32 (1)Iftheoffenderhasonepreviousprisoncommitmenttothedepartmentof
33correctionsforafelonyoffense,theminimumprisontermwhichtheoffendermustserveshall
34befortypercentofhisorhersentenceoruntiltheoffenderattainsseventyyearsofage,and
35hasservedatleastthirtypercentofthesentenceimposed,whicheveroccursfirst;
36 (2)Iftheoffenderhastwopreviousprisoncommitmentstothedepartmentof
37correctionsforfeloniesunrelatedtothepresentoffense,theminimumprisontermwhichthe
38offendermustserveshallbefiftypercentofhisorhersentenceoruntiltheoffenderattains

51 [4.]5.Forthepurposeofdeterminingtheminimumprisontermtobeserved,the
52followingcalculationsshallapply:
53 (1)Asentenceoflifeshallbecalculatedtobethirtyyears;

60 [6.Anoffenderwhowasconvictedof,orpledguiltyto,afelonyoffenseotherthan
61thoseoffenseslistedinsubsection2ofthissectionpriortoAugust28,2019,shallnolonger
62besubjecttotheminimumprisontermprovisionsundersubsection2ofthissection,andshall
63beeligibleforparole,conditionalrelease,orotherearlyreleasebythedepartmentof
64correctionsaccordingtotherulesandregulationsofthedepartment.]
65 7.(1)Asentencingadvisorycommissionisherebycreatedtoconsistofeleven
66members.Onemembershallbeappointedbythespeakerofthehouse.Onemembershallbe
67appointedbythepresidentprotemofthesenate.Onemembershallbethedirectorofthe
68departmentofcorrections.Sixmembersshallbeappointedbyandserveatthepleasureofthe
69governorfromamongthefollowing:thepublicdefendercommission;privatecitizens;a
70privatememberoftheMissouriBar;theboardofprobationandparole;andaprosecutor.
71Twomembersshallbeappointedbythesupremecourt,onefromametropolitanareaandone
72fromaruralarea.Allmembersshallbeappointedtoafour-yearterm.Allmembersofthe
73sentencingcommissionappointedpriortoAugust28,1994,shallcontinuetoserveonthe
74sentencingadvisorycommissionatthepleasureofthegovernor.
75 (2)Thecommissionshallstudysentencingpracticesinthecircuitcourtsthroughout
76thestateforthepurposeofdeterminingwhetherandtowhatextentdisparitiesexistamong
77thevariouscircuitcourtswithrespecttothelengthofsentencesimposedandtheuseof
78probationforoffendersconvictedofthesameorsimilaroffensesandwithsimilarcriminal
79histories.Thecommissionshallalsostudyandexaminewhetherandtowhatextent
80sentencingdisparityamongeconomicandsocialclassesexistsinrelationtothesentenceof
81deathandifso,thereasonstherefor,ifsentencesarecomparabletootherstates,ifthelength
82ofthesentenceisappropriate,andtherateofrehabilitationbasedonsentence.Itshall
83compilestatistics,examinecases,drawconclusions,andperformotherdutiesrelevanttothe
84researchandinvestigationofdisparitiesindeathpenaltysentencingamongeconomicand
85socialclasses.
86 (3)Thecommissionshallstudyalternativesentences,prisonworkprograms,work
87release,home-basedincarceration,probationandparoleoptions,andanyotherprogramsand
88reportthefeasibilityoftheseoptionsinMissouri.
89 (4)Thegovernorshallselectachairpersonwhoshallcallmeetingsofthecommission
90asrequiredorpermittedpursuanttothepurposeofthesentencingcommission.
HB2770	3 91 (5)Themembersofthecommissionshallnotreceivecompensationfortheirduties
92onthecommission,butshallbereimbursedforactualandnecessaryexpensesincurredinthe
93performanceofthesedutiesandforwhichtheyarenotreimbursedbyreasonoftheirother
94paidpositions.
95 (6)Thecircuitandassociatecircuitcourtsofthisstate,theofficeofthestatecourts
96administrator,thedepartmentofpublicsafety,andthedepartmentofcorrectionsshall
97cooperatewiththecommissionbyprovidinginformationoraccesstoinformationneededby
98thecommission.Theofficeofthestatecourtsadministratorwillprovideneededstaffing
99resources.
100 8.Courtsshallretaindiscretiontolowerorexceedthesentencerecommendedbythe
101commissionasotherwiseallowablebylaw,andtoorderrestorativejusticemethods,when
102applicable.
