No. 3031H.01I Bill No. HB 2668 Page 3 of April 16, 2024 HWC:LR:OD FISCAL ANALYSIS ASSUMPTION §650.575 – Missouri Patrol on Wave Runners Task Force Officials from the Missouri Senate (SEN) state the SEN anticipates a negative fiscal impact to reimburse 2 Senators for travel to Missouri Patrol on Wave Runners Task Force meetings. It is assumed meetings will be held in Jefferson City during the interim. It will cost approximately $335.36 per meeting. The SEN assumes no fiscal responsibility for other council members. Oversight has no information to the contrary. Although the legislation does not specify the number of meeting the task force is to have, Oversight assumes the SEN will have sufficient appropriations to cover the minimal cost associated with 2 senators attending meetings and will present no fiscal impact for the SEN. Officials from the Missouri House of Representatives (MHR) state the MHR will absorb any reasonable expenses of members serving on the task force. Therefore, the MHR assumes this proposal will have no fiscal impact on their organization. Oversight notes the provisions of the proposal provide for the creation of the Missouri Patrol on Wave Runners Tax Force Fund. This fund is to consist of moneys appropriated by the General Assembly and any gifts, contributions, grants and bequests received from federal, private and other sources. It is unknown how much funding this fund will receive. Funds are to be used to employ law enforcement officers and first responders to actively patrol lakes meeting specified requirements, enforce state laws/regulations, deter unsafe/unlawful activities, provide first responder services, promote water/boating safety and provide public education. In addition, the task force is to establish a personal watercraft patrol training program. This program is to sunset five years after the effective date of this section unless reauthorized. Oversight notes the provisions of this proposal are subject to appropriations and will present an impact of $0 or (Unknown) costs to the General Revenue Fund. Oversight further assumes appropriations, gifts, contributions, etc. and expenses will net to $0 for fiscal note purposes. Officials from the Department of Health and Senior Services, the Department of Public Safety (DPS) – Director’s Office and Missouri Highway Patrol and the Office of the State Treasurer each assume the proposal will have no fiscal impact on their respective organizations. FISCAL DESCRIPTION This bill creates the "Missouri Patrol on Wave Runners (MO-POWR) Task Force", for the purpose of establishing a law enforcement and first responder personal watercraft patrol in the Lake of the Ozarks. The task force will include voting and nonvoting members. Voting members include, among others: two members of the Senate, one to be appointed by the President Pro Tem of the Senate and one to be appointed by the Minority Floor Leader of the Senate; two members of the House of Representatives, one to be appointed by the Speaker of the House and one to be appointed by the Minority Floor Leader of the House; and representatives from specified law enforcement agencies and fire protection districts. Nonvoting members include a representative from the Missouri State Highway Patrol (MSHP), Water Patrol Division; a representative from the Department of Public Safety; and a member of the general public. The task force must hold its initial meeting prior to October 1, 2024, and its members will serve without compensation. The task force will employ law enforcement officers and first responders to actively patrol the Lake of the Ozarks on personal watercrafts, and the duties of the personal watercraft patrol are described in the bill. The task force will establish a personal watercraft patrol training program, and the task force will establish membership requirements for participating in the patrol. The Water Patrol Division of the State Highway Patrol will remain the principal law enforcement entity on the Lake of the Ozarks and the personal watercraft patrol will cooperate with the Water Patrol in all personal watercraft patrol activities conducted on the Lake of the Ozarks. Members of the personal watercraft patrol who are law enforcement officers will have the power of arrest and will carry firearms while serving. The bill creates the "Missouri Patrol on Wave Runners Task Force Fund", and the funds will be used to implement the personal watercraft patrol. The provisions of the bill sunset five years after the effective date. This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space. L.R.
