.
16 2.Theobligationoftheparentorderedtomakesupportpaymentsshallabate,in
17wholeorinpart,forsuchperiodsoftimeinexcessofthirtyconsecutivedaysthattheother
18parenthasvoluntarilyrelinquishedphysicalcustodyofachildtotheparentorderedtopay
19childsupport,notwithstandinganyperiodsofvisitationortemporaryphysicalandlegalor

21modificationthereof.InaIV-Dcase,thefamilysupportdivisionmaydeterminetheamount
22oftheabatementpursuanttothissubsectionforanychildsupportorderandshallrecordthe
23amountofabatementintheautomatedchildsupportsystemrecordestablishedpursuantto
24chapter454.IfthecaseisnotaIV-Dcaseanduponcourtorder,thecircuitclerkshallrecord
25theamountofabatementintheautomatedchildsupportsystemrecordestablishedinchapter

27 3.Unlessthecircumstancesofthechildmanifestlydictateotherwiseandthecourt
28specificallysoprovides,theobligationofaparenttomakechildsupportpaymentsshall
29terminatewhenthechild:
30 (1)Dies;
31 (2)Marries;
32 (3)Entersactivedutyinthemilitary;
33 (4)Becomesself-supporting,providedthatthecustodialparenthasrelinquishedthe
34childfromparentalcontrolbyexpressorimpliedconsent;or
35 (5)Reachesageeighteenorreceivesahighschooldiploma,whicheveroccurs
36later, unlesstheprovisionsofthechildsupportorderspecificallyextendtheparental
37supportorderpastthechild'seighteenthbirthdayforreasonsprovidedbysubsection4
38[or5]ofthissection[apply;or
39 (6)Reachesagetwenty-one,unlesstheprovisionsofthechildsupportorder
40specificallyextendtheparentalsupportorderpastthechild'stwenty-firstbirthdayforreasons
41providedbysubsection4ofthissection] .Theprovisionsofthissubdivisionshallbecome
42effectiveforallfuturecourtordersissuedonorafterJanuary1,2025.
43 4.Ifthechildisphysicallyormentallyincapacitatedfromsupportinghimselfand
44insolventandunmarried,thecourtmayextendtheparentalsupportobligationpastthechild's
45eighteenthbirthday.
46 5.[Ifwhenachildreachesageeighteen,thechildisenrolledinandattendinga
47secondaryschoolprogramofinstruction,theparentalsupportobligationshallcontinue,ifthe
48childcontinuestoattendandprogressestowardcompletionofsaidprogram,untilthechild
49completessuchprogramorreachesagetwenty-one,whicheverfirstoccurs.Ifthechildis
50enrolledinaninstitutionofvocationalorhighereducationnotlaterthanOctoberfirst
51followinggraduationfromasecondaryschoolorcompletionofagraduationequivalence
52degreeprogramandsolongasthechildenrollsforandcompletesatleasttwelvehoursof
53crediteachsemester,notincludingthesummersemester,ataninstitutionofvocationalor
54highereducationandachievesgradessufficienttoreenrollatsuchinstitution,theparental
55supportobligationshallcontinueuntilthechildcompleteshisorhereducation,oruntilthe
56childreachestheageoftwenty-one,whicheverfirstoccurs.Toremaineligibleforsuch
HCSHB2148	4 57continuedparentalsupport,atthebeginningofeachsemesterthechildshallsubmittoeach
58parentatranscriptorsimilarofficialdocumentprovidedbytheinstitutionofvocationalor
59highereducationwhichincludesthecoursesthechildisenrolledinandhascompletedfor
60eachterm,thegradesandcreditsreceivedforeachsuchcourse,andanofficialdocument
61fromtheinstitutionlistingthecourseswhichthechildisenrolledinfortheupcomingterm
62andthenumberofcreditsforeachsuchcourse.Whenenrolledinatleasttwelvecredithours,
63ifthechildreceivesfailinggradesinhalformoreofhisorhercourseloadinanyone
64semester,paymentofchildsupportmaybeterminatedandshallnotbeeligiblefor
65reinstatement.Uponrequestfornotificationofthechild'sgradesbythenoncustodialparent,
66thechildshallproducetherequireddocumentstothenoncustodialparentwithinthirtydaysof
67receiptofgradesfromtheeducationinstitution.Ifthechildfailstoproducetherequired
68documents,paymentofchildsupportmayterminatewithouttheaccrualofanychildsupport
69arrearageandshallnotbeeligibleforreinstatement.Ifthecircumstancesofthechild
70manifestlydictate,thecourtmaywaivetheOctoberfirstdeadlineforenrollmentrequiredby
71thissubsection.Ifthechildisenrolledinsuchaninstitution,thechildorparentobligatedto
72paysupportmaypetitionthecourttoamendtheordertodirecttheobligatedparenttomake
73thepaymentsdirectlytothechild.Asusedinthissection,an"institutionofvocational