103 9.Iftheimpositionorexecutionofasentenceissuspended,thecourtmayorderany
104orallofthefollowingrestorativejusticemethods,oranyothermethodthatthecourtfinds
105justorappropriate:
106 (1)Restitutiontoanyvictimorastatutorilycreatedfundforcostsincurredasaresult
107oftheoffender'sactions;
108 (2)Offendertreatmentprograms;
109 (3)Mandatorycommunityservice;
110 (4)Workreleaseprogramsinlocalfacilities;and
111 (5)Community-basedresidentialandnonresidentialprograms.
112 10.Pursuanttosubdivision(1)ofsubsection9ofthissection,thecourtmayorderthe
113assessmentandpaymentofadesignatedamountofrestitutiontoacountylawenforcement
114restitutionfundestablishedbythecountycommissionpursuanttosection50.565.Such
115contributionshallnotexceedthreehundreddollarsforanychargedoffense.Anyrestitution
116moneysdepositedintothecountylawenforcementrestitutionfundpursuanttothissection
117shallonlybeexpendedpursuanttotheprovisionsofsection50.565.
118 11.Ajudgemayorderpaymenttoarestitutionfundonlyifsuchfundhadbeen
119createdbyordinanceorresolutionofacountyofthestateofMissouripriortosentencing.A
120judgeshallnothaveanydirectsupervisoryauthorityoradministrativecontroloveranyfund
121towhichthejudgeisorderingapersontomakepayment.
122 12.Apersonwhofailstomakeapaymenttoacountylawenforcementrestitution
123fundmaynothavehisorherprobationrevokedsolelyforfailingtomakesuchpayment
124unlessthejudge,afterevidentiaryhearing,makesafindingsupportedbyapreponderanceof
125theevidencethatthepersoneitherwillfullyrefusedtomakethepaymentorthattheperson
126willfully,intentionally,andpurposefullyfailedtomakesufficientbonafideeffortstoacquire
127theresourcestopay.
HB2770	4 128 13.Nothinginthissectionshallbeconstruedtoallowthesentencingadvisory
129commissiontoissuerecommendedsentencesinspecificcasespendinginthecourtsofthis
130state.
566.030.1.Apersoncommitstheoffenseofrapeinthefirstdegreeifheorshehas
2sexualintercoursewithanotherpersonwhoisincapacitated,incapableofconsent,orlacksthe
3capacitytoconsent,orbytheuseofforciblecompulsion.Forciblecompulsionincludesthe
4useofasubstanceadministeredwithoutavictim'sknowledgeorconsentwhichrendersthe
5victimphysicallyormentallyimpairedsoastobeincapableofmakinganinformedconsent
6tosexualintercourse.
7 2.Theoffenseofrapeinthefirstdegreeoranattempttocommitrapeinthefirst
8degreeisafelonyforwhichtheauthorizedtermofimprisonmentislifeimprisonmentora
9termofyearsnotlessthanfiveyears,unless:
10 (1)Theoffenseisanaggravatedsexualoffense,inwhichcasetheauthorizedtermof
11imprisonmentislifeimprisonmentoratermofyearsnotlessthanfifteenyears;
12 (2)Thepersonisapersistentorpredatorysexualoffenderasdefinedinsection
13566.125andsubjectedtoanextendedtermofimprisonmentundersaidsection;
14 (3)Thevictimisachildlessthantwelveyearsofage,inwhichcasetherequiredterm
15ofimprisonmentislifeimprisonmentwithouteligibilityforprobationorparoleuntilthe
16offenderhasservednotlessthanthirtyyearsofsuchsentenceorunlesstheoffenderhas
17reachedtheageofseventy-fiveyearsandhasservedatleastfifteenyearsofsuchsentence,
18unlesssuchrapeinthefirstdegreeisdescribedundersubdivision(4)ofthissubsection;or
19 (4)Thevictimisachildlessthantwelveyearsofageandsuchrapeinthefirstdegree
20orattempttocommitrapeinthefirstdegreewasoutrageouslyorwantonlyvile,horribleor
21inhumane,inthatitinvolvedtortureordepravityofmind,inwhichcasetherequiredtermof
22imprisonmentislifeimprisonmentwithouteligibilityforprobation,paroleorconditional
23release.
24 3.Subsection[4]5ofsection558.019shallnotapplytothesentenceofapersonwho
25hasbeenfoundguiltyofrapeinthefirstdegreeorattempttocommitrapeinthefirstdegree
26whenthevictimislessthantwelveyearsofage,and"lifeimprisonment"shallmean
27imprisonmentforthedurationofaperson'snaturallifeforthepurposesofthissection.
