sectionsrelatingtotransactionsinvolvingsecureidentityverification,withpenalty
provisions.

SectionA.Sections311.310and311.328,RSMo,arerepealedandthreenewsections
2enactedinlieuthereof,tobeknownassections311.310,311.328,and407.225,toreadas
3follows:
311.310.1.Anylicenseeunderthischapter,orhisemployee,whoshallsell,vend,
2giveawayorotherwisesupplyanyintoxicatingliquorinanyquantitywhatsoevertoany
3personundertheageoftwenty-oneyears,ortoanypersonintoxicatedorappearingtobeina
4stateofintoxication,ortoahabitualdrunkard,andanypersonwhomsoeverexcepthisparent
5orguardianwhoshallprocurefor,sell,giveawayorotherwisesupplyintoxicatingliquorto
6anypersonundertheageoftwenty-oneyears,ortoanyintoxicatedpersonoranyperson
7appearingtobeinastateofintoxication,ortoahabitualdrunkard,shallbedeemedguiltyofa
8misdemeanor,exceptthatthissectionshallnotapplytothesupplyingofintoxicatingliquorto
9apersonundertheageoftwenty-oneyearsformedicalpurposesonly,ortotheadministering
10ofsuchintoxicatingliquortoanypersonbyadulylicensedphysician.Nopersonshallbe
11deniedalicenseorrenewalofalicenseissuedunderthischaptersolelyduetoaconviction
12forunlawfulsaleorsupplytoaminorwhenservinginthecapacityasanemployeeofa
13licensedestablishment.
14 2.Anyowner,occupant,orotherpersonorlegalentitywithalawfulrighttothe
15exclusiveuseandenjoymentofanypropertywhoknowinglyallowsapersonundertheageof
16twenty-onetodrinkorpossessintoxicatingliquororknowinglyfailstostopapersonunder
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17theageoftwenty-onefromdrinkingorpossessingintoxicatingliquoronsuchproperty,unless
18suchpersonallowingthepersonundertheageoftwenty-onetodrinkorpossessintoxicating
19liquorishisorherparentorguardian,isguiltyofaclassBmisdemeanor.Anysecondor
20subsequentviolationofthissubsectionisaclassAmisdemeanor.
21 3.Itshallbeadefensetoprosecutionunderthissectionif:
22 (1)Thedefendantisalicensedretailer,club,drinkingestablishment,orcatereror
23holdsatemporarypermit,oranemployeethereof;
24 (2)Thedefendantsoldtheintoxicatingliquortotheminorwithreasonablecauseto
25believethattheminorwastwenty-oneormoreyearsofage;and
26 (3)Topurchasetheintoxicatingliquor,thepersonexhibitedtothedefendanta
27driver'slicense,Missourinondriver'sidentificationcard,secureidentityverificationthat
28usedavalidgovernment-issuedidentificationcardverifiedthroughasecureidentity
29verificationprovider,orotherofficialorapparentlyofficialdocument,containinga
30photographoftheminorandpurportingtoestablishthatsuchminorwastwenty-oneyearsof
31ageandofthelegalageforconsumptionofintoxicatingliquor.
311.328.1.Avalidandunexpiredoperator'sorchauffeur'slicenseissuedunderthe
2provisionsofsection302.177,oravalidandunexpiredoperator'sorchauffeur'slicenseissued
3underthelawsofanystateorterritoryoftheUnitedStatestoresidentsofthosestatesor
4territories,oravalidandunexpiredidentificationcardornondriver'slicenseasprovidedfor
5undersection302.181,oravalidandunexpirednondriver'slicenseissuedunderthelawsof
6anystateorterritoryoftheUnitedStatestoresidentsofthosestatesorterritories,oravalid
7andunexpiredidentificationcardissuedbyanyuniformedserviceoftheUnitedStates,ora
8validandunexpiredpassportshallbepresentedbytheholderthereofuponrequestofany
9agentofthedivisionofalcoholandtobaccocontroloranylicenseeortheservant,agentor
10employeethereofforthepurposeofaidingthelicenseeortheservant,agentoremployeeto
11determinewhetherornotthepersonisatleasttwenty-oneyearsofagewhensuchperson
12desirestopurchaseorconsumealcoholicbeveragesprocuredfromalicensee.Uponsuch
13presentationthelicenseeortheservant,agentoremployeethereofshallcomparethe
14photographandphysicalcharacteristicsnotedonthelicense,identificationcardorpassport
15withthephysicalcharacteristicsofthepersonpresentingthelicense,identificationcardor
16passport.
17 2.Asecureidentityverificationsystemthatusesanelectronicscanofaunique
18physicalcharacteristicidentifiabletotheindividualmaybeusedbyalicenseeforthe
19purposeofaidingthelicenseeortheservant,agent,oremployeetodeterminewhether
20thepersonistwenty-oneyearsofageorolderwhensuchpersondesirestopurchaseor
21consumealcoholicbeveragesprocuredfromalicenseeifthesystemdemonstratesthat:
22 (1)Theperson’sageistwenty-oneyearsofageorolder;and
HCSHB2599	2 23 (2)Thepersonhadpreviouslyregisteredwiththesecureidentityverification
24provideranacceptableformofidentificationassetforthinsubsection1ofthissection.
25 3.Noretailerofalcoholicbeveragesshallberequiredtouseanysecureidentity
26verificationsystem.
27 4.Allretailersofalcoholicbeveragesusingasecureidentityverificationsystem
28shallacceptvalidgovernment-issuedidentificationassetforthundersubsection1ofthis
29sectionforageverificationpurposes.
30 5.Theinformationobtainedandstoredbyanysecureidentityverification
31systemshallnotbesoldforanypurposewithoutconsent.Anindividualmayrequestto
32optoutorrevokeconsentforthecontinuedstorageofhisorhersecureidentity
33verificationprofilemaintainedbythesecureidentityverificationproviderandrequest
34deletionfromtheprovider’sdatabaseinsuchcases.Thedatashallbedeletedsubjectto
35anylegalrequirementstomaintainsuchdata.
36 6.Uponproofbythelicenseeoffullcompliancewiththeprovisionsofthissection,
37nopenaltyshallbeimposedifthesupervisorofthedivisionofalcoholandtobaccocontrolor
38thecourtsaresatisfiedthatthelicenseeactedingoodfaith.Alicenseeassertingagood-
39faithdefenseusingasecureidentityverificationsystemshallberesponsiblefor
40obtainingandprovidingtothedivisionallrecordsnecessarytoestablishthatasecure
41identityverificationdevicewasusedasageverificationforthetransactioninquestion.
42 [3.]7.Anypersonwhoshall,withoutauthorizationfromthedepartmentofrevenue,
43reproduce,alter,modify,ormisrepresentanychauffeur'slicense,motorvehicleoperator's
44licenseoridentificationcardshallbedeemedguiltyofamisdemeanoranduponconviction
45shallbesubjecttoafineofnotmorethanonethousanddollars,andconfinementfornotmore
46thanoneyear,orbybothsuchfineandimprisonment.
407.225.Anybusinessthatoffersconsumerstheoptiontomakepayments
2throughasecureidentityverificationsystemthatusesascanofauniquephysical
3characteristicidentifiabletotheindividualshallalsoacceptatleastoneofthefollowing
4alternativepaymentmethods:
5 (1)CashinUnitedStatescurrency;
6 (2)Checkormoneyorder;
7 (3)Validdebitcardorcreditcard;or
8 (4)Electronicpaymentservices.
