Thisbillmodifiesseveralprovisionsrelatingtoassistant
physicians.
Thebilladjuststhedefinitionof"assistantphysician"by
expandingtheeligibilitytopersonswhohavecompletedstep2or3
oftheUnitedStatesMedicalLicensingExamination(USMLE). The
billalsorepealscertainprovisionsgoverningtheconditionsof
thethree-yearperiodprecedingtheapplicationforlicensureasan
assistantphysicianthatincludedgraduationfromamedicalor
osteopathicmedicalcollege,aswellaswhetherthepersonwas
servingasaresidentphysician.
Thisbillalsoaddstothedefinitionofan"assistantphysician
collaborativepracticearrangement"toincludesucharrangements
occurringinafederallyqualifiedhealthcenter,aswellas
providingthattheprovisionslimitingtheassistantphysician
withinthecollaborativepracticearrangementdonotapplytothose
receivingpostgraduatetrainingunderanauthorizedpreceptor,as
providedinthebill.
Currentlawrequireshealthbenefitplansorcarrierstoreimburse
assistantphysiciansforservicesonthesamebasisas
reimbursementforcomparablemid-levelhealthcareproviders,
includingphysicianassistants. Thisbilladdscertifiednurse
practitionerstothisprovision.
ThebillalsodesignatestheDepartmentofCommerceandInsurance
astheentityenforcingtheaboveprovisionsofthisbill.
Thebilladditionallyprovidestwopathwaysforanassistant
physicianwithalicenseingoodstandingtobecomealicensed
physician.
Thefirstpathwayrendersanassistantphysicianeligibleifheor
shehasanactivelicensewithoutanydisciplinaryactions,has
completedStep3oftheUSMLEortheequivalent,hascompleted60
monthsofcumulative,full-time,hands-onactivecollaborative
practice,whichincludesbimonthlydidactictrainingreportstothe
collaborativephysician,hascompletedthepostgraduatetraining
underapreceptorspecifiedinthebill,hascompletedatleast100
hoursofcontinuingmedicaleducationeverytwoyears,andhas
submittedtotheboardlettersofrecommendation fromcertain
physicians. Thesecondpathwayrendersanassistantphysicianeligibleifheor
shehascompletedStep3oftheUSMLE,hascompletedsixtymonths
ofcumulative,full-time,hands-on,activecollaborativepractice,
completedatleast100hoursofcontinuingmedicaleducationevery
twoyears,andhassubmittedtotheboardlettersofrecommendation
fromthephysicianwhohasservedasthecollaboratingphysicianin
thecollaborativepracticearrangementandoneotherlicensed
physicianingoodstandinginthisState.
TheprovisionsofthesecondpathwayexpireonAugust28,2030.