28 4.Nopersonfoundguiltyofrapeinthefirstdegreeoranattempttocommitrapein
29thefirstdegreeshallbegrantedasuspendedimpositionofsentenceorsuspendedexecutionof
30sentence.
566.060.1.Apersoncommitstheoffenseofsodomyinthefirstdegreeifheorshe
2hasdeviatesexualintercoursewithanotherpersonwhoisincapacitated,incapableofconsent,
3orlacksthecapacitytoconsent,orbytheuseofforciblecompulsion.Forciblecompulsion
4includestheuseofasubstanceadministeredwithoutavictim'sknowledgeorconsentwhich

6informedconsenttosexualintercourse.
7 2.Theoffenseofsodomyinthefirstdegreeoranattempttocommitsodomyinthe
8firstdegreeisafelonyforwhichtheauthorizedtermofimprisonmentislifeimprisonmentor
9atermofyearsnotlessthanfiveyears,unless:
10 (1)Theoffenseisanaggravatedsexualoffense,inwhichcasetheauthorizedtermof
11imprisonmentislifeimprisonmentoratermofyearsnotlessthantenyears;
12 (2)Thepersonisapersistentorpredatorysexualoffenderasdefinedinsection
13566.125andsubjectedtoanextendedtermofimprisonmentundersaidsection;
14 (3)Thevictimisachildlessthantwelveyearsofage,inwhichcasetherequiredterm
15ofimprisonmentislifeimprisonmentwithouteligibilityforprobationorparoleuntilthe
16offenderhasservednotlessthanthirtyyearsofsuchsentenceorunlesstheoffenderhas
17reachedtheageofseventy-fiveyearsandhasservedatleastfifteenyearsofsuchsentence,
18unlesssuchsodomyinthefirstdegreeisdescribedundersubdivision(4)ofthissubsection;or
19 (4)Thevictimisachildlessthantwelveyearsofageandsuchsodomyinthefirst
20degreeorattempttocommitsodomyinthefirstdegreewasoutrageouslyorwantonlyvile,
21horribleorinhumane,inthatitinvolvedtortureordepravityofmind,inwhichcasethe
22requiredtermofimprisonmentislifeimprisonmentwithouteligibilityforprobation,paroleor
23conditionalrelease.
24 3.Subsection[4]5ofsection558.019shallnotapplytothesentenceofapersonwho
25hasbeenfoundguiltyofsodomyinthefirstdegreeoranattempttocommitsodomyinthe
26firstdegreewhenthevictimislessthantwelveyearsofage,and"lifeimprisonment"shall
27meanimprisonmentforthedurationofaperson'snaturallifeforthepurposesofthissection.
28 4.Nopersonfoundguiltyofsodomyinthefirstdegreeoranattempttocommit
29sodomyinthefirstdegreeshallbegrantedasuspendedimpositionofsentenceorsuspended
30executionofsentence.
566.125.1.Thecourtshallsentenceapersontoanextendedtermofimprisonmentif
2itfindsthedefendantisapersistentsexualoffenderandhasbeenfoundguiltyofattempting
3tocommitorcommittingthefollowingoffenses:
4 (1)Statutoryrapeinthefirstdegreeorstatutorysodomyinthefirstdegree;
5 (2)Rapeinthefirstdegreeorsodomyinthefirstdegree;
6 (3)Forciblerape;
7 (4)Forciblesodomy;
8 (5)Rape;
9 (6)Sodomy.
10 2.A"persistentsexualoffender"isonewhohaspreviouslybeenfoundguiltyof
11attemptingtocommitorcommittinganyoftheoffenseslistedinsubsection1ofthissection
HB2770	6 12oronewhohaspreviouslybeenfoundguiltyofanoffenseinanyotherjurisdictionwhich
13wouldconstituteanyoftheoffenseslistedinsubsection1ofthissection.
14 3.Thetermofimprisonmentforonefoundtobeapersistentsexualoffendershallbe
15imprisonmentforlifewithouteligibilityforprobationorparole.Subsection[4]5ofsection
16558.019shallnotapplytoanypersonimprisonedunderthissubsection,and"imprisonment
17forlife"shallmeanimprisonmentforthedurationoftheperson'snaturallife.
18 4.Thecourtshallsentenceapersontoanextendedtermofimprisonmentasprovided
19forinthissectionifitfindsthedefendantisapredatorysexualoffenderandhasbeenfound
20guiltyofcommittingorattemptingtocommitanyoftheoffenseslistedinsubsection1ofthis
21sectionorcommittingchildmolestationinthefirstorseconddegreeorsexualabusewhen
22classifiedasaclassBfelony.
