2facilityorsolidwastedisposalareaofasolidwastemanagementsystemwithoutfirst 3obtaininganoperatingpermitfromthedepartment.Itshallbeunlawfulforanypersonto 4constructasolidwasteprocessingfacilityorsolidwastedisposalareawithoutfirstobtaining 5aconstructionpermitfromthedepartmentpursuanttothissection.Acurrentauthorizationto 6operateissuedbythedepartmentpursuanttosections260.200to260.345shallbeconsidered 7tobeapermittooperateforpurposesofthissectionforallsolidwastedisposalareasand 8processingfacilitiesexistingonAugust28,1995.Apermitshallnotbeissuedforasanitary 9landfilltobelocatedinafloodarea,asdeterminedbythedepartment,wherefloodwatersare 10likelytosignificantlyerodefinalcover.Apermitshallnotberequiredtooperateawaste 11stabilizationlagoon,settlingpondorotherwatertreatmentfacilitywhichhasavalidpermit 12fromtheMissouricleanwatercommissioneventhoughthefacilitymayreceivesolidor 13semisolidwastematerials. 14 2.Nopersonoroperatormayapplyfororobtainapermittoconstructasolidwaste 15disposalareaunlessthepersonhasrequestedthedepartmenttoconductapreliminarysite 16investigationandobtainedpreliminaryapprovalfromthedepartment.Thedepartmentshall, EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17withinsixtydaysofsuchrequest,conductapreliminaryinvestigationandapproveor 18disapprovethesite. 19 3.Allproposedsolidwastedisposalareasforwhichapreliminarysiteinvestigation 20requestpursuanttosubsection2ofthissectionisreceivedbythedepartmentonorafter 21August28,1999,shallbesubjecttoapublicinvolvementactivityaspartofthepermit 22applicationprocess.Theactivityshallconsistofthefollowing: 23 (1)Theapplicantshallnotifythepublicofthepreliminarysiteinvestigationapproval 24withinthirtydaysafterthereceiptofsuchapproval.Suchpublicnotificationshallbeby 25certifiedmailtothegoverningbodyofthecountyorcityinwhichtheproposeddisposalarea 26istobelocatedandbycertifiedmailtothesolidwastemanagementdistrictinwhichthe 27proposeddisposalareaistobelocated; 28 (2)Withinninetydaysafterthepreliminarysiteinvestigationapproval,the 29departmentshallconductapublicawarenesssessioninthecountyinwhichtheproposed 30disposalareaistobelocated.Thedepartmentshallprovidepublicnoticeofsuchsessionby 31bothprintedandbroadcastmediaatleastthirtydayspriortosuchsession.Printed 32notificationshallincludepublicationinatleastonenewspaperhavinggeneralcirculation 33withinthecountyinwhichtheproposeddisposalareaistobelocated.Broadcastnotification 34shallincludepublicserviceannouncementsonradiostationsthathavebroadcastcoverage 35withinthecountyinwhichtheproposeddisposalareaistobelocated.Theintentofsuch 36publicawarenesssessionshallbetoprovidegeneralinformationtointerestedcitizensonthe 37designandoperationofsolidwastedisposalareas; 38 (3)Atleastsixtydayspriortothesubmissiontothedepartmentofareportonthe 39resultsofadetailedsiteinvestigationpursuanttosubsection4ofthissection,theapplicant 40shallconductacommunityinvolvementsessioninthecountyinwhichtheproposeddisposal 41areaistobelocated.Departmentstaffshallattendanysuchsession.Theapplicantshall 42providepublicnoticeofsuchsessionbybothprintedandbroadcastmediaatleastthirtydays 43priortosuchsession.Printednotificationshallincludepublicationinatleastonenewspaper 44havinggeneralcirculationwithinthecountyinwhichtheproposeddisposalareaistobe 45located.Broadcastnotificationshallincludepublicserviceannouncementsonradiostations 46thathavebroadcastcoveragewithinthecountyinwhichtheproposeddisposalareaistobe 47located.Suchpublicnoticesshallincludetheaddressesoftheapplicantandthedepartment 48andinformationonapubliccommentperiod.Suchpubliccommentperiodshallbeginonthe 49dayofthecommunityinvolvementsessionandcontinueforatleastthirtydaysaftersuch 50session.Theapplicantshallrespondtoallpersonssubmittingcommentsduringthepublic 