5contaminants,ortolimitorpreventintroductionofwatercontaminantsintopubliclyowned 6treatmentworksorfacilitiesasrequiredunderanyfederalwaterpollutioncontrolact, 7throughoutthestateandthereaftermaymodifysuchregulationsfromtimetotime. 8 2.Anylandapplicationofindustrialwastewater,industrialwastewater 9treatmentsludge,andrelatedprocesswastes,excludingconcentratedanimalfeeding 10operations,livestockmarkets,andanimalmanure,shallbesubjecttoanutrient 11managementtechnicalstandardestablishedandincorporatedintorulebythe 12department,whichshallincludelandapplicationpractices,annualsoilsampling, 13setbacks,materialsamplingrequirementsandfrequency,andaprocessforestablishing 14landapplicationrates.Thenutrientmanagementtechnicalstandardshallallowtheuse 15ofaphosphorusindexdevelopedbyMissouri'sfirstlandgrantuniversity,regardlessof 16operationalcontroloverlandapplicationfields.Suchphosphorusindexshallberevised 17foreachannualplannedapplicationofsuchmaterialandinclude,butshallnotbe 18limitedto,datainputsforfielduse,fieldslope,fieldmanagementpractices,application 19method,soiltype,phosphorussoiltest,phosphorussolubility,andtillagetype.Results 20ofanysamplingrequiredunderthissubsectionshallbeprovidedtothedepartment. 21Suchrulesshallaffordaprudentdegreeofenvironmentalprotectiondesignedtoensure 22safeandcleansoilsandwaterforthesurroundingcommunitywhileaccommodating 23modernagriculturalpractices.Anyruleorportionofarule,asthattermisdefinedin 24section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 25becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter 26536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable 27andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to 28review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently 29heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor 30adoptedaftertheeffectivedateofthisact,shallbeinvalidandvoid. 31 3.Theprovisionsofsubsection2ofthissectionshallnotapplytoland 32applicationconductedincompliancewithalandapplicationmanagementplan 33approvedbythedepartment. 644.051.1.Itisunlawfulforanyperson: 2 (1)Tocausepollutionofanywatersofthestateortoplaceorcauseorpermittobe 3placedanywatercontaminantinalocationwhereitisreasonablycertaintocausepollutionof 4anywatersofthestate; 5 (2)Todischargeanywatercontaminantsintoanywatersofthestatewhichreducethe 6qualityofsuchwatersbelowthewaterqualitystandardsestablishedbythecommission; HCSSSSCSSB1351 6 7 (3)Toviolateanypretreatmentandtoxicmaterialcontrolregulations,ortodischarge 8anywatercontaminantsintoanywatersofthestatewhichexceedeffluentregulationsor 9permitprovisionsasestablishedbythecommissionorrequiredbyanyfederalwaterpollution 10controlact; 11 (4)Todischargeanyradiological,chemical,orbiologicalwarfareagentorhigh-level 12radioactivewasteintothewatersofthestate. 13 2.Itshallbeunlawfulforanypersontooperate,useormaintainanywater 14contaminantorpointsourceinthisstatethatissubjecttostandards,rulesorregulations 15promulgatedpursuanttotheprovisionsofsections644.006to644.141unlesssuchperson 16holdsanoperatingpermitfromthecommission,subjecttosuchexceptionsasthecommission 17mayprescribebyruleorregulation.However,nooperatingpermitshallberequiredofany 18personforanyemissionintopubliclyownedtreatmentfacilitiesorintopubliclyownedsewer 19systemstributarytopubliclyownedtreatmentworks. 