74education"meansanypostsecondarytrainingorschoolingforwhichthestudentisassesseda
75feeandattendsclassesregularly."Highereducation"meansanycommunitycollege,college,
76oruniversityatwhichthechildattendsclassesregularly.Achildwhohasbeendiagnosed
77withadevelopmentaldisability,asdefinedinsection630.005,orwhosephysicaldisabilityor
78diagnosedhealthproblemlimitsthechild'sabilitytocarrythenumberofcredithours
79prescribedinthissubsection,shallremaineligibleforchildsupportsolongassuchchildis
80enrolledinandattendinganinstitutionofvocationalorhighereducation,andthechild
81continuestomeettheotherrequirementsofthissubsection.Achildwhoisemployedatleast
82fifteenhoursperweekduringthesemestermaytakeasfewasninecredithourspersemester
83andremaineligibleforchildsupportsolongasallotherrequirementsofthissubsectionare
84compliedwith.
85 6.]Thecourtshallconsiderorderingaparenttowaivetherighttoclaimthetax
86dependencyexemptionforachildenrolledinaninstitutionofvocationalorhighereducation
87infavoroftheotherparentiftheapplicationofstateandfederaltaxlawsandeligibilityfor
88financialaidwillmakeanawardoftheexemptiontotheotherparentappropriate.
89 [7.]6.Thegeneralassemblyfindsanddeclaresthatitisthepublicpolicyofthisstate
90thatfrequent,continuingandmeaningfulcontactwithbothparentsaftertheparentshave
91separatedordissolvedtheirmarriageisinthebestinterestofthechildexceptforcaseswhere
92thecourtspecificallyfindsthatsuchcontactisnotinthebestinterestofthechild.Inorderto
93effectuatethispublicpolicy,acourtwithjurisdictionshallenforcevisitation,custodyand
HCSHB2148	5 94childsupportordersinthesamemanner.Acourtwithjurisdictionmayabate,inwholeorin
95part,anypastorfutureobligationofsupportandmaytransferthephysicalandlegalor
96physicalorlegalcustodyofoneormorechildrenifitfindsthataparenthas,withoutgood
97cause,failedtoprovidevisitationorphysicalandlegalorphysicalorlegalcustodytothe
98otherparentpursuanttothetermsofajudgmentofdissolution,legalseparationor
99modificationsthereof.Thecourtshallalsoaward,ifrequestedandforgoodcauseshown,
100reasonableexpenses,attorney'sfeesandcourtcostsincurredbytheprevailingparty.
101 [8.]7.TheMissourisupremecourtshallhaveineffectaruleestablishingguidelines
102bywhichanyawardofchildsupportshallbemadeinanyjudicialoradministrative
103proceeding.Saidguidelinesshallcontainspecific,descriptiveandnumericcriteriawhich
104willresultinacomputationofthesupportobligation.Theguidelinesshalladdresshowthe
105amountofchildsupportshallbecalculatedwhenanawardofjointphysicalcustodyresultsin
106thechildorchildrenspendingequalorsubstantiallyequaltimewithbothparentsandthe
107directionsandcommentsandanytabularrepresentationsofthedirectionsandcommentsfor
108completionofthechildsupportguidelinesandasubsequentformdevelopedtoreflectthe
109guidelinesshallreflecttheabilitytoobtainuptoafiftypercentadjustmentorcreditbelowthe
110basicchildsupportamountforjointphysicalcustodyorvisitationasdescribedinsubsection
111[11]10ofthissection.TheMissourisupremecourtshallpublishchildsupportguidelinesand
112specificallylistandexplaintherelevantfactorsandassumptionsthatwereusedtocalculate
113thechildsupportguidelines.Anyrulemadepursuanttothissubsectionshallbereviewedby
114thepromulgatingbodynotlessthanonceeveryfouryearstoensurethatitsapplicationresults
115inthedeterminationofappropriatechildsupportawardamounts.
116 [9.]8.Thereshallbearebuttablepresumption,inanyjudicialoradministrative
117proceedingfortheawardofchildsupport,thattheamountoftheawardwhichwouldresult
118fromtheapplicationoftheguidelinesestablishedpursuanttosubsection[8]7ofthissection
119isthecorrectamountofchildsupporttobeawarded.Awrittenfindingorspecificfindingon
120therecordinajudicialoradministrativeproceedingthattheapplicationoftheguidelines
121wouldbeunjustorinappropriateinaparticularcase,afterconsideringallrelevantfactors,
122includingthefactorssetoutinsubsection1ofthissection,shallberequiredandshallbe
123sufficienttorebutthepresumptioninthecase.Thewrittenfindingorspecificfindingonthe
124recordshalldetailthespecificrelevantfactorsthatrequiredadeviationfromtheapplication
125oftheguidelines.