51commentperiodnomorethanthirtydaysafterthereceiptofsuchcomments; HB2801 2 52 (4)Ifaproposedsolidwastedisposalareaistobelocatedinacountyorcitythathas 53localplanningandzoningrequirements,theapplicantshallnotberequiredtoconducta 54communityinvolvementsessionifthefollowingconditionsaremet: 55 (a)Thelocalplanningandzoningrequirementsincludeapublicmeeting; 56 (b)Theapplicantnotifiesthedepartmentofintenttoutilizesuchmeetinginlieuof 57thecommunityinvolvementsessionatleastthirtydayspriortosuchmeeting; 58 (c)Therequirementsofsuchmeetingincludeprovidingpublicnoticebyprintedor 59broadcastmediaatleastthirtydayspriortosuchmeeting; 60 (d)Suchmeetingisheldatleastthirtydayspriortothesubmissiontothedepartment 61ofareportontheresultsofadetailedsiteinvestigationpursuanttosubsection4ofthis 62section; 63 4.Nopersonmayapplyfororobtainapermittoconstructasolidwastedisposalarea 69unlessthepersonhassubmittedtothedepartmentaplanforconductingadetailedsurfaceand 70subsurfacegeologicandhydrologicinvestigationandhasobtainedgeologicandhydrologic 71siteapprovalfromthedepartment.Thedepartmentshallapproveordisapprovetheplan 72withinthirtydaysofreceipt.Theapplicantshallconducttheinvestigationpursuanttothe 73planandsubmittheresultstothedepartment.Thedepartmentshallprovideapprovalor 74disapprovalwithinsixtydaysofreceiptoftheinvestigationresults. 75 5.(1)Everypersondesiringtoconstructasolidwasteprocessingfacilityorsolid 76wastedisposalareashallmakeapplicationforapermitonformsprovidedforthispurposeby 77thedepartment.Everyapplicantshallsubmitevidenceoffinancialresponsibilitywiththe 78application.Anyapplicantwhoreliesinpartuponaparentcorporationforthisdemonstration 79shallalsosubmitevidenceoffinancialresponsibilityforthatcorporationandanyother 80subsidiarythereof. 81 (2)Everyapplicantshallprovideafinancialassuranceinstrumentorinstrumentsto 82thedepartmentpriortothegrantingofaconstructionpermitforasolidwastedisposalarea. 83Thefinancialassuranceinstrumentorinstrumentsshallbeirrevocable,meetallrequirements 84establishedbythedepartmentandshallnotbecancelled,revoked,disbursed,releasedor 85allowedtoterminatewithouttheapprovalofthedepartment.Afterthecessationofactive 86operationofasanitarylandfill,orothersolidwastedisposalareaasdesignedbythe 87department,neithertheguarantornortheoperatorshallcancel,revokeordisbursethe HB2801 3 88financialassuranceinstrumentorallowtheinstrumenttoterminateuntiltheoperatoris 89releasedfrompostclosuremonitoringandcareresponsibilitiespursuanttosection260.227. 90 (3)Theapplicantforapermittoconstructasolidwastedisposalareashallprovide 91thedepartmentwithplans,specifications,andsuchotherdataasmaybenecessarytocomply 92withthepurposeofsections260.200to260.345.Theapplicationshalldemonstrate 93compliancewithallapplicablelocalplanningandzoningrequirements.Thedepartmentshall 94makeaninvestigationofthesolidwastedisposalareaanddeterminewhetheritcomplieswith 95theprovisionsofsections260.200to260.345andtherulesandregulationsadoptedpursuant 96tosections260.200to260.345.Withintwelveconsecutivemonthsofthereceiptofan 97applicationforaconstructionpermitthedepartmentshallapproveordenytheapplication. 98Thedepartmentshallissuerulesandregulationsestablishingtimelimitsforpermit 99modificationsandrenewalofapermitforasolidwastedisposalarea.Thetimelimitshallbe 100consistentwiththischapter. 101 (4)Theapplicantforapermittoconstructasolidwasteprocessingfacilityshall 102providethedepartmentwithplans,specificationsandsuchotherdataasmaybenecessaryto 103complywiththepurposeofsections260.200to260.345.Withinonehundredeightydaysof 104receiptoftheapplication,thedepartmentshalldeterminewhetheritcomplieswiththe 105provisionsofsections260.200to260.345.Withintwelveconsecutivemonthsofthereceipt 106ofanapplicationforapermittoconstructanincineratorasdescribedinthedefinitionofsolid 107wasteprocessingfacilityinsection260.200oramaterialrecoveryfacilityasdescribedinthe 108definitionofsolidwasteprocessingfacilityinsection260.200,andwithinsixmonthsfor 109permitmodifications,thedepartmentshallapproveordenytheapplication.Permitsissued 110forsolidwastefacilitiesshallbefortheanticipatedlifeofthefacility. 