ThefollowingisasummaryoftheHouseCommitteeSubstituteforHB
2286.
Thebillspecifiesthat,foracityofthefourthclassification
withlessthan3,000inhabitants,ifastatuteorordinance
authorizesthemayortoappointamemberofalocalboardor
commission,anyrequirementthattheappointedpersonbearesident
ofthecitywillbedeemedsatisfiedifthepersonownsreal
propertyorabusinessinthecity,regardlessofwhetherthe
positiontowhichtheappointmentismadeisconsideredanofficer
ofthecity.
Thebillalsospecifiesthat,foracityofthefourth
classification, ifastatuteorordinanceauthorizesthemayorto
appointamemberofaboardthatmanagesamunicipalutility,any
requirementthattheappointedpersonbearesidentofthecity
willbedeemedsatisfiedonlyifthefollowingconditionsaremet:
(1)Theboardhasnoauthoritytosetutilityratesortoissue
bonds;
(2)Thepersonresideswithinfivemilesofthecitylimits;
(3)Thepersonownsrealpropertyorabusinessinthecity;
(4)Thepersonortheperson'sbusinessisacustomerofapublic
utility,asdescribedunderSection91.450,RSMomanagedbythe
board;and
(5)Thepersonhasnopecuniaryinterestin,andisnotan
employeeoraboardmemberof,anyutilitycompanyorotherentity
thatoffersthesametypeofserviceasautilitymanagedbythe
board.

Thefollowingisasummaryofthepublictestimonyfromthe
committeehearing. Thetestimonywasbasedontheintroduced
versionofthebill. PROPONENTS: Supporterssaythatoftenitishardtogetcity
residentstoserveontheseboardsandwithvacanciesitishardto
getaquorumtoconductbusiness. Thisbillwouldallowforpeople
whohaveavestedinterestbutdonotliveinthecitytoserveon
theboards.
