83subdivision(12),(13)or(14)ofthissubsectionshallnotasaconditionofeligibilityforMO
84HealthNetbenefitsberequiredtoapplyforaidtofamilieswithdependentchildren.The
85familysupportdivisionshallutilizeanapplicationforeligibilityforsuchpersonswhich
86eliminatesinformationrequirementsotherthanthosenecessarytoapplyforMOHealthNet
87benefits.Thedivisionshallprovidesuchapplicationformstoapplicantswhosepreliminary
88incomeinformationindicatesthattheyareineligibleforaidtofamilieswithdependent
89children.ApplicantsforMOHealthNetbenefitsundersubdivision(12),(13)or(14)ofthis
90subsectionshallbeinformedoftheaidtofamilieswithdependentchildrenprogramandthat
91theyareentitledtoapplyforsuchbenefits.Anyformsutilizedbythefamilysupportdivision
92forassessingeligibilityunderthischaptershallbeassimpleaspracticable;
93 (19)Subjecttoappropriationsnecessarytorecruitandtrainsuchstaff,thefamily
94supportdivisionshallprovideoneormorefull-time,permanenteligibilityspecialiststo
95processapplicationsforMOHealthNetbenefitsatthesiteofahealthcareprovider,ifthe
96healthcareproviderrequeststheplacementofsucheligibilityspecialistsandreimbursesthe
97divisionfortheexpensesincludingbutnotlimitedtosalaries,benefits,travel,training,

100careproviderifthehealthcareproviderrequeststheplacementofsuchaneligibilityspecialist
101andreimbursesthedivisionfortheexpenses,includingbutnotlimitedtothesalary,benefits,
102travel,training,telephone,supplies,andequipment,ofsuchaneligibilityspecialist.The
103divisionmayseektoemploysucheligibilityspecialistswhoareotherwisequalifiedforsuch
104positionsandwhoarecurrentorformerwelfareparticipants.Thedivisionmayconsider
105trainingsuchcurrentorformerwelfareparticipantsaseligibilityspecialistsforthisprogram;
106 (20)Pregnantwomenwhoareeligiblefor,haveappliedforandhavereceivedMO
107HealthNetbenefitsundersubdivision(2),(10),(11)or(12)ofthissubsectionshallcontinue
108tobeconsideredeligibleforallpregnancy-relatedandpostpartumMOHealthNetbenefits
109providedundersection208.152untiltheendofthesixty-dayperiodbeginningonthelastday
110oftheirpregnancy.Pregnantwomenreceivingmentalhealthtreatmentforpostpartum
111depressionorrelatedmentalhealthconditionswithinsixtydaysofgivingbirthshall,subject
112toappropriationsandanynecessaryfederalapproval,beeligibleforMOHealthNetbenefits
113formentalhealthservicesforthetreatmentofpostpartumdepressionandrelatedmental
114healthconditionsforuptotwelveadditionalmonths.Pregnantwomenreceivingsubstance
115abusetreatmentwithinsixtydaysofgivingbirthshall,subjecttoappropriationsandany
116necessaryfederalapproval,beeligibleforMOHealthNetbenefitsforsubstanceabuse
117treatmentandmentalhealthservicesforthetreatmentofsubstanceabusefornomorethan
118twelveadditionalmonths,aslongasthewomanremainsadherentwithtreatment.The
HCSSSSB1359	4 119departmentofmentalhealthandthedepartmentofsocialservicesshallseekanynecessary
120waiversorstateplanamendmentsfromtheCentersforMedicareandMedicaidServicesand
121shalldeveloprulesrelatingtotreatmentplanadherence.Nolaterthanfifteenmonthsafter
122receivinganynecessarywaiver,thedepartmentofmentalhealthandthedepartmentofsocial
123servicesshallreporttothehouseofrepresentativesbudgetcommitteeandthesenate
124appropriationscommitteeonthecompliancewithfederalcostneutralityrequirements;
125 (21)Casemanagementservicesforpregnantwomenandyoungchildrenatriskshall
126beacoveredservice.Tothegreatestextentpossible,andincompliancewithfederallawand
127regulations,thedepartmentofhealthandseniorservicesshallprovidecasemanagement
128servicestopregnantwomenbycontractoragreementwiththedepartmentofsocialservices
129throughlocalhealthdepartmentsorganizedundertheprovisionsofchapter192orchapter