111 (5)Ifthedepartmentfailstoapproveordenyanapplicationforapermitorapermit 112modificationwithinthetimelimitsspecifiedinsubdivisions(3)and(4)ofthissubsection,the 113applicantmaymaintainanactioninthecircuitcourtofColeCountyorthatofthecountyin 114whichthefacilityislocatedoristobesited.Thecourtshallorderthedepartmenttoshow 115causewhyithasnotactedonthepermitandthecourtmay,uponthepresentationofevidence 116satisfactorytothecourt,orderthedepartmenttoissueordenysuchpermitorpermit 117modification.Permitsforsolidwastedisposalareas,whetherissuedbythedepartmentor 118orderedtobeissuedbyacourt,shallbefortheanticipatedlifeofthefacility. 119 (6)Theapplicantforapermittoconstructasolidwasteprocessingfacilityshallpay 120anapplicationfeeofonethousanddollars.Uponcompletionofthedepartment'sevaluation 121oftheapplication,butbeforereceivingapermit,theapplicantshallreimbursethedepartment 122forallreasonablecostsincurredbythedepartmentuptoamaximumoffourthousanddollars. 123Theapplicantforapermittoconstructasolidwastedisposalareashallpayanapplicationfee 124oftwothousanddollars.Uponcompletionofthedepartment'sevaluationsoftheapplication, HB2801 4 125butbeforereceivingapermit,theapplicantshallreimbursethedepartmentforallreasonable 126costsincurredbythedepartmentuptoamaximumofeightthousanddollars.Applicantswho 127withdrawtheirapplicationbeforethedepartmentcompletesitsevaluationshallberequiredto 128reimbursethedepartmentforcostsincurredintheevaluation.Thedepartmentshallnot 129collectthefeesauthorizedinthissubdivisionunlessitcomplieswiththetimelimits 130establishedinthissection. 131 (7)Whenthereviewrevealsthatthefacilityorareadoesconformwiththeprovisions 132ofsections260.200to260.345andtherulesandregulationsadoptedpursuanttosections 133260.200to260.345,thedepartmentshallapprovetheapplicationandshallissueapermitfor 134theconstructionofeachsolidwasteprocessingfacilityorsolidwastedisposalareaasset 135forthintheapplicationandwithanypermittermsandconditionswhichthedepartmentdeems 136appropriate.Intheeventthatthefacilityorareafailstomeettherulesandregulations 137adoptedpursuanttosections260.200to260.345,thedepartmentshallissueareporttothe 138applicantstatingthereasonfordenialofapermit. 139 6.Plans,designs,andrelevantdatafortheconstructionofsolidwasteprocessing 140facilitiesandsolidwastedisposalareasshallbesubmittedtothedepartmentbyaregistered 141professionalengineerlicensedbythestateofMissouriforapprovalpriortotheconstruction, 142alterationoroperationofsuchafacilityorarea. 143 7.(1)Anypersonoroperatorasdefinedinsection260.200whointendstoobtaina 144constructionpermitinasolidwastemanagementdistrictwithanapprovedsolidwaste 145managementplanshallrequestarecommendationinsupportoftheapplicationfromthe 146executiveboardcreatedinsection260.315.Theexecutiveboardshallconsidertheimpactof 147theproposalon,andtheextenttowhichtheproposalconformsto,theapproveddistrictsolid 148wastemanagementplanpreparedpursuanttosection260.325.Theexecutiveboardshallact 149upontherequestforarecommendationwithinsixtydaysofreceiptandshallsubmita 150resolutiontothedepartmentspecifyingitspositionanditsrecommendationregarding 151conformityoftheapplicationtothesolidwasteplan.Theboard'sfailuretosubmita 152resolutionconstitutesrecommendationoftheapplication.Thedepartmentmayconsiderthe 153application,regardlessoftheboard'sactionthereonandmaydenytheconstructionpermitif 154theapplicationfailstomeettherequirementsofsections260.200to260.345,orifthe 155applicationisinconsistentwiththedistrict'ssolidwastemanagementplan. 