20 3.Itshallbeunlawfulforanypersontoconstruct,build,replaceormakemajor 21modificationtoanypointsourceorcollectionsystemthatisprincipallydesignedtoconveyor 22dischargehumansewagetowatersofthestate,unlesssuchpersonobtainsaconstruction 23permitfromthecommission,exceptasprovidedinthissection.Thefollowingactivitiesshall 24beexcludedfromconstructionpermitrequirements: 25 (1)Facilitiesgreaterthanonemilliongallonsperdaythatareauthorizedthrougha 26localsupervisedprogram,andarenotreceivinganydepartmentfinancialassistance; 27 (2)Allsewerextensionsorcollectionprojectsthatareonethousandfeetinlengthor 28lesswithfewerthantwoliftstations; 29 (3)Allsewercollectionprojectsthatareauthorizedthroughalocalsupervised 30program;and 31 (4)Anyotherexclusionsthecommissionmaypromulgatebyrule. 32 4.Aconstructionpermitmayberequiredbythedepartmentinthefollowing 33circumstances: 34 (1)Substantialdeviationfromthecommission'sdesignstandards; 35 (2)Toaddressnoncompliance; 36 (3)Whenanunauthorizeddischargehasoccurredorhasthepotentialtooccur;or 37 (4)Tocorrectaviolationofwaterqualitystandards. 38 5.Anypointsourcethatproposestoconstructanearthenstoragestructuretohold, 39convey,contain,storeortreatdomestic,agricultural,orindustrialprocesswastewateralso 40shallbesubjecttotheconstructionpermitprovisionsofsubsections3to5ofthissection. 41However,anyearthenbasinconstructedtoretainandsettlenontoxic,nonmetallicearthen 42materialssuchassoil,silt,androckshallbeexemptfromtheconstructionpermitprovisions 43ofsubsections3to5ofthissection.Allotherconstruction-relatedactivitiesatpointsources HCSSSSCSSB1351 7 44notsubjecttosubsections3to5ofthissectionshallbeexemptfromtheconstructionpermit 45requirements.Allactivitiesthatareexemptedfromtheconstructionpermitrequirementare 46subjecttothefollowingconditions: 47 (1)Anypointsourcesystemdesignedtohold,convey,contain,storeortreat 48domestic,agriculturalorindustrialprocesswastewatershallbedesignedbyaprofessional 49engineerregisteredinMissouriinaccordancewiththecommission'sdesignrules; 50 (2)Suchpointsourcesystemshallbeconstructedinaccordancewiththeregistered 51professionalengineer'sdesignandplans;and 52 (3)Suchpointsourcesystemmayreceiveapost-constructionsiteinspectionbythe 53departmentpriortoreceivingoperatingpermitapproval.Asiteinspectionmaybeperformed 54bythedepartment,uponreceiptofacompleteoperatingpermitapplicationorsubmissionof 55anengineer'sstatementofworkcomplete. 56 6.Notwithstandinganyprovisionofthissectiontothecontrary,thecommission 57mayexemptanentityfromtherequirementtoobtainapermitunderthissectionbased 58onlicensureundertheMissourifertilizerlaw,sections266.291to266.351,onlyifthe 59entityisproducingproductsthatarecommerciallysoldtoanenduserinaccordance 60withsuchsectionsandhasaccuratelabelingforeachcontainerthatincludesthe 61informationrequiredundersubsection1ofsection266.321. 62 7.Entitiescurrentlystoringcombinedbulkfertilizersinstoragebasinsshallnot 63beexemptfromanydesignrequirementsforagrichemicalfacilitiesestablishedbyrule 64whenconstructingnewagrichemicalfacilities. 65 8.(1)Inordertoreceiveanoperatingpermitunderthissection,anypoint 66sourceoroperatinglocationseekinganoperatingpermitforacommingledoffsite 67industrialwastewaterorwastewaterresidualsopenstoragebasinoropenstoragevessel 68shallmeetcurrentdesignrequirementsforawastewatertreatmentfacility'sdesign 69capacity. 