136services.Thedepartmentofsocialservicesshallbyregulationestablishthemethodologyfor
137reimbursementforcasemanagementservicesprovidedbythedepartmentofhealthandsenior
138services.Forpurposesofthissection,theterm"casemanagement"shallmeanthose
139activitiesoflocalpublichealthpersonneltoidentifyprospectiveMOHealthNet-eligiblehigh-
140riskmothersandenrolltheminthestate'sMOHealthNetprogram,referthemtolocal
141physiciansorlocalhealthdepartmentswhoprovideprenatalcareunderphysicianprotocol
142andwhoparticipateintheMOHealthNetprogramforprenatalcareandtoensurethatsaid
143high-riskmothersreceivesupportfromallprivateandpublicprogramsforwhichtheyare
144eligibleandshallnotincludeinvolvementinanyMOHealthNetprepaid,case-managed
145programs;
146 (22)ByJanuary1,1988,thedepartmentofsocialservicesandthedepartmentof

239furnishedinorafterthethirdmonthbeforethemonthinwhichhemadeapplicationforsuch
240assistanceifsuchindividualwas,oruponapplicationwouldhavebeen,eligibleforsuch
241assistanceatthetimesuchcareandserviceswerefurnished;provided,further,thatsuch
242medicalexpensesremainunpaid.
243 5.ThedepartmentofsocialservicesmayapplytothefederalDepartmentofHealth
244andHumanServicesforaMOHealthNetwaiveramendmenttotheSection1115
245demonstrationwaiverorforanyadditionalMOHealthNetwaiversnecessarynottoexceed
246onemilliondollarsinadditionalcoststothestate,unlesssubjecttoappropriationordirected
247bystatute,butinnoeventshallsuchwaiverapplicationsoramendmentsseektowaivethe
248servicesofaruralhealthclinicorafederallyqualifiedhealthcenterasdefinedin42U.S.C.

17unauthorizedaccess,andthedepartmentofrevenueshallmaintainahistoricalrecordofthe
18systemdataforaperiodofnomorethantwelvemonthsfromthedateofallrequestsand
19responses.Thesystemshallbeusedforverificationofthefinancialresponsibilityrequired
20underthischapter.Thesystemshallbeaccessibletoauthorizedpersonnelofthedepartment

3control.Anindividualisnotdeemedtoacquirecontrolofalicenseeandisnotsubjectto

59annuitiesarenotcoveredinwholeorinpartbyoneormoreguarantyassociations,the

61electtoassumetherightsandobligationsofthecedinginsurerunderanyoneormoreof
62thereinsurancecontractsthatrelatetothepoliciesorannuities,providedthecontracts
63havenotbeenterminatedassetforthinsubsection2ofthissection.Theelectionshall
64bemadebysendingwrittennotice,returnreceiptrequested,totheaffectedreinsurers.
65Inthatevent,paymentofpremiumsonthereinsurancecontractsforthepoliciesand
66annuities,forperiodsbothbeforeandafterthedateoftheorderofliquidation,shallbe
67chargeableagainsttheestateasaclass1administrativeexpense.Amountspaidbythe
68reinsureronaccountoflossesonthepoliciesandannuitiesshallbetotheestateofthe

70 5.Duringtheperiodfromthedateoftheorderofliquidationuntilthedatethe
71guarantyassociationorthereceiverelectstoassumetherightsandobligationsofthe
72cedinginsurerunderanyoneormoreofthereinsurancecontractsthatrelatetothe
73policiesorannuitiesasprovidedforinsubsection3or4ofthissection,theguaranty
74association,thereceiver,andthereinsurershallnothaveanyrightsorobligationsunder
75anyreinsurancecontractthatiseligibleforassumptionbysuchassociationorthe

77 6.(1)Iftheguarantyassociationorthereceiver,asthecasemaybe,hastimely
78electedtoassumeareinsurancecontractpursuanttosubsection3or4ofthissection,as
79applicable,theparties'rightsandobligationsshallbegovernedbytheprovisionsof

109 9.Whenareinsurancecontractisterminatedpursuanttosections375.1150to
110375.1246,thereinsurerandthereceivershallcommenceamandatorynegotiation
111procedureinaccordancewiththissubsection:
112 (1)Nolaterthanthirtydaysafterthedateoftermination,eachpartyshall
113appointanactuarytodetermineanestimatedsumdueasaresultoftheterminationof