156 (2)Onceapprovalofthedetailedsiteinvestigationhasbeengrantedbythe 157departmentundersubsection4ofthissection,thepermitprocessshallbeheldin 158abeyanceuntilthedepartmenthascompletedandpublishedanupdateofthestatewide 159solidwastemanagementplanrequiredundersubdivision(4)ofsubsection1ofsection 160260.225.Thissubdivisionshallapplyonlytoapplicationsthathavenotreceived 161detailedsiteinvestigationapprovalsbeforeAugust28,2024. HB2801 5 162 8.Ifthesiteproposedforasolidwastedisposalareaisnotownedbytheapplicant, 163theownerorownersofthesiteshallacknowledgethatanapplicationpursuanttosections 164260.200to260.345istobesubmittedbysignatureorsignaturesthereon.Thedepartment 165shallprovidetheownerwithcopiesofallcommunicationwiththeoperator,including 166inspectionreportsandordersissuedpursuanttosection260.230. 167 9.Thedepartmentshallnotissueapermitfortheoperationofasolidwastedisposal 168areadesignedtoserveacitywithapopulationofgreaterthanfourhundredthousandlocated 169inmorethanonecounty,ifthesiteislocatedwithinone-halfmileofanadjoining 170municipality,withouttheapprovalofthegoverningbodyofsuchmunicipality.The 171governingbodyshallconductapublichearingwithinfifteendaysofnotice,shallpublicize 172thehearinginatleastonenewspaperhavinggeneralcirculationinthemunicipality,andshall 173votetoapproveordisapprovethelanddisposalfacilitywithinthirtydaysafterthecloseofthe 174hearing. 175 10.(1)Uponreceiptofanapplicationforapermittoconstructasolidwaste 176processingfacilityordisposalarea,thedepartmentshallnotifythepublicofsuchreceipt: 177 (a)Bylegalnoticepublishedinanewspaperofgeneralcirculationintheareaofthe 178proposeddisposalareaorprocessingfacility; 179 (b)Bycertifiedmailtothegoverningbodyofthecountyorcityinwhichthe 180proposeddisposalareaorprocessingfacilityistobelocated;and 181 (c)Bymailtothelastknownaddressofallrecordownersofcontiguousrealproperty 182orrealpropertylocatedwithinonethousandfeetoftheproposeddisposalareaand,fora 183proposedprocessingfacility,noticeasprovidedinsection64.875orsection89.060, 184whicheverisapplicable. 185 (2)Ifanapplicationforaconstructionpermitmeetsallstatutoryandregulatory 186requirementsforissuance,apublichearingonthedraftpermitshallbeheldbythedepartment 187inthecountyinwhichtheproposedsolidwastedisposalareaistobelocatedpriortothe 188issuanceofthepermit.Thedepartmentshallprovidepublicnoticeofsuchhearingbyboth 189printedandbroadcastmediaatleastthirtydayspriortosuchhearing.Printednotification 190shallincludepublicationinatleastonenewspaperhavinggeneralcirculationwithinthe 191countyinwhichtheproposeddisposalareaistobelocated.Broadcastnotificationshall 192includepublicserviceannouncementsonradiostationsthathavebroadcastcoveragewithin 193thecountyinwhichtheproposeddisposalareaistobelocated. 194 11.Aftertheissuanceofaconstructionpermitforasolidwastedisposalarea,but 195priortothebeginningofdisposaloperations,theownerandthedepartmentshallexecutean 196easementtoallowthedepartment,itsagentsoritscontractorstoenterthepremisesto 197completeworkspecifiedintheclosureplan,ortomonitorormaintainthesiteortotake 198remedialactionduringthepostclosureperiod.Afterissuanceofaconstructionpermitfora HB2801 6 199solidwastedisposalarea,butpriortothebeginningofdisposaloperations,theownershall 200submitevidencethatsuchownerhasrecorded,intheofficeoftherecorderofdeedsinthe 201countywherethedisposalareaislocated,anoticeandcovenantrunningwiththelandthatthe 202propertyhasbeenpermittedasasolidwastedisposalareaandprohibitsuseofthelandinany 203mannerwhichinterfereswiththeclosureand,whereappropriate,postclosureplansfiledwith 204thedepartment. 