70 (2)Exceptasprovidedinsubdivision(3)ofthissubsection,thedepartmentshall 71requireatleast,butnotmorethan,thefollowingbufferdistancesbetweenthenearest 72commingledoffsiteindustrialwastewaterorwastewaterresidualsopenstoragebasinor 73openstoragevesselandanypublicbuildingoroccupiedresidenceotherthanapublic 74buildingoroccupiedresidencethatisoperatedbythecommingledoffsiteindustrial 75wastewaterorwastewaterresidualsopenstoragebasinoropenstoragevesselora 76residencefromwhichawrittenagreementforoperationisobtained: 77 (a)Forafacilitywithacapacityofmorethanfivehundredthousandgallonsbut 78lessthanorequaltofivemilliongallons,onethousandfeet; 79 (b)Forafacilitywithacapacityofmorethanfivemilliongallonsbutlessthan 80orequaltotenmilliongallons,twothousandfeet;and HCSSSSCSSB1351 8 81 (c)Forafacilitywithacapacityofmorethantenmilliongallons,threethousand 82fivehundredfeet. 83 (3)Allcommingledoffsiteindustrialwastewaterorwastewaterresidualsopen 84storagebasinsoropenstoragevesselsholdingvalidoperatingpermitsasoftheeffective 85dateofthissectionshallbeexemptfromthebufferdistancesprescribedinsubdivision 86(2)ofthissubsection.Suchdistancesshallnotapplytoafacilitythathasreceiveda 87writtenagreementsignedbyallaffectedpropertyownerswithintherelevantbuffer 88distance. 89 (4)Thedepartmentshallrequiregroundwatermonitoringonasite-specificbasis 90when,inthedeterminationofthedivisionofgeologicalsurvey,thecommingledoffsite 91industrialwastewaterandwastewaterresidualsopenstoragebasinoropenstorage 92vesselislocatedinproximitytoageologicalfeaturethatincreasesthelikelihoodof 93groundwatercontamination. 94 (5)(a)Thedepartmentshallestablishbyrulesamplingrequirementsfor 95commingledoffsiteindustrialwastewaterandwastewaterresidualsopenstoragebasins 96oropenstoragevesselsbasedonpermittedmaterials. 97 (b)Thedepartmentshall,withinsixtydaysoftheeffectivedateofthissection, 98begintheprocessofpromulgatingrules,whichshallincludecreatingachainofcustody 99recordformtobeusedbyallpartiesduringthehandlingoftestingsamples,and,ata 100minimum,establishcriteriatorequiremonthlysamplingandtestingofanycontentsof 101anycommingledoffsiteindustrialwastewaterorwastewaterresidualsopenstorage 102basinoropenstoragevesselfor: 103 a.Thetotalconcentrationsofmetals,includingarsenic,aluminum,barium, 104cadmium,chromium,copper,lead,mercury,selenium,silver,andthallium;and 105 b.E.coliandfecalcoliform. 106 (c)Testingunderparagraph(b)ofthissubdivisionshallbedonebyathird-party 107certifiedlaboratoryandresultsofthetestingshallbesenttothedepartmentbythe 108third-partycertifiedlaboratoryannually. 109 9.Agovernmentalunitmayapplytothedepartmentforauthorizationtooperatea 110localsupervisedprogram,andthedepartmentmayauthorizesuchaprogram.Alocal 111supervisedprogramwouldrecognizethegovernmentalunit'sengineeringcapacityandability 115suchnotices,conductsuchhearings,andconsidersuchfactors,commentsand 116recommendationsasrequiredbysections644.006to644.141oranyfederalwater 117pollutioncontrolact.Thedirectorshalldetermineifanystateoranyprovisionsofany HCSSSSCSSB1351 9 118federalwaterpollutioncontrolactthestateisrequiredtoenforce,anystateorfederaleffluent 119limitationsorregulations,waterquality-relatedeffluentlimitations,nationalstandardsof 120performance,toxicandpretreatmentstandards,orwaterqualitystandardswhichapplytothe 121source,oranysuchstandardsinthevicinityofthesource,arebeingexceeded,andshall 122determinetheimpactonsuchwaterqualitystandardsfromthesource.Thedirector,inorder 123toeffectuatethepurposesofsections644.006to644.141,shalldenyapermitifthesource 124willviolateanysuchacts,regulations,limitationsorstandardsorwillappreciablyaffectthe 125waterqualitystandardsorthewaterqualitystandardsarebeingsubstantiallyexceeded,unless 126thepermitisissuedwithsuchconditionsastomakethesourcecomplywithsuch 127requirementswithinanacceptabletimeschedule. 