Thisbilldefines"deceptiveandfraudulentdeepfake"and
"syntheticmedia".
Thebillprohibitsanypersonorentityfrom,within90daysofan
election,distributingasyntheticmediamessageofanycandidate
orpartyforelectiveofficewhowillappearonastateorlocal
ballot.
Thisshallnotapplyifthesyntheticmediaincludesadisclaimer
statingthatithasbeenmanipulatedorgeneratedbyartificial
intelligence. Thenatureofthedisclaimerisspecifiedinthe
bill.
Thisshallalsonotapplytoabroadcasteriftheyacknowledge
throughcontentoradisclosurethattherearequestionsaboutthe
authenticityofthemedia,iftheyacknowledgethatapublication
doesnotaccuratelyrepresentthespeechorconductofthe
candidate,ifagoodfaithefforthasbeenmadetoestablishthat
thebroadcastisnotadeepfake,ortomediathatconstitutes
satireorparody.
Acandidatewhoisharmedbyaviolationofthissectionmayseek
injunctiveorotherequitablereliefprohibitingthepublicationof
thedeepfake.
