HB2880--JUVENILEOFFENSES SPONSOR: Murphy Thisbillspecifiesthatthejuvenilecourtwillhaveconcurrent jurisdictionwiththecircuitcourtoveranychildwhoisalleged tohavecommittedanoffensethatwouldbeclassifiedasaclassB felonyorhigherifcommittedbyanadult. Thebillspecifiesthatifapetitionallegesthatanychild committedtheoffenseofunlawfulpossessionofafirearmoranyof theoffenseslistedinthebillifcommittedbyanadult,orhas committedanoffenseinwhichthechildusedafirearminthe commissionoftheoffenseandsuchoffensewouldbeconsidereda felonyifcommittedbyanadult,thecourtmustorderahearing. Thisbillspecifiesthatidentifyinginformationofachildmaybe releasedtothepublicifthechildescapedwhileincustodyforan offensethatwouldbeconsideredafelonyoffenseifcommittedby anadult. Thebillspecifiesthatapersoncommitsunlawfulpossessionofa firearmifsuchpersonknowinglyhasanyfirearminhisorher possessionandsuchpersonisunder18andhasbeenadjudicateda delinquentforcommittinganoffensethatwouldbeconsidereda felonyoffenseifcommittedbyanadult. Thisbillspecifiesthatapersonwhoisaparentorguardianofa childcommitstheoffenseoffailuretosuperviseachildin possessionofafirearmif: (1)Thechildhasbeenadjudicatedasadelinquent; (2)Thepersonknowinglysells,leases,loans,givesaway,or deliversafirearmtothechild; (3)Thepersonknowinglyfailstosupervisethechild;and (4)Thechildusesthefirearminthecommissionofanoffenseor causesseriousbodilyinjuryordeathresultingfromtheuseofthe firearm. Failuretosuperviseachildinpossessionofafirearmisaclass Amisdemeanor,unlessthatchildcausesseriousbodilyinjuryor deathresultingfromuseofthefirearm,inwhichcasetheoffense isaclassDfelony.