128 [8.]11.Thedirectorshallgrantordenythepermitwithinsixtydaysafterall 129requirementsoftheFederalWaterPollutionControlActconcerningissuanceofpermitshave 130beensatisfiedunlesstheapplicationdoesnotrequireanypermitpursuanttoanyfederalwater 131pollutioncontrolact.Thedirectororthecommissionmayrequiretheapplicanttoprovide 132andmaintainsuchfacilitiesortoconductsuchtestsandmonitoreffluentsasnecessaryto 133determinethenature,extent,quantityordegreeofwatercontaminantdischargedorreleased 134fromthesource,establishandmaintainrecordsandmakereportsregardingsuch 135determination. 136 [9.]12.Thedirectorshallpromptlynotifytheapplicantinwritingofhisorheraction 137andifthepermitisdeniedstatethereasonsforsuchdenial.Asprovidedbysections621.250 138and640.013,theapplicantmayappealtotheadministrativehearingcommissionfromthe 139denialofapermitorfromanyconditioninanypermitbyfilingapetitionwiththe 140administrativehearingcommissionwithinthirtydaysofthenoticeofdenialorissuanceofthe 141permit.Afterafinalactionistakenonaneworreissuedgeneralpermit,apotentialapplicant 142forthegeneralpermitwhocandemonstratethatheorsheisormaybeadverselyaffectedby 143anypermittermorconditionmayappealthetermsandconditionsofthegeneralpermit 144withinthirtydaysofthedepartment'sissuanceofthegeneralpermit.Innoeventshalla 145permitconstitutepermissiontoviolatethelaworanystandard,ruleorregulationpromulgated 146pursuantthereto.Oncetheadministrativehearingcommissionhasreviewedtheappeal,the 147administrativehearingcommissionshallissuearecommendeddecisiontothecommissionon 148permitissuance,denial,oranyconditionofthepermit.Thecommissionshallissueitsown 149decision,basedontheappeal,forpermitissuance,denial,oranyconditionofthepermit.If 150thecommissionchangesafindingoffactorconclusionoflawmadebytheadministrative 151hearingcommission,ormodifiesorvacatesthedecisionrecommendedbytheadministrative 152hearingcommission,itshallissueitsowndecision,whichshallincludefindingsoffactand 153conclusionsoflaw.Thecommissionshallmailcopiesofitsfinaldecisiontothepartiestothe 154appealortheircounselofrecord.Thecommission'sdecisionshallbesubjecttojudicial HCSSSSCSSB1351 10 155reviewpursuanttochapter536,exceptthatthecourtofappealsdistrictwithterritorial 156jurisdictioncoextensivewiththecountywherethepointsourceistobelocatedshallhave 157originaljurisdiction.Nojudicialreviewshallbeavailableuntilandunlessalladministrative 158remediesareexhausted. 159 [10.]13.Inanyhearingheldpursuanttothissectionthatinvolvesapermit,license,or 160registration,theburdenofproofisonthepartyspecifiedinsection640.012.Anydecisionof 161thecommissionmadepursuanttoahearingheldpursuanttothissectionissubjecttojudicial 162reviewasprovidedinsection644.071. 163 [11.]14.Inanyevent,nopermitissuedpursuanttothissectionshallbeissuedif 164properlyobjectedtobythefederalgovernmentoranyagencyauthorizedtoobjectpursuantto 165anyfederalwaterpollutioncontrolactunlesstheapplicationdoesnotrequireanypermit 166pursuanttoanyfederalwaterpollutioncontrolact. 167 [12.]15.Permitsmaybemodified,reissued,orterminatedattherequestofthe 168permittee.Allrequestsshallbeinwritingandshallcontainfactsorreasonssupportingthe 169request. 