Thisbillprovidesthatownersofproductspurchasedorusedin
Missouriandindependentrepairprovidersshallhavetherightto
accessthesamediagnosticandrepairinformationthat
manufacturerssupplytoauthorizedrepairproviders. Product
ownersshallalsohavetherighttopurchaseserviceparts
documentation, andtoolsfrommanufacturersinthesamemannerand
timeasthosepartsaregiventoauthorizedrepairproviders. A
"product"isanyfarmmachinery,constructionmachinery,or
forestrymachinery.
Productownersandindependentrepairfacilitiesshallhavethe
righttopurchasealldiagnosticrepairtoolsfrommanufacturerson
fairandreasonableterms.Forequipmentwithelectronicsecurity
lockorothersecurity-relatedfunction,themanufacturermustmake
availabletoownersandindependentrepairproviders,onfairand
reasonableterms,anyspecialdocumentation, tools,andparts
neededtodisablethelockorfunctionandtoresetitwhen
disabledinthecourseofdiagnosis,maintenance,orrepairofthe
equipment. Uponpurchaseoracquisition,anownerhastherightto
receivedisclosureofanymodificationmadebythepreviousowners.
Productssoldforsecurity-relatedpurposesmaynotbeprogramedto
excludediagnostic,service,orrepairmethodstoresetasecurity-
relatedelectronicfunction. Manufacturersarenotlegally
responsibleforthecontentandfunctionalityofsuchdiagnostic
repairtoolssolongasthemanufacturerscomplywiththerestof
thebill,thebilldoesnotrequirethedivulgenceofatrade
secret.
However,nomanufacturershallberequiredtoproviderepair
informationorservicepartstoaproductowneriftheproductis
stillcoveredbyarepairorreplacementwarranty.
Thebillalsoprovidesacomplaintprovisionforconsumersand
independentrepairprovidersforviolationsofthebillandis
punishablebya$10,000fineperviolation. TheAttorneyGeneral
isrequiredtoenforceitsprovisions.
