HB2604--UNIFORMREALPROPERTYELECTRONICRECORDINGACT SPONSOR: Reedy Thisbillestablishesthe"UniformRealPropertyElectronic RecordingAct",whichallowsfortherecordingofanelectronic formatdocumentratherthanapaperdocument. Italsoallowsan electronicsignaturetoqualifyasasufficientsignature. Such electronicsignaturewillalsosatisfytherequirementfor notarizeddocumentsifthesignaturealsocomplieswiththe requirementsoftheremoteonlinenotarialactsunderChapter486, RSMo.Acountyrecorderofdeedsmayconvertpaperdocumentsinto electronicformforthepurposesofindexing,storing,archiving, andmakingsuchformsaccessibletothepublicandmayalsoaccept feesanddocumentselectronically. Thisbillcreatesthe"ElectronicRecordingCommission"consisting ofninemembersappointedbytheGovernorwiththeadviceand consentoftheSenate,toadoptstandardsandimplementthe provisionsofthisbill. TheprovisionsofthisbillsupersedethefederalElectronic SignaturesinGlobalandNationalCommerceAct,butdonot supersedeSection101(c)oftheActorauthorizeelectronic deliveryofanyofthenoticesdescribedinSection103(b)ofthe Act.ThisbillhasadelayedeffectivedateofJanuary2,2025. ThisbillissimilartoHB2895(2022).