170 [13.]16.Nomanufacturingorprocessingplantoroperatinglocationshallberequired 171topaymorethanoneoperatingfee.Operatingpermitsshallbeissuedforaperiodnotto 172exceedfiveyearsafterdateofissuance,exceptthatgeneralpermitsshallbeissuedforafive- 173yearperiod,andalsoexceptthatneitheraconstructionnoranannualpermitshallberequired 174forasingleresidence'swastetreatmentfacilities.Applicationsforrenewalofasite-specific 175operatingpermitshallbefiledatleastonehundredeightydayspriortotheexpirationofthe 176existingpermit.Applicationsseekingtorenewcoverageunderageneralpermitshallbe 177submittedatleastthirtydayspriortotheexpirationofthegeneralpermit,unlessthepermittee 178hasbeennotifiedbythedirectorthatanearlierapplicationmustbemade.Generalpermits 179maybeappliedforandissuedelectronicallyoncemadeavailablebythedirector. 180 [14.]17.Everypermitissuedtomunicipaloranypubliclyownedtreatmentworksor 181facilityshallrequirethepermitteetoprovidethecleanwatercommissionwithadequate 182noticeofanysubstantialnewintroductionsofwatercontaminantsorpollutantsintosuch 183worksorfacilityfromanysourceforwhichsuchnoticeisrequiredbysections644.006to 184644.141oranyfederalwaterpollutioncontrolact.Suchpermitshallalsorequirethe 185permitteetonotifythecleanwatercommissionofanysubstantialchangeinvolumeor 186characterofwatercontaminantsorpollutantsbeingintroducedintoitstreatmentworksor 187facilitybyasourcewhichwasintroducingwatercontaminantsorpollutantsintoitsworksat 188thetimeofissuanceofthepermit.Noticemustdescribethequalityandquantityofeffluent 189beingintroducedortobeintroducedintosuchworksorfacilitybyasourcewhichwas 190introducingwatercontaminantsorpollutantsintoitsworksatthetimeofissuanceofthe 191permit.Noticemustdescribethequalityandquantityofeffluentbeingintroducedortobe HCSSSSCSSB1351 11 192introducedintosuchworksorfacilityandtheanticipatedimpactofsuchintroductiononthe 193qualityorquantityofeffluenttobereleasedfromsuchworksorfacilityintowatersofthe 194state. 195 [15.]18.Thedirectororthecommissionmayrequirethefilingorpostingofabond 196asaconditionfortheissuanceofpermitsforconstructionoftemporaryorfuturewater 197treatmentfacilitiesorfacilitiesthatutilizeinnovativetechnologyforwastewatertreatmentin 198anamountdeterminedbythecommissiontobesufficienttoensurecompliancewithall 199provisionsofsections644.006to644.141,andanyrulesorregulationsofthecommissionand 200anyconditionastosuchconstructioninthepermit.Forthepurposesofthissection, 201"innovativetechnologyforwastewatertreatment"shallmeanacompletelynewandgenerally 202unproventechnologyinthetypeormethodofitsapplicationthatbenchtestingortheory 203suggesthasenvironmental,efficiency,andcostbenefitsbeyondthestandardtechnologies. 204Nobondshallberequiredfordesignsapprovedbyanyfederalagencyorenvironmental 205regulatoryagencyofanotherstate.Thebondshallbesignedbytheapplicantasprincipal, 206andbyacorporatesuretylicensedtodobusinessinthestateofMissouriandapprovedbythe 207commission.Thebondshallremainineffectuntilthetermsandconditionsofthepermitare 208metandtheprovisionsofsections644.006to644.141andrulesandregulationspromulgated 209pursuanttheretoarecompliedwith. 210 [16.]19.