205 12.Everypersondesiringtoobtainapermittooperateasolidwastedisposalareaor 206processingfacilityshallsubmitapplicableinformationandapplyforanoperatingpermitfrom 207thedepartment.Thedepartmentshallreviewtheinformationanddetermine,withinsixty 208daysofreceipt,whetheritcomplieswiththeprovisionsofsections260.200to260.345and 209therulesandregulationsadoptedpursuanttosections260.200to260.345.Whenthereview 210revealsthatthefacilityorareadoesconformwiththeprovisionsofsections260.200to 211260.345andtherulesandregulationsadoptedpursuanttosections260.200to260.345,the 212departmentshallissueapermitfortheoperationofeachsolidwasteprocessingfacilityor 213solidwastedisposalareaandwithanypermittermsandconditionswhichthedepartment 214deemsappropriate.Intheeventthatthefacilityorareafailstomeettherulesandregulations 215adoptedpursuanttosections260.200to260.345,thedepartmentshallissueareporttothe 216applicantstatingthereasonfordenialofapermit. 217 13.Eachsolidwastedisposalarea,exceptutilitywastelandfillsunlessotherwiseand 218totheextentrequiredbythedepartment,andthosesolidwasteprocessingfacilities 219designatedbyrule,shallbeoperatedunderthedirectionofacertifiedsolidwastetechnician 220inaccordancewithsections260.200to260.345andtherulesandregulationspromulgated 221pursuanttosections260.200to260.345. 222 14.Basedataforthequalityandquantityofgroundwaterinthesolidwastedisposal 223areashallbecollectedandsubmittedtothedepartmentpriortotheoperationofanewor 224expansionofanexistingsolidwastedisposalarea.Basedatashallincludeachemical 225analysisofgroundwaterdrawnfromtheproposedsolidwastedisposalarea. 226 15.Leachatecollectionandremovalsystemsshallbeincorporatedintonewor 227expandedsanitarylandfillswhicharepermittedafterAugust13,1986.Thedepartmentshall 228assesstheneedforaleachatecollectionsystemforalltypesofsolidwastedisposalareas, 229otherthansanitarylandfills,andtheneedformonitoringwellswhenitevaluatesthe 230applicationforallneworexpandedsolidwastedisposalareas.Thedepartmentmayrequire 231anoperatorofasolidwastedisposalareatoinstallaleachatecollectionsystembeforethe 232beginningofdisposaloperations,atanytimeduringdisposaloperationsforunfilledportions 233ofthearea,orforanyportionofthedisposalareaasapartofaremedialplan.The 234departmentmayrequiretheoperatortoinstallmonitoringwellsbeforethebeginningof 235disposaloperationsoratanytimeduringtheoperationallifeorpostclosurecareperiodifit HB2801 7 236concludesthatconditionsattheareawarrantsuchmonitoring.Theoperatorofademolition 237landfillorutilitywastelandfillshallnotberequiredtoinstallaleachatecollectionand 238removalsystemormonitoringwellsunlessotherwiseandtotheextentthedepartmentso 239requiresbasedonhazardouswastecharacteristiccriteriaorsitespecificgeohydrological 240characteristicsorconditions. 241 16.Permitsgrantedbythedepartment,asprovidedinsections260.200to260.345, 242shallbesubjecttosuspensionforadesignatedperiodoftime,civilpenaltyorrevocation 243wheneverthedepartmentdeterminesthatthesolidwasteprocessingfacilityorsolidwaste 244disposalareais,orhasbeen,operatedinviolationofsections260.200to260.345ortherules 245orregulationsadoptedpursuanttosections260.200to260.345,orhasbeenoperatedin 246violationofanypermittermsandconditions,oriscreatingapublicnuisance,healthhazard, 247orenvironmentalpollution.Intheeventapermitissuspendedorrevoked,thepersonnamed 248inthepermitshallbefullyinformedastothereasonsforsuchaction. 249 17.Eachpermitforoperationofafacilityorareashallbeissuedonlytotheperson 250namedintheapplication.Permitsaretransferableasamodificationtothepermit.An 251applicationtotransferownershipshallidentifytheproposedpermittee.Adisclosure 252statementfortheproposedpermitteelistingviolationscontainedinthedefinitionof 253disclosurestatementfoundinsection260.200shallbesubmittedtothedepartment.The 254operationanddesignplansforthefacilityorareashallbeupdatedtoprovidecompliancewith 255thecurrentlyapplicablelawandrules.Afinancialassuranceinstrumentinsuchanamount 256andformasprescribedbythedepartmentshallbeprovidedforsolidwastedisposalareasby 257theproposedpermitteepriortotransferofthepermit.Thefinancialassuranceinstrumentof 258theoriginalpermitteeshallnotbereleaseduntilthenewpermittee'sfinancialassurance 259instrumenthasbeenapprovedbythedepartmentandthetransferofownershipiscomplete. 