arisingfromactsoromissionsthatmayincludeawrongfuldeath.

through. Thislegislationseekstoprotecttheunbornfrombeing
consideredanemployeeinacivilaction.Itisunrealisticto
consideranunbornchildanemployee.Unbornchildrendonotfile
taxes,collectapaycheck,orworkashift.Adeathcausedbythe
negligenceofanemployee'semployershouldresultintheemployer
beingheldaccountable. Instead,MODOThasavoidedpayingouta
wrongfuldeathclaimbasedonthelegaltheorythatJaxxwasan
employeeandtherefore,hismotherCaitlin'sfamilyisnotentitled
toaclaim.ConsideringJaxxasanemployeeimpliesthatheisof
legalagetoworkintheStateofMissouri. It'sobviousthatthis
wasnotthecasesincehewasafetusatthetimeofhisdeath.
Childrenundertheageof14areunabletobeemployedatanyjob
atanytimeexceptforafewexceptions,noneofwhichinclude
MODOT.Thislegislationensuresthatemployersareheld
accountablefortheirnegligentactions.