(1)Thedepartmentshallissueordenyapplicationsforconstructionand 211site-specificoperatingpermitsreceivedafterJanuary1,2001,withinonehundredeightydays 212ofthedepartment'sreceiptofanapplication.Forgeneralconstructionandoperatingpermit 213applicationsreceivedafterJanuary1,2001,thatdonotrequireapublicparticipationprocess, 214thedepartmentshallissueordenythepermitswithinsixtydaysofthedepartment'sreceiptof 215anapplication.Foranapplicationseekingcoverageunderarenewedgeneralpermitthatdoes 216notrequireanindividualpublicparticipationprocess,thedirectorshallissueordenythe 217permitwithinsixtydaysofthedirector'sreceiptoftheapplication,oruponissuanceofthe 218generalpermit,whicheverislater.Inregardtoanapplicationseekingcoverageunderan 219initialgeneralpermitthatdoesnotrequireanindividualpublicparticipationprocess,the 220directorshallissueordenythepermitwithinsixtydaysofthedepartment'sreceiptofthe 221application.Foranapplicationseekingcoverageunderarenewedgeneralpermitthat 222requiresanindividualpublicparticipationprocess,thedirectorshallissueordenythepermit 223withinninetydaysofthedirector'sreceiptoftheapplication,oruponissuanceofthegeneral 224permit,whicheverislater.Inregardtoanapplicationforaninitialgeneralpermitthat 225requiresanindividualpublicparticipationprocess,thedirectorshallissueordenythepermit 226withinninetydaysofthedirector'sreceiptoftheapplication. 227 (2)Ifthedepartmentfailstoissueordenywithgoodcauseaconstructionor 228operatingpermitapplicationwithinthetimeframesestablishedinsubdivision(1)ofthis HCSSSSCSSB1351 12 229subsection,thedepartmentshallrefundthefullamountoftheinitialapplicationfeewithin 230forty-fivedaysoffailuretomeettheestablishedtimeframe.Ifthedepartmentfailstorefund 231theapplicationfeewithinforty-fivedays,therefundamountshallaccrueinterestatarate 232establishedpursuanttosection32.065. 233 (3)Permitfeedisputesmaybeappealedtothecommissionwithinthirtydaysofthe 234dateestablishedinsubdivision(2)ofthissubsection.Iftheapplicantprevailsinapermitfee 235disputeappealedtothecommission,thecommissionmayorderthedirectortorefundthe 236applicant'spermitfeeplusinterestandreasonableattorney'sfeesasprovidedinsections 237536.085and536.087.Arefundoftheinitialapplicationorannualfeedoesnotwaivethe 238applicant'sresponsibilitytopayanyannualfeesdueeachyearfollowingissuanceofapermit. 239 (4)NolaterthanDecember31,2001,thecommissionshallpromulgateregulations 240definingshorterreviewtimeperiodsthanthetimeframesestablishedinsubdivision(1)of 241thissubsection,whenappropriate,fordifferentclassesofconstructionandoperatingpermits. 242Innocaseshallcommissionregulationsadoptpermitreviewtimesthatexceedthetime 243framesestablishedinsubdivision(1)ofthissubsection.Thedepartment'sfailuretocomply 244withthecommission'spermitreviewtimeperiodsshallresultinarefundofsaidpermitfees 245assetforthinsubdivision(2)ofthissubsection.Onasemiannualbasis,thedepartmentshall 246submittothecommissionareportwhichdescribesthedifferentclassesofpermitsandreports 247onthenumberofdaysittookthedepartmenttoissueeachpermitfromthedateofreceiptof 248theapplicationandshowaveragesforeachdifferentclassofpermits. 249 (5)Duringthedepartment'stechnicalreviewoftheapplication,thedepartmentmay 250requesttheapplicantsubmitsupplementaloradditionalinformationnecessaryforadequate 251permitreview.Thedepartment'stechnicalreviewlettershallcontainasufficientdescription 252ofthetypeofadditionalinformationneededtocomplywiththeapplicationrequirements. 253 (6)Nothinginthissubsectionshallbeinterpretedtomeanthatinactiononapermit 254applicationshallbegroundstoviolateanyprovisionsofsections644.006to644.141orany 255rulespromulgatedpursuanttosections644.006to644.141. 