HB2796--PROTECTINGMISSOURI'SECONOMYDURINGASHUTDOWNORDER SPONSOR: Murphy Thisbillestablishesthe"ProtectingMissouri'sSmallBusinesses Act". ThebillrequirestheStateanditspoliticalsubdivisionstogive carefulconsiderationandappropriateconcernforthelasting effectsofactionstakenduringa"shutdownorder"asdefinedin thebill. ThebillspecifiesthatbeginningJanuary1,2025,ifanypolitical subdivisionwithjurisdictionoverabusinessimplementsashutdown orderandthebusinessclosesdueonlytotheshutdownorderforat least21consecutivedaysoratleast45cumulativedays,the followingrequirementsapply: (1)Waivinganyfeeforabusinesslicenseduringtheperiodof theshutdownorderorsixmonths,whicheverislonger;and (2)Reducingtherealandpersonalpropertytaxliabilityofthe businessbasedonthenumberofdaysthebusinesswasshutdownin agivenyear,asspecifiedinthebill. Ifataxpayerrentsorleasesalloraportionofthetaxpayer's affectedrealpropertytooneormorerentersorlessors,the taxpayermustdistributeaprorataamountofthereducedliability torentersorlessorswhoarecurrentonallleaseorrental payments. Thisbillisnottobeconstruedtoaffectprofessional licensureanddoesnotrequiretheStatetoproviderestitutionor toreplacelostrevenuestoapoliticalsubdivision. ThisbillisthesameasHCSHB1263(2023).
