Thebillspecifiesthat,foracityofthefourthclassification,
ifastatuteorordinanceauthorizesthemayortoappointamember
ofalocalboardorcommission,anyrequirementthattheappointed
personbearesidentofthecitywillbedeemedsatisfiedifthe
personownsrealpropertyorabusinessinthecity,regardlessof
whetherthepositiontowhichtheappointmentismadeisconsidered
anofficerofthecity.
Thebillalsospecifiesthat,foracityofthefourth
classification, ifastatuteorordinanceauthorizesthemayorto
appointamemberofaboardthatmanagesamunicipalutility,any
requirementthattheappointedpersonbearesidentofthecity
willbedeemedsatisfiedonlyifthefollowingconditionsaremet:
(1)Theboardhasnoauthoritytosetutilityratesortoissue
bonds;
(2)Thepersonresideswithinfivemilesofthecitylimits;
(3)Thepersonownsrealpropertyorabusinessinthecity;
(4)Thepersonortheperson'sbusinessisacustomerofapublic
utility,asdescribedunderSection91.450,RSMomanagedbythe
board;and
(5)Thepersonhasnopecuniaryinterestin,andisnotaboard
memberof,anyutilitycompanythatoffersthesametypeofservice
asautilitymanagedbytheboard.