256 [17.]20.Thedepartmentshallrespondtoallrequestsforindividualcertification 257underSection401oftheFederalCleanWaterActwithinthelesserofsixtydaysorthe 258allowedresponseperiodestablishedpursuanttoapplicablefederalregulationswithoutrequest 259foranextensionperiodunlesssuchextensionisdeterminedbythecommissiontobe 260necessarytoevaluatesignificantimpactsonwaterqualitystandardsandthecommission 261establishesatimetableforcompletionofsuchevaluationinaperiodofnomorethanone 262hundredeightydays. 263 [18.]21.Allpermitfeesgeneratedpursuanttothischaptershallnotbeusedforthe HCSSSSCSSB1351 13 266 [19.]22.Thedepartmentshallimplementpermitshieldprovisionsequivalenttothe 267permitshieldprovisionsimplementedbytheU.S.EnvironmentalProtectionAgencypursuant 268totheCleanWaterAct,Section402(k),33U.S.C.Section1342(k),anditsimplementing 269regulations,forpermitsissuedpursuanttothischapter. 270 [20.]23.Priortothedevelopmentofanewgeneralpermitorreissuanceofageneral 271permitforaquaculture,landdisturbancerequiringastormwaterpermit,orreissuanceofa 272generalpermitunderwhichfiftyormorepermitswereissuedunderageneralpermitduring 273theimmediatelyprecedingfive-yearperiodforadesignatedcategoryofwatercontaminant 274sources,thedirectorshallimplementapublicparticipationprocesscomplyingwiththe 275followingminimumrequirements: 276 (1)Foranewgeneralpermitorreissuanceofageneralpermit,ageneralpermit 277templateshallbedevelopedforwhichcommentsshallbesoughtfrompermitteesandother 278interestedpersonspriortoissuanceofthegeneralpermit; HCSSSSCSSB1351 14 303 (6)Uponissuanceofaneworrenewedgeneralpermit,thegeneralpermitshallbe 304postedtothedepartment'swebsite. 305 [21.]24.Noticesrequiredtobemadebythedepartmentpursuanttosubsection[20] 30623ofthissectionmaybemadebyelectronicmail.Thedepartmentshallnotberequiredto 307makenoticetoanypermitteeorotherpersonwhohasnotprovidedacurrentelectronicmail 308addresstothedepartment.Intheeventthedepartmentchoosestomakematerial 309modificationstothegeneralpermitbeforeitsexpiration,thedepartmentshallfollowthe 310publicparticipationprocessdescribedinsubsection[20]23ofthissection. 644.145.1.Whenissuingpermitsunderthischapterthatincorporateanew 2requirementfordischargesfrompubliclyownedcombinedorseparatesanitaryorstorm 3sewersystemsorwaterorsewertreatmentworks,orwhenenforcingprovisionsofthis 4chapterortheFederalWaterPollutionControlAct,33U.S.C.Section1251,etseq., 5pertainingtoanyportionofapubliclyownedcombinedorseparatesanitaryorstormsewer 6systemorwaterorsewertreatmentworks,thedepartmentofnaturalresourcesshallmakea 7findingofaffordabilityonthecoststobeincurredandtheimpactofanyratechangeson 8ratepayersuponwhichtobasesuchpermitsanddecisions,totheextentallowableunderthis 9chapterandtheFederalWaterPollutionControlAct. 10 2.(1)Thedepartmentofnaturalresourcesshallnotberequiredunderthissectionto 11makeafindingofaffordabilitywhen: 12 (a)Issuingcollectionsystemextensionpermits; 13 (b)IssuingNationalPollutionDischargeEliminationSystemoperatingpermit 14renewalswhichincludenonewenvironmentalrequirements;or 15 (c)Thepermitapplicantcertifiesthattheapplicablerequirementsareaffordableto 16implementorotherwisewaivestherequirementforanaffordabilityfinding;however,atno 17timeshallthedepartmentrequirethatanyapplicantcertify,asaconditiontoapprovingany 18permit,administrativeorcivilaction,thatarequirement,condition,orpenaltyisaffordable. 