BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Sections556.036and556.037,RSMo,arerepealedandonenewsection
2enactedinlieuthereof,tobeknownassection556.036,toreadasfollows:
556.036.1.Aprosecutionformurder,[rapeinthefirstdegree,forciblerape,
2attemptedrapeinthefirstdegree,attemptedforciblerape,sodomyinthefirstdegree,forcible
3sodomy,attemptedsodomyinthefirstdegree,attemptedforciblesodomy] anoffenseunder
4chapter566,oranyclassAfelonymaybecommencedatanytime.
5 2.Exceptasotherwiseprovidedinthissection,prosecutionsforotheroffensesmust
6becommencedwithinthefollowingperiodsoflimitation:
7 (1)Foranyfelony,threeyears,exceptasprovidedinsubdivision(4)ofthis
8subsection;
9 (2)Foranymisdemeanor,oneyear;
10 (3)Foranyinfraction,sixmonths;
11 (4)Foranyviolationofsection569.040,whenclassifiedasaclassBfelony,orany
12violationofsection569.050or569.055,fiveyears.
13 3.Iftheperiodprescribedinsubsection2ofthissectionhasexpired,aprosecution
14mayneverthelessbecommencedfor:
15 (1)Anyoffenseamaterialelementofwhichiseitherfraudorabreachoffiduciary
16obligationwithinoneyearafterdiscoveryoftheoffensebyanaggrievedpartyorbyaperson
17whohasalegaldutytorepresentanaggrievedpartyandwhoishimselforherselfnotaparty
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18totheoffense,butinnocaseshallthisprovisionextendtheperiodoflimitationbymorethan
19threeyears.Asusedinthissubdivision,theterm"personwhohasalegaldutytorepresentan
20aggrievedparty"shallmeantheattorneygeneralortheprosecutingorcircuitattorneyhaving
21jurisdictionpursuanttosection407.553,forpurposesofoffensescommittedpursuantto
22sections407.511to407.556;and
23 (2)Anyoffensebaseduponmisconductinofficebyapublicofficeroremployeeat
24anytimewhenthepersonisinpublicofficeoremploymentorwithintwoyearsthereafter,but
25innocaseshallthisprovisionextendtheperiodoflimitationbymorethanthreeyears;and
26 (3)Anyoffensebaseduponanintentionalandwillfulfraudulentclaimofchild
27supportarrearagetoapublicservantintheperformanceofhisorherdutieswithinoneyear
28afterdiscoveryoftheoffense,butinnocaseshallthisprovisionextendtheperiodof
29limitationbymorethanthreeyears.
30 4.Anoffenseiscommittedeitherwheneveryelementoccurs,or,ifalegislative
31purposetoprohibitacontinuingcourseofconductplainlyappears,atthetimewhenthe
32courseofconductortheperson'scomplicitythereinisterminated.Timestartstorunonthe
33dayaftertheoffenseiscommitted.
34 5.Aprosecutioniscommencedforamisdemeanororinfractionwhentheinformation
35isfiledandforafelonywhenthecomplaintorindictmentisfiled.
36 6.Theperiodoflimitationdoesnotrun:
37 (1)Duringanytimewhentheaccusedisabsentfromthestate,butinnocaseshall
38thisprovisionextendtheperiodoflimitationotherwiseapplicablebymorethanthreeyears;
39 (2)Duringanytimewhentheaccusedisconcealinghimselforherselffromjustice
40eitherwithinorwithoutthisstate;
41 (3)Duringanytimewhenaprosecutionagainsttheaccusedfortheoffenseispending
42inthisstate;
43 (4)Duringanytimewhentheaccusedisfoundtolackmentalfitnesstoproceed
44pursuanttosection552.020;or
45 (5)DuringanyperiodoftimeafterwhichaDNAprofileisdevelopedfromevidence
46collectedinrelationtothecommissionofacrimeandincludedinapublishedlaboratory
47reportuntilthedateuponwhichtheaccusedisidentifiedbynamebaseduponamatch
48betweenthatDNAevidenceprofileandtheknownDNAprofileoftheaccused.Forpurposes
49ofthissection,theterm"DNAprofile"meansthecollectiveresultsoftheDNAanalysisofan
50evidencesample.
[556.037.1.Notwithstandingtheprovisionsofsection556.036,
2 prosecutionsforunlawfulsexualoffensesinvolvingapersoneighteenyearsof
3 ageorundermaybecommencedatanytime.