260 18.ThosesolidwastedisposalareaspermittedonJanuary1,1996,shall,upon 261submissionofarequestforpermitmodification,begrantedasolidwastemanagementarea 262operatingpermitiftherequestmeetsreasonablerequirementssetoutbythedepartment. 263 19.Incaseapermitrequiredpursuanttothissectionisdeniedorrevoked,theperson 264mayrequestahearinginaccordancewithsection260.235. 265 20.Everyapplicantforapermitshallfileadisclosurestatementwiththeinformation 266requiredbyandonaformdevelopedbythedepartmentofnaturalresourcesatthesametime 267theapplicationforapermitisfiledwiththedepartment. 268 21.Uponrequestofthedirectorofthedepartmentofnaturalresources,theapplicant 269forapermit,anypersonthatcouldreasonablybeexpectedtobeinvolvedinmanagement 270activitiesofthesolidwastedisposalareaorsolidwasteprocessingfacility,oranypersonwho 271hasacontrollinginterestinanypermitteeshallberequiredtosubmittoacriminal 272backgroundcheckundersection43.543. HB2801 9 308 26.Anycounty,district,municipality,authority,orotherpoliticalsubdivisionofthis 309statewhichownsandoperatesasanitarylandfillshallbeexemptfromtherequirementforthe 310filingofthedisclosurestatementandannualupdatetothedisclosurestatement. 311 27.Anypersonseekingapermittooperateasolidwastedisposalarea,asolidwaste 312processingfacility,oraresourcerecoveryfacilityshall,concurrentlywiththefilingofthe 313applicationforapermit,discloseanyconvictionsinthisstate,countyorcounty-equivalent 314publichealthorlanduseordinancesrelatedtothemanagementofsolidwaste.Ifthe 315departmentfindsthattherehasbeenacontinuingpatternofadjudicatedviolationsbythe 316applicant,thedepartmentmaydenytheapplication. 317 28.Nopermittoconstructorpermittooperateshallberequiredpursuanttothis 318sectionforanyutilitywastelandfilllocatedinacountyofthethirdclassificationwitha 319townshipformofgovernmentwhichhasapopulationofatleasteleventhousandinhabitants 320andnomorethantwelvethousandfivehundredinhabitantsaccordingtothemostrecent 321decennialcensus,ifsuchutilitywastelandfillcomplieswithalldesignandoperating 322standardsandclosurerequirementsapplicabletoutilitywastelandfillspursuanttosections 323260.200to260.345andprovidedthatnowastedisposedofatsuchutilitywastelandfillis 324consideredhazardouswastepursuanttotheMissourihazardouswastelaw. 325 29.Advancedrecyclingfacilitiesarenotsubjecttotherequirementsofthissectionas 326longasthefeedstocksreceivedbysuchfacilityaresource-separatedordivertedorrecovered 327frommunicipalorotherwastestreamspriortoacceptanceattheadvancedrecyclingfacility. 260.225.1.Thedepartmentshalladministersections260.200to260.345to 2maximizetheamountofrecoveredmaterialsandtominimizedisposalofsolidwastein 3sanitarylandfills.Thedepartmentshall,throughitsrulesandregulations,policiesand 4programs,encouragetothemaximumextentpractical,theuseofalternativestodisposal.To 5accomplishtheseobjectives,thedepartmentshall: 6 (1)Administerthestatesolidwastemanagementprogrampursuanttotheprovisions 7ofsections260.200to260.345; 8 (2)Cooperatewithappropriatefederal,state,andlocalunitsofgovernmentofthisor 9anyotherstate,andwithappropriateprivateorganizationsincarryingoutitsauthorityunder 10sections260.200to260.345; 11 (3)Promulgateandadopt,afterpublichearing,suchrulesandregulationsrelatingto 12solidwastemanagementsystemsasshallbenecessarytocarryoutthepurposesand 13provisionsofsections260.200to260.345; 14 (4)Developastatewidesolidwastemanagementplanincooperationwithlocal 