19 (2)Theexceptionsprovidedunderparagraph(c)ofsubdivision(1)ofthissubsection 20donotapplywhenthecommunitybeingservedhaslessthanthreethousandthreehundred 21residents. 22 3.Whenusedinthischapterandinstandards,rulesandregulationspromulgated 23pursuanttothischapter,thefollowingwordsandphrasesmean: 24 (1)"Affordability",withrespecttopaymentofautilitybill,ameasureofwhetheran 25individualcustomerorhouseholdwithanincomeequaltoorlowerthanthemedian 26householdincomefortheircommunitycanpaythebillwithoutunduehardshipor 27unreasonablesacrificeintheessentiallifestyleorspendingpatternsoftheindividualor 28household,takingintoconsiderationthecriteriadescribedinsubsection4ofthissection; HCSSSSCSSB1351 15 29 (2)"Financialcapability",thefinancialcapabilityofacommunitytomake 30investmentsnecessarytomakewaterquality-relatedimprovements; 31 (3)"Findingofaffordability",adepartmentstatementastowhetheranindividualora 32householdreceivingasincomeanamountequaltoorlowerthanthemedianhousehold 33incomefortheapplicantcommunitywouldberequiredtomakeunreasonablesacrificesinthe 34individual'sorthehousehold'sessentiallifestyleorspendingpatternsorundergohardshipsin 35ordertomaketheprojectedmonthlypaymentsforsewerservices.Thedepartmentshall 36makeastatementthattheproposedchangesmeetthedefinitionofaffordable,orfailtomeet 37thedefinitionofaffordable,orareimplementedasafederalmandateregardlessof 38affordability. 39 4.Thedepartmentofnaturalresourcesshalladoptproceduresbywhichitwillmake 40affordabilityfindingsthatevaluatetheaffordabilityofpermitrequirementsandenforcement 41actionsdescribedinsubsection1ofthissection,andmaybeginimplementingsuch 42procedurespriortopromulgatingimplementingregulations.Thecommissionshallhavethe 43authoritytopromulgaterulestoimplementthissectionpursuanttochapters536and644,and 44shallpromulgatesuchrulesassoonaspracticable.Affordabilityfindingsshallbebasedupon 45reasonablyverifiabledataandshallincludeanassessmentofaffordabilitywithrespectto 46personsorentitiesaffected.Thedepartmentshallofferthepermitteeanopportunitytoreview 47adraftaffordabilityfinding,andthepermitteemaysuggestchangesandprovideadditional 48supportinginformation,subjecttosubsection6ofthissection.Thefindingshallbebased 49uponthefollowingcriteria: 50 (1)Acommunity'sfinancialcapabilityandabilitytoraiseorsecurenecessary 51funding; 52 (2)Affordabilityofpollutioncontroloptionsfortheindividualsorhouseholdsator 53belowthemedianhouseholdincomelevelofthecommunity; 54 (3)Anevaluationoftheoverallcostsandenvironmentalbenefitsofthecontrol 55technologies; 56 (4)Inclusionofongoingcostsofoperatingandmaintainingtheexistingwastewater 57collectionandtreatmentsystem,includingpaymentsonoutstandingdebtsforwastewater 58collectionandtreatmentsystemswhencalculatingprojectedrates; 59 (5)Aninclusionofwaystoreduceeconomicimpactsondistressedpopulationsinthe 60community,includingbutnotlimitedtolow-andfixed-incomepopulations.This 61requirementincludesbutisnotlimitedto: 62 (a)Allowingadequatetimeinimplementationschedulestomitigatepotentialadverse 63impactsondistressedpopulationsresultingfromthecostsoftheimprovementsandtaking 64intoconsiderationlocalcommunityeconomicconsiderations;and HCSSSSCSSB1351 16 65 (b)Allowingforreasonableaccommodationsforregulatedentitieswheninflexible 66standardsandfineswouldimposeadisproportionatefinancialhardshipinlightofthe 67environmentalbenefitstobegained;