23 5.Forpurposesofthissection,a"predatorysexualoffender"isapersonwho:
24 (1)Haspreviouslybeenfoundguiltyofcommittingorattemptingtocommitanyof
25theoffenseslistedinsubsection1ofthissection,orcommittingchildmolestationinthefirst
26orseconddegree,orsexualabusewhenclassifiedasaclassBfelony;or
27 (2)Haspreviouslycommittedanactwhichwouldconstituteanoffenselistedin
28subsection4ofthissection,whetherornottheactresultedinaconviction;or
29 (3)Hascommittedanactoractsagainstmorethanonevictimwhichwouldconstitute
30anoffenseoroffenseslistedinsubsection4ofthissection,whetherornotthedefendantwas
31chargedwithanadditionaloffenseoroffensesasaresultofsuchactoracts.
32 6.Apersonfoundtobeapredatorysexualoffendershallbeimprisonedforlifewith
33eligibilityforparole,howeversubsection[4]5ofsection558.019shallnotapplytopersons
34foundtobepredatorysexualoffendersforthepurposesofdeterminingtheminimumprison
35termorthelengthofsentenceasdefinedorusedinsuchsubsection.Notwithstandingany
36otherprovisionoflaw,innoeventshallapersonfoundtobeapredatorysexualoffender
37receiveafinaldischargefromparole.
38 7.Notwithstandinganyotherprovisionoflaw,thecourtshallsettheminimumtime
39requiredtobeservedbeforeapredatorysexualoffenderiseligibleforparole,conditional
40releaseorotherearlyreleasebythedepartmentofcorrections.Theminimumtimetobe
41servedbyapersonfoundtobeapredatorysexualoffenderwho:
42 (1)Haspreviouslybeenfoundguiltyofcommittingorattemptingtocommitanyof
43theoffenseslistedinsubsection1ofthissectionandisfoundguiltyofcommittingor
44attemptingtocommitanyoftheoffenseslistedinsubsection1ofthissectionshallbeany
45numberofyearsbutnotlessthanthirtyyears;
46 (2)Haspreviouslybeenfoundguiltyofchildmolestationinthefirstorsecond
47degree,orsexualabusewhenclassifiedasaclassBfelonyandisfoundguiltyofattempting

49numberofyearsbutnotlessthanfifteenyears;

59subsection5ofthissectionshallbeanynumberofyearswithintherangetowhichtheperson
60couldhavebeensentencedpursuanttotheapplicablelawifthepersonwasnotfoundtobea
61predatorysexualoffender.
62 8.Notwithstandinganyprovisionoflawtothecontrary,thedepartmentof
63corrections,oranydivisionthereof,maynotfurloughanindividualfoundtobeandsentenced
64asapersistentsexualoffenderorapredatorysexualoffender.
566.210.1.Apersoncommitstheoffenseofsexualtraffickingofachildinthefirst
2degreeifheorsheknowingly:
3 (1)Recruits,entices,harbors,transports,provides,orobtainsbyanymeans,including
4butnotlimitedtothroughtheuseofforce,abduction,coercion,fraud,deception,blackmail,
5orcausingorthreateningtocausefinancialharm,apersonundertheageoftwelveto
6participateinacommercialsexact,asexualperformance,ortheproductionofexplicitsexual
7materialasdefinedinsection573.010,orbenefits,financiallyorbyreceivinganythingof
8value,fromparticipationinsuchactivities;
9 (2)Causesapersonundertheageoftwelvetoengageinacommercialsexact,a
10sexualperformance,ortheproductionofexplicitsexualmaterialasdefinedinsection
11573.010;or
12 (3)Advertisestheavailabilityofapersonundertheageoftwelvetoparticipateina
13commercialsexact,asexualperformance,ortheproductionofexplicitsexualmaterialas
14definedinsection573.010.
15 2.Itshallnotbeadefensethatthedefendantbelievedthatthepersonwastwelve
16yearsofageorolder.
17 3.Theoffenseofsexualtraffickingofachildinthefirstdegreeisafelonyforwhich
18theauthorizedtermofimprisonmentislifeimprisonmentwithouteligibilityforprobationor
19paroleuntiltheoffenderhasservednotlessthantwenty-fiveyearsofsuchsentence.
20Subsection[4]5ofsection558.019shallnotapplytothesentenceofapersonwhohasbeen