15governments,regionalplanningcommissions,districts,andappropriatestateagencies; 16 (5)Providetechnicalassistancetocities,counties,districts,andauthorities; 17 (6)Developandconductamandatorysolidwastetechniciantrainingcourseofstudy; HB2801 10 18 (7)Conductandcontractforresearchandinvestigationsintheoverallareaofsolid 19wastestorage,collection,recycling,recovery,processing,transportationanddisposal, 20including,butnotlimitedto,newandnovelprocedures; 21 (8)Subjecttoappropriationbythegeneralassembly,establishcriteriaforawarding 22state-fundedsolidwastemanagementgrantstocities,counties,anddistricts,allocatefunds, 23andmonitortheproperexpenditureoffunds; 24 (9)Issuesuchpermitsandordersandconductsuchinspectionsasmaybenecessary 25toimplementtheprovisionsofsections260.200to260.345andtherulesandregulations 26adoptedpursuanttosections260.200to260.345; 27 (10)Initiate,conductandsupportresearch,demonstrationprojects,andinvestigations 28withapplicablefederalprogramspertainingtosolidwastemanagementsystems; 29 (11)Contractwithcities,counties,districtsandotherpersonstoactasitsagentin 30carryingouttheprovisionsofsections260.200to260.345underproceduresandconditionsas 31thedepartmentshallprescribe. 32 2.Thedepartmentshallpreparemodelsolidwastemanagementplanssuitablefor 33ruralandurbanareaswhichmaybeusedbydistricts,countiesandcities.Inpreparingthe 34modelplans,thedepartmentshallconsiderthefindingsandrecommendationsofthestudyof 35resourcerecoveryconductedpursuanttosection260.038,andotherrelevantinformation. 36Theplansshallconformwiththerequirementsofsection260.220andsection260.325and 37shall: 38 (1)Emphasizewastereductionandrecycling; 39 (2)Provideforeconomicalwastemanagementthroughregionalanddistrict 40cooperation; 41 (3)Bedesignedtoachieveareductionoffortypercentinsolidwastedisposed,by 42weight,byJanuary1,1998; 43 (4)Establishameanstomeasuretheamountofreductioninsolidwastedisposal; 44 (5)Providefortheeliminationofsmallquantitiesofhazardouswaste,including 45householdhazardouswaste,fromthesolidwastestream;and 46 (6)Bedesignedtoguideplanningindistricts,citiesandcountiesincludingcitiesand 47countiesnotwithinadistrict. 48 3.Themodelplanshallbedistributedtotheexecutiveboardofeachsolidwaste 49districtandtocountiesandcitiesnotwithinadistrictbyDecember1,1991. 50 4.Noruleorportionofarulepromulgatedundertheauthorityofsections260.200to 51260.345shallbecomeeffectiveunlessithasbeenpromulgatedpursuanttotheprovisionsof 52section536.024. 53 5.Incoordinationwithotherappropriatestateagencies,including,butnotlimitedto, 54thedivisionofcommerceandindustrialdevelopment,theofficeofadministration,the HB2801 11 55environmentalimprovementandenergyresourceauthority,andthepublicservice 56commission,thedepartmentshallperformthefollowingdutiesinordertopromote 57resourcerecoveryinthestateinwayswhichareeconomicallyfeasible: 58 (1)Identifymarketsforrecoveredmaterialsandforenergywhichcouldbeproduced 59fromsolidwasteandhouseholdhazardouswaste; 60 (2)Providetechnicalassistancepertainingtoallaspectsofresourcerecoverytocities, 61counties,districts,industriesandotherpersons; 62 (3)Identifyopportunitiesforresourcerecoveryprogramsinstategovernmentand 63initiateactionstoimplementsuchprograms; 64 (4)Expandstatecontractsforprocurementofitemsmadefromrecoveredmaterials; 65 (5)Initiaterecyclingprogramswithinstategovernment; 66 (6)Provideaclearinghouseofconsumerinformationregardingtheneedtosupport 67resourcerecovery,utilizeanddevelopnewresourcerecoveryprogramsaroundexisting 68enterprises,requestandpurchaserecycledproducts,participateinresourceconservation 69activitiesandotherrelevantissues; 70 (7)Identifybarrierstoresourcerecoveryandresourceconservation,andpropose 71remediestothesebarriers;and 72 (8)Initiateactivitieswithappropriatestateandlocalentitiestodevelopmarketsfor 73recoveredmaterials. ✔ HB2801 12
