BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Chapter160,RSMo,isamendedbyaddingtheretoonenewsection,tobe 2knownassection160.426,toreadasfollows: 160.426.1.BeginningAugust28,2025,nocharterschoolshallbeeligibleto 2operateinthisstatewithoutthestateboardofeducation'sissuanceofacertificateof 3needforsuchcharterschoolasprovidedinthissection. 4 2.Acertificateofneedshallberequiredonlyforproposedcharterschoolsthat 5arenotestablishedasofAugust28,2025,andshallnotberequiredfor: 6 (1)Therenewalofachartercontractpursuanttotheprovisionsofsection 7160.405;or 8 (2)Thetransferofsponsorshipofacharterschoolinaccordancewithrules 9promulgatedbythestateboardofeducation. 10 3.Thissectionshallnotbeconstruedtoexemptacharterschoolfromthe 11requirementsofsection160.405oranyotherapplicablestateorfederallawor 12regulation. 13 4.Thecharterschoolcertificateofneedapplicationshallconsistofawritten 14certification,includingsupportingdocumentation,submittedbythegoverningboardof 15theschooldistrictorthegoverningbodyofthecityorcountyinwhichtheproposed 16charterschoolwouldbelocated,affirmingthatthefollowingconditionsapplytothe 17schooldistrictinwhichtheproposedcharterschoolwouldbeoperated: 18 (1)Consumerdemandforalternativeeducationaloptionsexceedssupply; EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19 (2)Theschooldistrict'sattendanceareacontainssufficienteconomiesofscaleto 20ensurebothanadequatesupplyofhigh-qualityteachersandasufficientnumberof 21potentialstudentsinorderfortheproposedcharterschooltosucceedwithout 22detrimentallyimpactingtheschooldistrict'sabilitytoprovideafreepubliceducation 23forstudentswhoenrollintheschooldistrict.Forpurposesofthissubdivision, 24"economiesofscale"shallmeanthecapacitytoreducecostsandincreaseefficiencyas 25studentenrollmentnumberschange;and 26 (3)Theproposedcharterschoolislikelyto: 27 (a)Alleviateeconomicandracialinequitiesacrosstheschooldistrict's 28attendancecenters; 29 (b)Improvestudents'academicachievementandtestscores; 30 (c)Reducestudent-teacherratiosacrosstheschooldistrict; 31 (d)Resultinamoreefficienteducationservicedeliverysystemwithout 32superfluousduplicationofservices; 33 (e)Limitthenumberofschoolingdisruptionsfacedbychildrenandfamilies; 34and 35 (f)Addressfamilyprioritiesthatarenotstrictlyeducationalinnatureincluding, 36butnotlimitedto,safety,convenience,transportationtime,neighborhoodwalkability, 37andschoolculture. 38 5.Thestateboardofeducationshallrevieweachcharterschoolcertificateof 39needapplicationandeitherapproveordisapproveeachapplicationwithinonehundred 40twentycalendardaysofreceipt.Iftheboarddeterminesthattheinformationprovided 41intheapplicationisfactualandbasedonsounddataandreasoning,theboardshall 42considertheconditionsofthissubsectiontobesatisfiedandtheboardshallapprove 43suchapplication.Iftheboarddeterminesthattheinformationprovidedinthe 44applicationisnotfactualandbasedonsounddataandreasoning,theboardshall 45disapprovetheapplicationandprovidetotheapplicantwrittendocumentationofthe 46reasonswhytheapplicationwasnotapproved. ✔ HB1056 2
