JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSections2and3of
ArticleVIIIoftheConstitutionofMissouri,andadoptingfournewsectionsinlieu
thereofrelatingtoelections.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2024,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleVIIIoftheConstitutionofthestate
5ofMissouri:
SectionA.Sections2and3,ArticleVIII,ConstitutionofMissouri,arerepealedand
2fournewsectionsadoptedinlieuthereof,tobeknownasSections2,3,24,and25,toreadas
3follows:
Section2.[All]OnlycitizensoftheUnitedStates,includingoccupantsofsoldiers'
2andsailors'homes,overtheageofeighteenwhoareresidentsofthisstateandofthepolitical
3subdivisioninwhichtheyoffertovoteareentitledtovoteatallelectionsbythepeople,ifthe
4electionisoneforwhichregistrationisrequirediftheyareregisteredwithinthetime
5prescribedbylaw,oriftheelectionisoneforwhichregistrationisnotrequired,iftheyhave
6beenresidentsofthepoliticalsubdivisioninwhichtheyoffertovoteforthirtydaysnext
7precedingtheelectionforwhichtheyoffertovote:Providedhowever,nopersonwhohasa
8guardianofhisorherestateorpersonbyreasonofmentalincapacity,appointedbyacourtof

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 9competentjurisdictionandnopersonwhoisinvoluntarilyconfinedinamentalinstitution
10pursuanttoanadjudicationofacourtofcompetentjurisdictionshallbeentitledtovote,and
11personsconvictedoffelony,orcrimeconnectedwiththeexerciseoftherightofsuffragemay
12beexcludedbylawfromvoting.
Section3.Allelectionsbythepeopleshallbebypaperballotorbyanymechanical
2methodprescribedbylaw.Votersshallhaveonlyasinglevoteforeachissueonwhich
3suchvoteriseligibletovote.Votersshallhavethesamenumberofvotesforanofficeas
4thenumberofopenseatstobeelectedtosuchofficeatthatelection.Allelectionofficers
5shallbeswornoraffirmednottodisclosehowanyvotervoted;provided,thatincasesof
6contestedelections,grandjuryinvestigationsandinthetrialofallcivilorcriminalcasesin
7whichtheviolationofanylawrelatingtoelections,includingnominatingelections,isunder
8investigationoratissue,suchofficersmayberequiredtotestifyandtheballotscastmaybe
9opened,examined,counted,andreceivedasevidence.
Section24.1.Thepersonreceivingthegreatestnumberofvotesataprimary
2electionasapartycandidateforanofficeshallbetheonlycandidateforthatpartyfor
3theofficeatthegeneralelection.Thenameofsuchcandidateshallbeplacedonthe
4officialballotatthegeneralelectionunlessremovedorreplacedasprovidedbylaw.
5 2.Thepersonreceivingthegreatestnumberofvotesatthegeneralelectionshall
6bedeclaredthewinner.
Section25.1.Intheeventthatvotingmachinesareusedforthepurposeof
2countingandtabulatingresults,suchmachinesshallbetestedandcertifiedassecurein
3accordancewithfederalstandardspriortoeachelectioninwhichthemachineswillbe
4used.
5 2.Thissectionshallnotbeconstruedtorequireanyelectionauthority,
6jurisdiction,oranyofficeradministeringelectionsinthisstatetousevotingmachines
7forthepurposeofcountingandtabulatingvotesinanyelectionconductedinthisstate
8unlessotherwiserequiredbylaw.Thegeneralassemblymay,bylaw,requireor
9prohibittheuseofanyvotingmachine.
SectionB.Pursuanttochapter116,andotherapplicableconstitutionalprovisionsand
2lawsofthisstateallowingthegeneralassemblytoadoptballotlanguageforthesubmissionof
3thisjointresolutiontothevotersofthisstate,theofficialsummarystatementofthis
4resolutionshallbeasfollows:
5 "ShalltheMissouriConstitutionbeamendedto:
6 •AllowonlycitizensoftheUnitedStatestovote;
7 •Ensurethatvotersshallhaveonlyonevoteperissueoropenseat;
8 •Prohibitelectionsthroughtherankingofcandidates;and
