No. 5340H.01I Bill No. HB 2568 Page 3 of February 6, 2024 KB:LR:OD FISCAL ANALYSIS ASSUMPTION Officials from the Missouri Department of Transportation (MoDOT), the Missouri Senate and Office of the Governor each assume the proposal will have no fiscal impact on their respective organizations. Oversight does not have any information to the contrary. Therefore, Oversight will reflect a zero impact in the fiscal note for these agencies. Upon further inquiry, MoDOT notes in response to HJR 109 from 2024, $300,000 was budgeted in FY 2023 for six commissioners. This proposal maintains six commissioners until December 1, 2026, at which time the number of members may be changed; however, there can never be more than one commissioner per congressional district (8). Therefore, Oversight will range the fiscal impact from $0 (no new commissioners) to “Less than $100,000” ($300,000 / 6 x 2) cost to the State Road Fund for the potential addition of two commissioners starting in FY 2027. As the change is effective roughly in the middle of the fiscal year (December 1, 2026), Oversight will reflect 7/12 months of impact in FY 2027). FISCAL IMPACT – State GovernmentFY 2025 (10 Mo.) No. 5340H.01I Bill No. HB 2568 Page 4 of February 6, 2024 KB:LR:OD FISCAL DESCRIPTION This bill changes the way in which members of the State Highways and Transportation Commission are selected. Beginning December 1, 2026, the number of members of the Commission may be changed, but there cannot be more than one member from each Congressional district at the same time. If congressional reapportionment results in the loss of a district, the most senior member of the Commission will serve the remainder of the member's term, and then that seat will no longer exist. If congressional reapportionment increases the number of districts, the number of members on the Commission will be increased by law to match the number of districts. Members of the Commission will be appointed by the Governor, with not more than half of the members of the same political party. No member can be appointed to replace a member from the same Congressional district, and no member can be appointed from a Congressional district until each district has been represented by a member at least once. This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