126 [10.]9.Pursuanttothisoranyotherchapter,whenacourtdeterminestheamount
127owedbyaparentforsupportprovidedtoachildbyanotherperson,otherthanaparent,prior
128tothedateoffilingofapetitionrequestingsupport,orwhenthedirectorofthefamilysupport
129divisionestablishestheamountofstatedebtduepursuanttosubdivision(2)ofsubsection1of
130section454.465,thecourtordirectorshallusetheguidelinesestablishedpursuantto
HCSHB2148	6 131subsection[8]7ofthissection.Theamountofchildsupportresultingfromtheapplicationof
132theguidelinesshallbeappliedretroactivelyforaperiodpriortotheestablishmentofa
133supportorderandthelengthoftheperiodofretroactivityshallbelefttothediscretionofthe
134courtordirector.Thereshallbearebuttablepresumptionthattheamountresultingfrom
135applicationoftheguidelinesundersubsection[8]7ofthissectionconstitutestheamount
136owedbytheparentfortheperiodpriortothedateofthefilingofthepetitionforsupportor
137theperiodforwhichstatedebtisbeingestablished.Inapplyingtheguidelinestodeterminea
138retroactivesupportamount,wheninformationastoaveragemonthlyincomeisavailable,the
139courtordirectormayusetheaveragemonthlyincomeofthenoncustodialparent,asaveraged
140overtheperiodofretroactivity,indeterminingtheamountofpresumedchildsupportowed
141fortheperiodofretroactivity.Thecourtordirectormayenteradifferentamountina
142particularcaseuponfinding,afterconsiderationofallrelevantfactors,includingthefactors
143setoutinsubsection1ofthissection,thatthereissufficientcausetorebutthepresumed
144amount.
145 [11.]10.IfissuedonorafterJanuary1,2025,thecourt[mayaward] awardschild
146support[inanamountthatprovidesupto],thereshallbearebuttablepresumptionincases
147inwhichthereisacustodyawardofjointphysicalcustodywherethechildorchildren
148spendequalorsubstantiallyequaltimewithbothparentsthatthecalculationofchild
149supportbeginswithafiftypercentcreditforovernightvisitationorcustodyadjustment
150belowthebasicchildsupportamountauthorizedbythechildsupportguidelinesdescribed
151undersubsection[8]7ofthissection[forcustodyawardsofjointphysicalcustodywherethe
152childorchildrenspendequalorsubstantiallyequaltimewithbothparents].
153 [12.]11.Theobligationofaparenttomakechildsupportpaymentsmaybe
154terminatedasfollows:
155 (1)Providedthatthestatecaseregistryorchildsupportordercontainsthechild'sdate
156ofbirth,theobligationshallbedeemedterminatedwithoutfurtherjudicialoradministrative
157processwhenthechildreachesage[twenty-one] eighteenorreceivesahighschool
158diploma,whicheveroccurslater,ifthechildsupportorderdoesnotspecificallyrequire
159paymentofchildsupportbeyondage[twenty-one] eighteenorwhenthechildreceivesa
160highschooldiploma,whicheveroccurslater,forreasonsprovidedbysubsection4ofthis
161section. Theprovisionsofthissubdivisionshallbecomeeffectiveforallfuturecourt
162ordersissuedonorafterJanuary1,2025;
163 (2)Theobligationshallbedeemedterminatedwithoutfurtherjudicialor
164administrativeprocesswhentheparentreceivingchildsupportfurnishesaswornstatement
165oraffidavitnotifyingtheobligorparentofthechild'semancipationinaccordancewiththe
166requirementsofsubsection4ofsection452.370,andacopyofsuchswornstatementor

168obligation,orthefamilysupportdivisionforanorderenteredundersection454.470;
169 (3)Theobligationshallbedeemedterminatedwithoutfurtherjudicialor

192appearancebyeitherparty.Theclerkofthecourtshallmailacopyofajudgmentterminating
193childsupportenteredpursuanttosubsection[12]11ofthissectiononboththeobligorand
194obligeeparents.Thesupremecourtmaypromulgateuniformformsforswornstatementsand
195affidavitstoterminateordersofchildsupportobligationsforusepursuanttosubsection[12]

454.470.1.Thedirectormayissueanoticeandfindingoffinancialresponsibilityto
2aparentwhoowesastatedebtorwhoisresponsibleforthesupportofachildonwhose
3behalfthecustodianofthatchildisreceivingsupportenforcementservicesfromthedivision
4pursuanttosection454.425ifacourtorderhasnotbeenpreviouslyenteredagainstthat
5parent,acourtorderhasbeenpreviouslyenteredbuthasbeenterminatedbyoperationoflaw
6orifasupportorderfromanotherstatehasbeenenteredbutisnotentitledtorecognition
7undersections454.850to454.997.Serviceofthenoticeandfindingshallbemadeonthe
