                    HB101--ZERO-EMISSIONSCHOOLBUSES

Thisbillenactsprovisionsrelatingtocontractsforzero-emission
schoolbuses.Thebillspecifiesthatacontractbetweenaschool
districtandapartycontractingtoprovidetransportation services
totheschooldistrictisjointlyrenewableattheendofthe
contracttermforatermnomorethan15years,andmustinclude
allofthetermsofthepreviouscontractandanyprovisions
increasingratesbasedonincreasedcosts.Iftheschooldistrict
canexerciseanoptioneithertopurchasethebusesorcancelthe
leaseattheendofeachannualperiodduringthecontract,the
contractmaybemadeforatermnotmorethan20years.Thebill
allowsforacontracttobenegotiatedannuallywithinthecontract
periodwheneconomicfactorsindicatenegotiationisnecessaryto
maintainanequitablepricingstructure. Renegotiationissubject
totheapprovalofbothcontractingparties. Anyrental,lease,or
lease-purchaseofaschoolbusmustcomplywithChapter177,RSMo.
Thebillalsorequiresthat,beginningJanuary1,2036,100%ofall
newlypurchasedorcontractedschoolbusesmustbezero-emission
vehicles,wherefeasible. Ifaschooldistrictdeterminesthatthe
purchaseorleaseofazero-emissionschoolbusisnotfeasibledue
tobothterrainandrouteconstraints,itmayrequestaone-time
extensionforatermnottoexceedfiveyears.Theschooldistrict
mustreasonablydemonstratesthatadailyplannedbusroutefor
transportingpupilstoandfromschoolcannotbeservicedthrough
availablezero-emissiontechnologyandtheDepartmentofNatural
Resources,consultingwiththeMissouriAirConservation
Commission,willdeterminewhethertograntaone-timeextension.
BeginningJanuary1,2041,ifaschooldistrictwithanaverage
dailyattendanceof350orlessdeterminesthatthepurchaseor
leaseofazero-emissionschoolbusinnotfeasibleduetoboth
terrainandrouteconstraints,theschooldistrictmayrequest
annualextensionswiththelastextensionexpiringonJanuary1,
2046.Theschooldistrictmustreasonablydemonstratesthata
dailyplannedbusroutefortransportingpupilstoandfromschool
cannotbeservicedthroughavailablezero-emissiontechnologyin
theperiodinwhichtheannualwaiverissoughtandtheDepartment
ofNaturalResources,consultingwiththeMissouriAirConservation
Commission,willdeterminewhethertograntstheannualextension.
