Thisbillreplacestheterm"time-limiteddemand"with"settlement
demand". Thebillspecifiesthat,inanylawsuitallegingdamages
outsideofwhatiscoveredinthecontractagainstthetort-
feasor'sliabilityinsurer,anypriorsettlementdemandtosettlea
claimwillnotbeconsideredtohavebeenareasonableopportunity
tosettletheclaimunlessthedemandwasinwriting,referenced
Section537.058,RSMo,wassentcertifiedmail,remainedopenfor
acceptancebytheliabilityinsurerforatleast90daysfromthe
datethedemandwasreceivedbytheinsurer,andcontainedcertain
materialterms,describedinthebill.
ThisbillisthesameasHB1009(2023).
PROPONENTS: Supporterssaythatthisaddsclaritysotheinsurance
companiesknowwhatisanacceptableformofsettlementofferand
howmuchtimetheyhavetomakeadecision. Thisalsoclosesa
loopholeattorneysareusingtonothavethesettlementdemand
provisionsapplytotheirdemandbynotputtingatimelimitonit.
