Currently,aparent'sobligationtopaychildsupportterminates
whenthechildreaches18yearsofageunlessthechildisenrolled
inandattendingasecondaryschoolprogramofinstructionand
otherspecifiedcriteriaaremet,inwhichcasethesupport
obligationterminateswhenthechildreaches21yearsofage.This
billspecifiesthataparent'sobligationtopaychildsupport
terminateswhenachildreaches18yearsofageorreceivesahigh
schooldiplomaorcertificateofgraduation,unlessthechildis
physicallyormentallyincapacitatedfromsupportinghimselfor
herselfandinsolventandunmarried.
Thebilladditionallyprovidesthatifchildsupportisawarded,
thereshallbearebuttablepresumptionincasesinwhichjoint
physicalcustodyhasbeenawardedwherethechildorchildrenspend
equalorsubstantiallyequaltimewithbothparentsthatthe
calculationofchildsupportbeginswitha50%creditforovernight
visitationorcustodyadjustmentbelowthebasicamountofchild
supportauthorized.
